RECOMMENDED ACTION:
Adopt a resolution ordering the preparation of the feasibility report and approving a work order for
the preparation of a feasibility report for the proposed 170th Street improvements in the
annexation area (2027-05).
BACKGROUND:
The M.S. Chapter 429 process applies to all projects that will be financed in whole or part through
special assessments or bond proceeds. The first step in the process is for the Council to order
the preparation of a feasibility report for the improvement project. The feasibility report will address
options and costs for the street, utility, and storm sewer upgrades. City assessment policy will be
applied to the preliminary assessment calculation which is completed as a part of the feasibility
report. The feasibility report will provide the details needed for the city to make decisions on how
to proceed.
The proposed 170th Street Improvement Project seeks to urbanize 170th Street from Marschall
Road (CSAH 17) to Baseline Avenue (CASH 79) following the successful annexation of the area
that exists west of the current city limits.
With the annexation of this area and the urbanization of 170th Street, it is also proposed to extend
municipal utilities within the corridor. Sanitary sewer and water main are proposed to be extended
to the limits of the roadway improvements. It is anticipated that a lift station and force main will be
required to serve portions of the annexation area with sanitary sewer, as identified in the
Alternative Urban Areawide Review completed for the annexation area.
Storm sewer and stormwater management areas will also be required for the proposed urban
road section and to satisfy water quality and volume requirements for the new impervious surface
areas.
WSB LLC, a member of the city’s consultant pool, has submitted a proposal in the amount of
$122,370 to provide engineering services that include a topographic survey, geotechnical
services, and the preparation of a feasibility report for this proposed project. Specific details are
provided in the attached work order. Staff recommend approving this work order at this time.

FINANCIAL IMPACT:
The $122,370 cost for this work order will be funded by the trunk fund reserves. In the future
when this project is constructed and assessments are collected for the improvements, the trunk
fund expenditure for the feasibility study will be replenished.
ALTERNATIVES:
1. Motion and second as part of the consent agenda to adopt a resolution ordering the
preparation of the feasibility report and approving a work order for the preparation of a
feasibility report for the proposed 170th Street improvements in the annexation area
(2027-05).
2. Motion and second to remove this item from the consent agenda for additional
discussion.

WHEREAS, this project will also require the extension of water and sewer facilities, as well as
a plan for stormwater management in the area; and
WHEREAS, a feasibility report is needed to determine the best options for construction and
financing for this project; and
WHEREAS, WSB LLC, a member of the city’s consultant pool, has submitted a proposal in the
amount of $122,370 to provide engineering services that include a topographic
survey, geotechnical services, and the prepration of a feasibility report for this
proposed project; and
WHEREAS, city staff recommend approving the work order at this time.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.

WSB & ASSOCIATES, INCORPORATED, dba WSB LLC
This work order (“Work Order”) is issued on this 24th day of March, 2026 by the City of Prior
Lake (“City”) pursuant to the Public Works Consultant Pool – Master Agreement dated April 20,
2020 and as amended February 24, 2025 (“Contract”) between the City and WSB & Associates,
Incorporated, dba WSB LLC (“Consultant”).
Based on the mutual promises and covenants set forth herein, the sufficiency of which are
hereby acknowledged, the City and Consultant agree as follows:
1. Scope of Work Order. Consultant agrees to provide, perform and complete all the services
requested by the City in this Work Order and attached Exhibit 1 (“Work”), which Work shall
be subject to the terms and conditions of this Work Order and the Contract.
2. Term of Work Order. All Work requested by this Work Order shall be completed by
December 31, 2026.
3. Compensation for Work Order. City agrees to pay the Consultant an amount not to
exceed $122,370 as full and complete payment for the Work requested by this Work Order.
4. Consultant Representative. Consultant has designated Monica Heil to manage the Work
Order subject to the supervision of Consultant’s representative.

RE: Supplemental Agreement to Provide Professional Engineering Services to
complete Topographic Survey, Geotechnical Services and a Feasibility Report
for the City’s 170th Street Improvement Project
Dear Mr. Monserud:
On behalf of WSB we are pleased to submit this Supplemental Agreement to our Public Works
Consultant Pool Master Agreement, dated April 20, 2020 to provide engineering services to the
City of Prior Lake. Specifically, our services will include topographic survey, geotechnical
services and the preparation of a Feasibility Report for the City’s 170th Street Improvement
Project.
PROJECT UNDERSTANING
The project seeks to urbanize 170th Street from the existing curb and gutter limits west of the
intersection of Marschall Road (CSAH 17) at the westerly Springview Meadows plat limits to
Baseline Avenue (CASH 79) following the successful annexation of the area that exists west of the
current City limits. 170th Street exists as a two-lane rural paved roadway between the westerly plat
limits of Springview Meadows and Langford Avenue. Between Langford Avenue and Baseline
Avenue 170th Street exists as a rural two-lane gravel roadway.

