RESOLUTION 24- 133 A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE A TERMINATION OF DEVELOPMENT CONTRACT FOR SHEPHERD’S PATH; THE PARTIAL RELEASE OF THE PLANNED UNIT DEVELOPMENT CONTRACT FOR SHEPHERD’S PATH; AND AN AMENDED PUBLIC PROPERTY USE PERMIT REGARDING SHEPHERD OF THE LAKE EVANGELICAL LUTHERAN CHURCH Motion By: Burkart Second By: Churchill

The Shakopee Mdewakanton Sioux Community, a federally recognized sovereign Native American Tribe (“SMSC”) is in the process of acquiring property located within the City of Prior Lake, legally described as:
That part of Lot 1, Block 2, Shepherds Path Addition, Scott County, Minnesota, lying west of the following described line: Commencing at the most easterly southeast corner of said Lot 1; thence South 89 degrees 10 minutes 17 seconds West, assumed bearing, along a southerly line of said Lot 1, a distance of 326.45 feet to the point of beginning of the line to be described; thence on a bearing of North a distance of 478.48 feet, more or less, to the northerly line of said Lot 1 and there terminating. (p/o PID 254520022)
And Outlot B, Shepherds Path Addition, Scott County, Minnesota (PID 254520060) together the (“Property”); Lot 1, Block 2, and Outlot B, Shepherds Path Addition is currently encumbered by that certain Development Contract for Shepherd’s Path entered into on June 26, 2006 between the City of Prior Lake, Shepherd of the Lake Lutheran Church (“SOLLC”), and Shepherd’s Path Senior Housing, Inc. and recorded in the Office of the Scott County Recorder on July 7, 2006 as Document No. 744390; and
Lot 1, Block 2, and Outlot B, Shepherds Path Addition is currently encumbered by that certain Contract for Development of Land as a Planned Unit Development to be Known as Shepherd’s Path entered into on June 26, 2006 between the City of Prior Lake, SOLLC, and Shepherd’s Path Senior Housing, Inc. and recorded in the Office of the Scott County Recorder on July 7, 2006 as Document No. 744391; and
Lot 1, Block 2, Shepherds Path Addition is currently encumbered by that certain Public Property Use Permit regarding SOLLC entered into on April 11, 2017 between
the City of Prior Lake and SOLLC and recorded in the Office of the Scott County Recorder on April 24, 2017 as Document No. 1023975; and
WHEREAS, The SMSC has requested the City of Prior Lake modify or terminate the above contracts and permits for which the obligations have been completed, or which create
barriers to the future transfer of the land into trust with the Bureau of Indian Affairs; and

WHEREAS, On November 26, 2024, the Prior Lake City Council authorized the Mayor and City Manager to execute the termination of the Development Contract for Shepherd’s Path; the partial release of the Contract for Development of Land as a Planned Unit Development known as Shepherd’s Path; and an amended Public Property Use Permit regarding Shepherd of the Lake Evangelical Lutheran Church. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows:
1. The recitals set forth above are incorporated herein as if fully set forth. 2. The Mayor and City Manager are hereby authorized to execute the termination of the Development Contract for Shepherd’s Path; the partial release of the Contract for
Development of Land as a Planned Unit Development known as Shepherd’s Path; and an amended Public Property Use Permit regarding Shepherd of the Lake Evangelical Lutheran Church. Passed and adopted by the Prior Lake City Council this 26th day of November 2024. VOTE Briggs Braid Burkart Churchill Lake
