RECOMMENDED ACTION:
1. Adopt a resolution adopting the assessment roll for the Martindale/Henning/Hickory
Reclamation Project (2025-03).
2. Adopt a resolution receiving bids and awarding the contract for the
Martindale/Henning/Hickory Reclamation Project (2025-03).
BACKGROUND:
The Martindale/Henning/Hickory Reclamation Project includes reclamation of the existing
roadway and storm sewer improvements for Martindale St NE, Henning Cir NE and Hickory Ave
NE, as shown on the attached assessment map.
The City Council held a Public Hearing on November 26, 2024, and ordered the improvements
for the Martindale/Henning/Hickory Reclamation Project. At the April 22, 2025 meeting the City
Council accepted the plans and specifications and authorized the advertisement for bids.
The City received a total of five (5) bids on May 15, 2025. The bids have been reviewed and
tabulated by Bolton & Menk, Inc., the city’s consulting engineer on this project. OMG Midwest
Inc. Dba Minnesota Paving & Materials of Rogers, MN submitted the low bid in the amount of
$538,830.33, which is 17.9% below the engineer’s estimate of $656,480. The bid from Valley
Paving was rejected due to their submittal of the wrong documentation.

Bolton & Menk has provided the attached recommendation letter to award this project to OMG
Midwest Inc. Dba Minnesota Paving & Materials.

The project area contains 30 single-family residential properties. The proposed assessments,
which are calculated in accordance with the City of Prior Lake Assessment Policy, are shown in
the table below:

An assessment hearing conducted on July 22, 2025 will provide an extended prepay period
without interest to property owners, with a deadline for pre-payment of November 3, 2025.

A RESOLUTION ADOPTING THE ASSESSMENT ROLL FOR THE
MARTINDALE/HENNING/HICKORY RECLAMATION PROJECT (2025-03)

WHEREAS, Pursuant to proper notice duly given as required by law, the City Council has
met, heard and passed upon all objections to the proposed assessments for
the Martindale/Henning/Hickory Reclamation Project (2025-03).
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The proposed assessment for the Martindale/Henning/Hickory Reclamation Project (2025-
03), a copy of which is attached hereto and made part hereof, is hereby accepted and shall
constitute the special assessment against the lands named therein, and each tract of land
therein included is hereby found to be benefitted by the proposed improvement in the
amount of the assessment levied against it.
3. The portion of the cost of such improvements to be paid by the City is hereby declared to be
$600,730 and the portion of the cost to be assessed against benefited property owners is
declared to be $176,100.
4. Assessments shall be payable on an equal principal installment method extending over a
period of 10 years for street improvements. The first installment shall be the annual
principal plus interest calculated from the public hearing date to the end of this year plus
twelve months of the next year, and shall bear interest at the rate of 5.7% per annum from
the date of the adoption of the assessment resolution.
5. The owner of any property so assessed may, at any time prior to certification of the
assessment to the County Auditor, pay the whole of the assessment on such property, with
interest accrued to the date of payment, to the City Finance Director, except that no interest
will be charged if the entire assessment is paid by November 3, 2025. The owner may, at
any time thereafter, pay to the City Finance Director the entire amount of the assessment
remaining unpaid, with interest accrued to December 31 of the year in which such payment
is made. Such payment must be made before November 3 or interest will be charged
through December 31 of the succeeding year.
6. The Finance Director shall send a certified duplicate of the assessment to the County
Auditor to be extended on the property tax lists of Scott County. Such assessments shall be
collected and paid to the City in the same manner as other municipal taxes.

WHEREAS, pursuant to an advertisement for bids for the Martindale/Henning/Hickory
Reclamation Project which includes reclamation, bituminous curb, storm sewer
improvements, turf restoration and appurtenant work; and
WHEREAS, bids were received, opened, and tabulated according to law; and
WHEREAS, The following bids were received complying with the advertisement:

3. The Mayor and City Manager are hereby authorized to enter into the City’s standard
contract with OMG Midwest Inc. Dba Minnesota Paving & Materials in the name of the City
of Prior Lake for the Martindale/Henning/Hickory Reclamation Project in the amount of
$538,830.33.
4. The City Manager is hereby authorized and directed to return to all bidders the deposits that
accompanied their respective bids.
5. The City Council authorizes the following funding for this project:

Dear Mayor and Council Members,
Bids on the above-referenced project were opened on Thursday, May 15, 2025. There were five total bidders for
the project but one bid was rejected due to submission of improper bid documents leaving four accepted bids; a
tabulation of bids received, and a detailed bid abstract are enclosed. The low bidder on the project is OMG
Midwest, Inc. dba Minnesota Paving & Materials from Rogers, MN with a total bid of $538,830.33. Minnesota
Paving & Materials has previous experience on projects of this size and scope in the greater metro area and it is
our opinion that they are qualified to perform the work required under this contract.
Based on Minnesota Paving & Materials experience, acceptable total bid price under the engineer’s estimate, and
the competitive bids the City received, we recommend the City of Prior Lake award the project to OMG Midwest,
Inc. dba Minnesota Paving & Materials following the Special Assessment Hearing on July 22, 2025.