The majority of the right-of-way (ROW) within the corridor is 66’ wide and is presumed to exist as
prescriptive rights adjacent to metes and bounds parcels. It is understood that 170th will be designed
to State Aid Standards and will also satisfy Scott County’s 40’-46’ face-to-face (FF)’ wide urban
roadway section, within a 110’ ROW (50’ on the north, 60’ on the south), in anticipation of a future
roadway turnback to Scott County. An 8’ bituminous trail is proposed along the north side of 170th
Street between Baseline Road and Marschall Road with the urbanization of 170th Street. A 5’
concrete sidewalk exists along the south side of 170th Street, adjacent to the Springview Meadows
plat. It is anticipated that future extension of that sidewalk will take place with development and
not the City’s 170th Street roadway improvements. The proposed typical section is shown below:
A separate improvement project, led by Scott County, proposes to construct a single lane
roundabout at the intersection of 170th Street and Marschall Road (CSAH 17) by 2030. A future
County-led improvement project is anticipated at the intersection of 170th Street and Baseline
Avenue by the year 2040, when it is anticipated another single lane roundabout will be needed at
that intersection to manage anticipated traffic volumes.
Proposed future intersection access points meeting County spacing requirements will also be
stubbed out along the corridor with this project.
With the annexation of this area and the urbanization of 170 th Street it is also desired to extend
municipal utilities within the corridor. Sanitary sewer and water main are proposed to be extended
to the limits of the roadway improvements. It is anticipated that a lift station and force main will be
required to serve portions of the annexation area with sanitary sewer, as identified in the Alternative
Urban Areawide Review (AUAR) completed for the annexation area. Private wells that exist within
the corridor will need to be located as a part of the topographic survey. Private wells located within
the corridor that are not planned for immediate connection to municipal utilities will need to be
evaluated to determine if the wells meet Minnesota Department of Health well separation
requirements from potential contamination sources, such as the new sanitary sewer extension.
Storm sewer and stormwater management areas will also be required for the urban road section
and to satisfy water quality and volume requirements for the new impervious surface areas.

PROJECT APPROACH/SCOPE OF SERVICES
WSB’s project scope and proposed tasks are based on our understanding of the project, and
we propose the following scope of services:
Task 1 – Geotechnical
• WSB will obtain a total 0f 16 SPT soil borings ranging from depths of 15 to 30 feet
below grade for pavement design, utility depths, and lift station. In addition, we propose
to complete about 15 hand augers in road widening or trail areas to obtain data on
organic thickness and subgrade soil conditions.
• WSB will also:
• Provide geotechnical report with pavement evaluation and recommendations
• Participate in a Gopher State One site meet for utility clearance.
• Perform Standard Penetration Test borings and sampling
• Perform lab testing for percent fines and organics for classification of subgrade
soils
• Complete routine lab tests (moisture content and P200 wash)
• Classify soils with USCS and prepare boring logs
• Review samples, field notes, photographs and readily available information
from various web sources.
• Preparation of a Geotechnical Report with recommendations for pavement
design
• WSB will provide recommendations on pavement sections that will satisfy Scott County
design requirements.
• All borings will be obtained from within the exiting 170th Street ROW.
• Based on existing traffic loads, traffic control will consist of signage and cones around
the work area and allow traffic to self-regulate.
Task 2– Topographic Survey
WSB will complete the topographic survey for the 8,000 LF of 170th Street up to and including
the intersections with Baseline Avenue and Marschall Road. Initially, survey controls will be set
up for the project area followed immediately by the topographic survey of the existing conditions
within the road right-of-way. Topographic survey will extend to a distance of 20’ beyond the
assumed 110’ wide future 170th Street ROW. Sanitary and storm sewer will include rim
elevations and invert elevations at the easterly limits of the project. Existing driveway culverts
will be surveyed for inverts, material type, diameter and length. All hydrants and exposed valves
will also be surveyed. Private wells will be surveyed for adjacent properties when within 100’
of the existing 170th Street centerline. It is assumed that City of Prior Lake staff will assist the
survey crew with field locating all private wells within the corridor.
It is also proposed to complete the Gopher State One Call locate request for maps as a part of
the topographic survey work.
It is assumed that the City of Prior Lake will obtain any necessary Right of Entries (ROE s) for
survey work completed outside of the existing ROW.

