AGENDA ITEM: Resolution Approving a Public Property Use Permit at 16309 Main
Avenue SE
RECOMMENDED ACTION:
Approval of a resolution approving a Public Property Use Permit (PPUP) with YT's Garage, LLC,
and the Carol Rae Johnson Revocable Trust to allow a patio to be constructed partially within an
existing public drainage and utility easement at 16309 Main Avenue SE.
BACKGROUND:
YT's Garage, LLC is currently remodeling an existing building owned by the Carol Rae Johnson
Revocable Trust at 16309 Main Avenue SE into a bar and restaurant. YT's is proposing to
construct a covered patio at the rear of the property, a portion of which would encroach into an
existing public drainage and utility easement. Comm unity Development and Public Works staff
are supportive of the request, provided the patio maintains a minimum distance of 10 ft. from the
existing sanitary sewer pipe.
Conclusion
The attached PPUP would allow for construction and maintenance of the patio provided the use
does not interfere with the public's use of the drainage and utility easement. The City may
terminate this PPUP at any point if the private use adversely interferes with the public's right to
use the easement area or for any other reason at the City's sole discretion. If terminated, the
property owners have thirty (30) days from receipt of written notice to remove the patio and restore
the easement area to the condition it existed in prior to the placement of the patio.
FINANCIAL IMPACT:
No financial impact is anticipated. The City will not be responsible for any costs related to
maintenance, removal or replacement of the patio if needed in the future.
ALTERNATIVES:
1.Motion and Second, as part of the Consent Agenda, approving the Resolution approving
the Public Property Use Permit.
2.Remove this item from the consent agenda for additional discussion.
