AGENDA ITEM: Private Street/Public Utility Discussion
BACKGROUND:
This topic was first discussed with the City Council on October 5, 2020. The basis for the
discussion was to solicit input on how to fund the replacement of curb and gutter and pavement
when the city initiates a utility replacement project beneath private streets. Private streets are
established to be owned and maintained by the private property owners of the development
and/or home owners association when the original development is platted and constructed. The
sanitary sewer and watermains located beneath these private streets are publicly owned. Due to
the interconnected nature of these utilities with entire network throughout the city, it has been the
policy of the city to maintain ownership of those pipes.
There were a several methodologies discussed at that work session and eventually
communicated with the properties on private streets that would be impacted. The City Council
subsequently received feedback from numerous residents that were opposed to the concepts for
funding. Ultimately, a final decision was not reached and this issue has yet to be resolved.
We are bringing this topic back to the City Council due to the pending project in our Capital
Improvement Plan. The Green Heights/Inguadona neigbhorhood is scheduled to be reconstructed
in 2028 and will include the replacement of sanitary sewer and watermains beneath private
streets. It is therefore necessary to identify a funding source for those private streets.
Staff will provide a refresh on the information that was presented in 2020 and ask for direction
from City Council on options they might like to consider.
