Holdings, LLC, is requesting to amend the Official Zoning Map from R-1, Low Density Residential to C-2, General Business at 6025 170th St. E. History Property owner, M.P. Holdings, LLC, is requesting to amend the Official Zoning Map to rezone property at 6025 170th Street E. from R-1, Low Density Residential to C-2, General Business. The property owner recently received approval of a preliminary and final plat to be known as Revere Addition which created an approximate 1.42 acre parcel to the west of Revere Way that is currently occupied with a 4,860 sq. ft. building and surface parking lot. The east side of Revere Way is proposed for future commercial development and has been platted as an approximate 7.16 acre Outlot. Prior Lake City Code Subsection 1120.501, Designation of Annexed Property, Zoning of Land, states, land areas which may be added to the City by annexation, merger, or other means shall be classified as R-1 (Low Density Residential) on the Zoning Map upon annexation. In conformance with City Code, this property was automatically zoned R-1, Low Density Residential when it was annexed into the City of Prior Lake from Credit River Township in 2018. Current Circumstances The City of Prior Lake Comprehensive Land Use Map guides this property as Retail/General Business. Rezoning of the property from R-1 to C-2, General Business would bring the parcel into conformance with Comprehensive Plan guidance. Subsection 1153.209 of City Code identifies the following policies for amendments to the Official Zoning Map: ➢ The area, as presently zoned, is inconsistent with the policies and goals of the Comprehensive Plan, or the land was originally zoned erroneously due to a technical or administrative error, or ➢ The area for which rezoning is requested has changed or is changing to such a degree that it is in the public interest to rezone so as to encourage redevelopment of the area, or ➢ The permitted uses allowed within the proposed Zoning District will be appropriate on the subject property and compatible with adjacent properties and the neighborhood. Conclusion Rezoning of this property from R-1 to C-2 was a condition of approval for a recent Conditional Use Permit and the Combined Preliminary and Final Plat approval for Revere Addition. City staff finds the area, as presently zoned, is inconsistent with the policies and goals of the Comprehensive Plan. The permitted uses allowed within the General Commercial (C-2) Zoning District will be appropriate on the subject property and compatible with the zoning of adjacent properties. Based on these findings, City Staff recommends approval of the rezoning request. ALTERNATIVES: 1. Motion and a second to recommend the City Council approve the rezoning request from R-1, Low Density Residential to C-2, General Business for the property at 6025 170th Street E. 2. Motion and a second to recommend the City Council deny the rezoning request from R-1, Low Density Residential to C-2, General Business for the property at 6025 170th Street E. 3.
