This plan was last adopted in 2020 BACKGROUND: The history of the plan is to reduce disaster impacts to communities and help obtain Federal Emergency Management Agency (FEMA) pre and post disaster mitigation funding. It is required under the Disaster Mitigation Act of 2000 that each county develop and maintain such a plan. The County Mitigation Plan includes the City of Prior Lake, and, with Council approval, the Plan can be adopted and serve as the City Mitigation Plan. The Plan includes an area wide risk assessment that evaluates the following: past hazards; hazards that threaten the City of Prior Lake, and Scott County; an estimate of the structures that may be at risk; and a general description of land uses and development trends. Additionally, the Plan includes mitigation strategies, goals and objectives, and an action plan identifying future mitigation projects. Staff from the County and local municipalities worked over the last twelve months to identify current areas of concern and to expand the previous plan adopted in 2016. The current Plan was developed and submitted by the Scott County Emergency Manager. The Plan has been conditionally approved by the Minnesota Division of Homeland Security and by FEMA, pending approval by the County and affected cities. The entire plan can be viewed online at the following Scott County website: 2026 Hazard Mitigation Plan; Scott County MN Final FEMA approval is contingent on formal adoption by all Scott County cities, townships, and the Scott County Board of Commissioners. Staff recommends adoption of the Scott County All Hazards, Multijurisdictional Mitigation Plan. FINANCIAL IMPACT: Adopting the Scott County All Hazard, Multijurisdictional Mitigation Plan does not require any additional funding. Failure to adopt the Plan may adversely affect the City's ability to secure Federal funding for future mitigation related projects and expenses. Resolution - CONSIDER APPROVAL OF A RESOLUTION ADOPTING THE SCOTT COUNTY ALL HAZARDS MULTIJRISDICTIONAL MITIGATION PLAN 2026 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 26-XXX A RESOLUTION ADOPING THE SCOTT COUNTY ALL HAZARD MULTIJURISDICTIONAL MITIGATION PLAN Motion By: Second By: WHEREAS, the City of Prior Lake has participated in the hazard mitigation planning as established under the Disaster Mitigation Act of 2000, and WHEREAS, the Act establishes a framework for the development of a multi-jurisdictional County Hazard Mitigation Plan, and WHEREAS, the Act as part of the planning process requires public involvement and local coordination among neighboring local units of government and businesses; and WHEREAS, the Scott County Plan includes a risk assessment including past hazards, hazards that threaten the County, an estimate of structures at risk, a general description of land uses and development trends; and WHEREAS, the Scott County Plan includes a mitigation strategy including goals and objectives and an action plan identifying specific mitigation projects and costs; and WHEREAS, the Scott County Plan includes a maintenance and implementation process including plan updates, integration of the plan into other planning documents and how Scott County will maintain public participation and coordination; and WHEREAS, the Plan has been shared with the Minnesota Division of Homeland Security and Emergency Management and the Federal Emergency Management Agency for review and comment; and WHEREAS, the Scott County All Hazard, Multijurisdictional Mitigation Plan will make the County and participating jurisdictions eligible to receive FEMA hazard mitigation assistance grants; and WHEREAS, this is a multi-jurisdictional plan and cities that participated in the planning process may also choose to adopt the County Plan. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. Mitigation plans may include additional content to meet Element H: Additional State Requirements or content the local government included beyond applicable FEMA mitigation planning requirements. Determination that the plan is Approvable Pending Adoption (APA) does not include the review or approval of content that exceeds the applicable FEMA mitigation planning requirements. An approved local mitigation plan, including adoption by the local government, is one of the conditions for applying for and/or receiving FEMA mitigation grants from the following programs: • Hazard Mitigation Grant Program (HMGP) • HMGP Post-Fire • Building Resilient Infrastructure and Communities • Flood Mitigation Assistance • Safeguarding Tomorrow Revolving Loan Fund Participating jurisdictions that adopt the plan more than one year after APA status has been issued must either: • Validate that their information in the plan remains current with respect to both the risk assessment (no recent hazard events, no changes in development) and their mitigation strategy (no changes necessary); or Robert T. Stafford Disaster Relief and Emergency Assistance Act, as amended; the National Flood Insurance Act of 1968, as amended; and National Dam Safety Program Act, as amended; 44 CFR Part 201, Mitigation Planning; and Local Mitigation Planning Policy Guide (FP-206-21-0002) • Make necessary updates before submitting the adoption resolution to FEMA.
