RESOLUTION 24-139 A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE TWO TERMINATION OF ASSESSMENT DEVELOPMENT AGREEMENTS Motion By: Burkart Second By: Braid
WHEREAS, WHEREAS, WHEREAS, WHEREAS,
The City of Prior Lake and MP Holdings, LLC, a Minnesota limited liability company (“Developer 1”) entered into that certain Assessment Development Agreement dated December 5, 2022 (the “Assessment Agreement 1”) and
recorded of record in the office of the Scott County, Minnesota Recorder on December 16, 2022 as Document No. A1168146 pertaining to the real property set forth and leally described as follows:
The West 919.00 feet (as measured at right angles) of that part of the North half of the Northwest Quarter (N ½ of NW ¼) of Section 7, Township 114,
Range 21, Scott County, Minnesota, lying North of the Northerly right of way
line of Eagle Creek Avenue, Scott County, Minnesota (PID 259070010) (the “Property 1”); and The City of Prior Lake and PL 170th Street, LLC, a Minnesota limited liability company (“Developer 2”) entered into that certain Assessment Development Agreement dated December 5, 2022 (the “Assessment Agreement 2”) and recorded of record in the office of the Scott County, Minnesota Recorder on
December 16, 2022 as Document No. A1168147 pertaining to the real property set forth and leally described as follows:
The south 1391.13 feet of the west half of the Southwest Quarter of Section
6, Township 114, Range 21, Scott County, Minnesota, lying west of the of the east 366 feet thereof, Except the west 375.75 feet of the east 741.75
feet of the south 1391.13 feet of the west half of the Southwest Quarter of
Section 6, Township 114, Range 21, Scott County, Minnesota. (PID 259060060) (the “Property 2”); and
Developer 1 and Developer 2 have fulfilled their obligations and fully paid the special assessments assessed against the Property 1 and Property 2; and On December 10, 2024, the Prior Lake City Council authorized the Mayor and City Manager to execute a Termination of Assessment Development Agreement with MP Holdings, LLC and PL 170th Street, LLC. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows:
1. The recitals set forth above are incorporated herein as if fully set forth. 2. The Mayor and City Manager are hereby authorized to execute the Termination of Assessment Development Agreement with MP Holdings, LLC and the Termination of
Development Agreement with PL 170th Street, LLC.
