RESOLUTION 24-130 A RESOLUTION REQUESTING A VARIANCE FROM STANDARD FOR STATE AID OPERATION FOR LORDS STREET BRIDGE REHABILITATION (2024-02) CP NO. 2024-02/S.A.P. 201-597-001 Motion By: Braid Second By: Lake WHEREAS, the City of Prior Lake is preparing plans for Lords Street Bridge Rehabilitation
Project which includes Bridge Number 70513 (75 foot length), which is located within Township 115N, Section 35, Range 22W, within the City of Prior Lake, located approximately 1900 feet east of Eagle Creek Boulevard (Scott County CSAH 21) along Lords Street; and WHEREAS, Minnesota Rules for State Aid Operation 8820.9922 requires a minimum bridge width of 30 feet and a minimum shoulder width of 4 feet; and WHEREAS, the achievement of a 30-foot width would require full removal and replacement of the existing bridge (28’-1” wide) and the structural integrity of the bridge can be restored by means of deck replacement; and WHEREAS, the primary reasons for this variance request are:
• significant financial hardship posed by the cost of a full bridge replacement that serves a relatively small number of residents
• hardships related to the loss of the sole access to properties east of the bridge during construction. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows:
1. The City Council does hereby request a variance from the Minnesota Department of
Transportation State Aid Operations Rules Chapter 8820. 9922 (Minimum Design
Standards; New Bridge, Bridge Replacement, or Bridge Rehabilitation Projects and Approach Roadways on Rural or Suburban Undivided Roadways that are not on the State Aid System) to allow for a bridge width of 28 feet - 1 inch and shoulder widths of 3 feet and
½ inch for the full length of the bridge. 2. The City of Prior Lake City Council hereby indemnifies, saves and hold harmless the State
of Minnesota and its agents and employees from claims, demands, actions, or causes of action arising out of or by reason of bridge rehabilitation of the Lords Street Bridge in accordance with Minnesota Rules 8820.9922 and further agrees to defend at their sole cost
and expense any action or proceeding commenced for the purpose of asserting any claim arising as a result of the granting this variance. Passed and adopted by the Prior Lake City Council this 26th day of November, 2024.
