AGENDA ITEM: Resolution Authorizing Concurrence for the Prior Lake Spring Lake
Watershed District to Obtain Drainage Authority for County Ditch 13
RECOMMENDED ACTION:
Adopt a resolution providing concurrence for the Prior Lake Spring Lake Watershed District
(PLSLWD) to obtain drainage authority for County Ditch 13 (CD 13) under authority of Minn. Stat.
103D.621, subdivision 4.
BACKGROUND:
County Ditch 13 is a key subwatershed to Spring Lake and is located south and west of Spring
Lake within Sand Creek Township and Spring Lake Township. A small portion is located within
the Prior Lake Orderly Annexation Area. See Attachment 2 for a figure showing the full reach of
CD 13.
Scott County is currently the drainage authority for CD 13. PLSLWD is interested in managing
CD 13 for the following reasons:
1. Management of CD 13 under watershed law, rather than the current drainage code,
would allow for more efficient and equitable charge allocations as property use
changes.
2. Greater efficiency in streamlining implementation projects adjacent to CD 13.
3. Easier identification and implementation of multipurpose drainage management practices
with willing landowners.
PLSLWD obtained concurrence from Sand Creek Township on October 2, 2025, and from Spring
Lake Township on October 9, 2025.
FINANCIAL IMPACT:
There is no financial impact to the City. PLSLWD would fund the management of CD 13 through
equitable charges to landowners benefitting from the system as well as through its ad valorem
taxing authority.
ALTERNATIVES:
1. Motion and second as part of the consent agenda to adopt a resolution providing
concurrence for PLSLWD to obtain drainage authority for County Ditch 13 under authority of
Minn. Stat. 103D.621, subdivision 4.
2. Motion and second to remove this item from the consent agenda for additional discussion.

RESOLUTION 26-
A RESOLUTION PROVIDING CONCURRENCE FOR THE PRIOR LAKE SPRING LAKE
WATERSHED DISTRICT TO OBTAIN DRAINAGE AUTHORITY FOR COUNTY DITCH 13
Motion By: Second By:
WHEREAS, County Ditch 13 (CD 13) is a key subwatershed to Spring Lake and has a
portion of its reach within the Prior Lake Orderly Annexation Area; and
WHEREAS, Scott County currently serves as the drainage authority for CD 13 and will be
transferring drainage authority to Prior Lake Spring Lake Watershed District;
and
WHEREAS, the transfer of drainage authority to Prior Lake Spring Lake Watershed District
would allow for efficiency in streamlining implementation projects and
equitable charge allocations for landowners.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City Council provides concurrence for the Prior Lake Spring Lake Watershed District to
obtain drainage authority for County Ditch 13 under authority of Minn. Stat. 103D.621,
subdivision 4.