Task 3 – Environmental
Archeological Assessment
An archeological assessment is recommended given the location of the project. Our proposal
includes scope to engage an archeological subconsultant in a Phase 1a literature review and
Phase 1 survey and report assuming the project will be 100% funded using local funds. Should
the City obtain any federal funding to complete portions of the project, additional Section 106
process requirements may apply and a separate proposal can be provided for the City’s
consideration to complete that work.
The Phase 1a literature review will focus on the project area and the surrounding 0.5 mile radius
using Minnesota State Historical Preservation Office (SHPO) files. Deliverables include a letter
report for SHPO compliance.
If warranted by the recommendations of the Phase 1a report, a Phase 1 survey and report will
also be completed. For the purposes of this proposal, it is assumed a Phase 1 survey and
report will be required and the Phase 1 scope assumes one on-site meeting with the Minnesota
Indian Affairs Council (MIAC) and the Shakopee Mdewakanton Sioux Community (SMSC) prior
to beginning work on the Phase 1 survey. Deliverables include a Phase 1 archeological report
completed in accordance with Minnesota SHPO guidelines.
Findings of the Phase 1a literature review and possible Phase 1 survey and report may impact
design and construction plans for the project. As such, it is recommended that the City
authorize work to commence for the Phase 1a literature review as soon as possible.
Wetlands
WSB will delineate aquatic resources along the project corridor, including wetlands and the
Ordinary High Water (OHW) elevation of Campbell Lake (for potential storm sewer outfall
locations). Delineations will be completed using the US Army Corps of Engineers Wetland
Delineation manual and Midwest Regional Supplement. Boundaries of wetlands will be flagged
using pink pin flags and surveyed using sub-meter accuracy GPS units. The OHW elevation of
Campbell Lake will be determined using data from the MN Department of Natural Resources.
Data collected will be summarized in a delineation report and submitted to the city and then
regulatory agencies for review. Once approved, electronic files of the boundaries will be
provided to the city and design team for use in planning.
Task 4 – Feasibility Report
WSB will prepare a Feasibility Report for the 170th Street Improvement Project, which will
include:
• Pavement recommendations to satisfy State Aid and Scott County requirement, in addition
to the geotechnical report recommendations
• Utility recommendations for serviceability of the newly annexed area, including a potential
sanitary sewer lift station and force main.
o It is assumed that the City of Prior Lake will provide property file records that
identify well locations for each property within the corridor for evaluation of
separation requirements from the new sanitary sewer.
• Intersection location recommendations
• Utility coordination recommendations

• Right-of-Way Acquisition estimates. WSB will prepare estimates of ROW costs based on
assumed permanent ROW needs using a 110’ ROW width. ROW estimates will include
ROW costs based on current Scott County assessor market value estimates for the
property. The final feasibility report cost estimate will include the estimated ROW and
consultant fees associated with ROW acquisition work assuming condemnation is not
required.
o It is assumed no ROW estimate is needed for the Piepers parcel on the south
side of 170th Street.
o No temporary easement needs will be evaluated as a part of the feasibility
report. Temporary easement needs will be evaluated with final design.
• Stormwater Management needs. The feasibility report will provide guidance on the design
considerations and preferred location to locate stormwater improvements necessary to
permit and construct the project. Basin retrofits will be reviewed as part of this analysis.
o The cost to acquire the land needed for these improvements will also be included
in the feasibility report estimate, again assuming condemnation will not be
required.
• Feasibility Report text — Executive Summary, Existing Conditions, Proposed
Improvements, Special Considerations, Cost Estimate/Financing, and Recommendations .
• Preparation of the preliminary assessment roll for the 170th Street Improvement Project
• Maps and figures as necessary
• Project schedule
WSB will attend the first neighborhood meeting for the Project as a part of this Feasibility Report.
WSB will also prepare materials for, and attend, the City Council meetings in which the
Feasibility Report is presented to the City Council and the Improvement Public Hearing is held
for the Project as a part of this task.
Task 5 – Project Communication
WSB will support City Staff in developing meeting materials and will attend one (1) additional
neighborhood meeting for the project immediately preceding the Public Hearing for the project.
WSB will serve as an extension of City Staff in this meeting, working with members of the public
to identify potential areas of concern and incorporating comments received into the final design
of the project. It is assumed only those properties along 170 th Street directly adjacent to the
project will be included in Public Engagement and Project Communication efforts for the
Feasibility Study.
WSB will also create a website, an email address and a project hotline for the combined 170th
Street Improvement Project. WSB will update the website content and monitor all email and
project hotline correspondence for a period of one year from the time the project is initiated. This
website hosting service can be extended should the project move into final design and
construction. Third party website hosting fees will be billed to the City as a pass -through
expense.
Schedule
Based on our discussions with City Staff, we are proposing the following schedule for the 170th
Street Improvement Projects:
• March 2026: Authorize the contract with WSB and the preparation of the feasibility
report for the project

PROPOSED FEE
WSB will provide the services as outlined in Project Approach/Scope of Services. Our budget
was developed based on our understanding of the scope and experience with past street
improvement projects in the area. We estimate an hourly not to exceed fee of $122,370.00.
The proposed scope and fee presented herein represents our complete understanding of the
project based on site visits and discussions with City staff. If you have any questions or
