HomeMy WebLinkAbout24-132 Resolution Ordering the Improvements for the Martindale Henning Hickory Reclamation Project 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 24-132 A RESOLUTION ORDERING THE IMPROVEMENTS FOR THE MARTINDALE HENNING HICKORY RECLAMATION PROJECT (CP 2025-03) Motion By: Burkart Second By: Churchill WHEREAS, the Prior Lake City Council on its own initiative has determined that it desires to complete the Public Improvements for the Martindale Henning Hickory Reclamation Project; and WHEREAS, on June 25, 2024 the City Council accepted the Feasibility Report and called for a Public Hearing to be held for the Martindale Henning Hickory Reclamation Project which includes improvements to aggregate base, curb and gutter, bituminous surfacing, some components of the storm sewer systems, and other appurtenant work; and WHEREAS, ten days’ mailed notice and two weeks’ published notice of the hearing was given, and the hearing was held on July 23, 2024 at which time all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, since the project was initiated by the City Council it must be approved by a 4/5 vote in accordance with Minnesota Statutes 429.031 Subdivision 1(f). NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report. 3. The City Council, by the required statutory 4/5 vote, does hereby order the project as outlined in the feasibility report. 4. The City Engineer is hereby designated as the Engineer for these improvements and is authorized to record engineering expenses in the construction fund TRN24-000003. 5. The Engineer shall prepare plans and specifications for the making of such improvements for the Martindale Henning Hickory Reclamation Project (CP 2025-03). 6. The City shall let the contract for all or part of the work to be performed in 2025, or order all or part of the work done by day labor or otherwise as may be authorized by law, no later than one year after the adoption of this resolution. 7. The City Council authorizes the following preliminary funding sources and corresponding transfers to the construction fund for the project: M:\2- City Clerk\City Council\Resolutions\2024\24-133 Resolution Ordering the Improvements for the Martindale Henning Hickory Reclamation Project .docx 2 PROPOSED FUNDING Assessment ($8,100 x 30 parcels) $243,000 Tax Levy $458,400 Utility Fund – Stormwater $150,000 SMSC Cost Share $48,600 Total $900,000 Passed and adopted by the Prior Lake City Council this 26th day of November, 2024.
