Resolution Approving a Public Property Use Change and Authorizing the Disposal of Tax-forfeited Land Community Development Director McCabe presented the item. Churchill: Prior to 1994, what was the purpose of the property? McCabe: Shady Beach was buildable lots. Manitou Road was not plotted so the city is unsure of the purpose prior to that time. Public hearing opened at 7:13 p.m. by BRAID seconded by CHURCHILL VOTE Briggs Braid Churchill Lake Hellier Aye ☒ ☒ ☒ ☒ ☒ Nay ☐ ☐ ☐ ☐ ☐ Abstain ☐ ☐ ☐ ☐ ☐ Absent ☐ ☐ ☐ ☐ ☐ The motion carried. Jennifer Flatten, 15014 Appaloosa Trail: lives in Raspberry Ridge development. Believes the Manitou lot is important to the trail as it provides additional nature. This park was one of ten parks 09 22 2026 City Council Meeting Minutes that are considered a natural park and was recommended to stay that way to preserve natural plants and wildlife. Curious of when communication was provided to the neighborhood. More dis- cussion should be had with the neighborhood. Zachary Leverne 14360 Shady Beach Trail: Lives across from the Shady Beach trail lot. Never seen the city taken care of it. Feels strongly about the land being preserved for nature. Would like to purchase the lot. Janine Alcorn, 14283 Shady Beach Trail: Lived in the neighborhood for 34 years and knows it well. Refers to the lot as a flood lot and would like some answers about what can be developed as far as storm water functions and what will become of it when the property is sold. Questioned if City engineers have done evaluations on the site to prevent flooding. Would like to see the evaluations flood plan information that would show these new developments could be located on this parcel successfully. Amy Scapel, 5775 Birchwood Ave NE: Her and her family have lived in the neighborhood for 25 years. Wondering about the environmental impact with this proposal will it have on the lake and the lake environment. Questions about what the city has done to protect the environment. Janis Ritchie 5794 Birchwood Ave: They cleared out the area in 2022. Was told by the city cleared it to get the water back in the area. This pond is a part of the neighborhood, and the neigh- borhood just got it back and now the city wants to take it away again. Obert Tufte 14937 Manitou Road: Owns lot next to parcel since 1985. Concerns on zoning and what can be built there. Would prefer it if the city could put out the individual lots up for bids virus the whole area so the builders are restricted on what can be built in that area. Adam Proehl, 14957 Manitou Road: Lived across from Manitou parcel for 15 years. Mimicking previous comments. Please take all neighbors’ concerns seriously. Ryan Capelle 14906 Manitou Rd: Lives on Manitou Road down from parcel. The neighborhood has done a nice job bringing up the concerns. There was discussion on having other options Used for this lot. Feels that further discussion on these lots needs to happen. Kip and Nancy Kepper 14924 Manitou: Main concern is the one water/sewer hookup. Concerned about how many houses would go on this lot. Has concerns about the number of parcels going in and the wildlife that has been there. Brian Lampert, 14223 Shady Beach Trail: Taking a lot of the property away from this pond. Ques- tioned if the city has spoken to the Watershed or the DNR. 09 22 2026 City Council Meeting Minutes Public hearing Closed at 7:41 p.m. by BRAID seconded by CHURCHILL VOTE Briggs Braid Churchill Lake Hellier Aye ☒ ☒ ☒ ☒ ☒ Nay ☐ ☐ ☐ ☐ ☐ Abstain ☐ ☐ ☐ ☐ ☐ Absent ☐ ☐ ☐ ☐ ☐ The motion carried. Director McCabe: This public hearing was voluntary and important to staff/council. Notices sent to 400-foot radius, similar to state statute. Thanked Obert for catching the incorrect legal description. Storm water pipe would remain even if the shady beach parcel was disposed of. Flooding concerns. The buildability of the parcel One third of the area is going to be below 904 elevations. Anything above the developer can build on but cannot do anything with the part below the 904. The surveyor has provided some preliminary information. Impact on the lake is similar to any other single-family development on the lake. City Manager Wedel: There was Sedimented buildup and dredged back out. This would be some- thing the city would continue to do because the pipe would stay even with the new development Director McCabe: Both parcels are zoned as R-1 low-density single-family district. The council would decide if they wanted to split the parcels or not. Hopefully that trees wouldn’t need to be removed. If they did then the city does have a tree preservation and restoration for any trees re- moved. City shared the Shady Beach parcel with the DNR and DNR stated they did not need any review of this item. Notices were set out 10 days from the hearing. City Manage Wedel: Confirming the revenue from these properties would be used for parks. Coun- cil has yet to decide which park it would be used for but would stay in the park maintained Braid: If any of these houses were built on shady beach trail. The developers would still have to go through the guidelines of the city and the DNR. If any of these lots should be sold this is for resi- dential use only that fits in with the current neighborhood. Director McCabe: The only thing that could be constructed on them is single family homes or a purchasers could choose to leave them vacant. Anything that was proposed for construction would go through the normal review process. Braid: How disruptive would putting in the utilities be for the current residents. Director McCabe: Would guess a one-to-two-day of ripping up the street for this project. Hellier: Curious about the Trail that was brought up and is this a city-maintained trail. Director McCabe: Unsure if there is a city-maintained train in that area. Possibly a woodchip trail that was established many years ago, but I am not aware of the current trail in that area. 09 22 2026 City Council Meeting Minutes Briggs: What would the process look like for splitting up the parcel on Manitou. Director McCabe: Council would have options of selling the parcel as one lot which does give the option for the developer to split the lots themselves as long as it meets the minimum requirement. The city could spill the parcel prior to subdivision. We would want to put some sort of restrictions on this subdivision. Briggs: Council could ensure that there is protection with adjacent properties. Director McCabe: That is correct. Briggs: All questions were addressed such as environmental questions, impervious surface, Im- pacts, Conversations were had with the DNR and the Watershed Churchill: The park plan has been in place for over six years. Selling off some of the parks was always a on the table if the park referendum had failed. These meetings were open to the public. Confused that everyone is here now when voting for the referendum could have stopped this and how frustrating it is as a councilmember. Braid: The council tackled getting the city funds. While going through the budget there was zero dollars getting put away for park maintenance. Asked the residents for their feedback about the parks. This city has four times the national average of parks. We would be setting up a referendum due to the many years of not having a parks maintenance fund. We put it on the ballot for citizens to choose. This is where we are with the outcome of the election. These decisions are agenizing. But when changes happen, they should fit into the nature of the neighborhood. The city is stuck between making these sales or raising taxes. With the State and County raising taxes this is an option we do not want to do. Lake: Council Member braid put this into words better than I can but the pain and frustration and the tough decision we now have to make. The council wanted to do this public hearing and hearing out the neighborhood. Very hard decisions and want to support the citizens. Briggs: Council decided to put the park referendum on the ballot instead of just voting on it. Council wanted to hear what the citizens wanted. Sixty percent of voters decided against the park plan. The council now takes this information from the referendum and uses it for clarity. These are your assists that the city needs to protect. This council will do the best we can with what we have for the parks. Will be speaking with staff for further discussion on these parcels City Manager Wedel: On the Manitou lot the benefits of plotting the lot it does give the surrounding neighbors the option to buy a smaller lot and checking to see if a trail was feasible through the Manitou lot. 09 22 2026 City Council Meeting Minutes MOTION BY BRAID SECOND BY LAKE, TO APPROVE RESOLUTION 26-137 APPROVING A PUBLIC PROPERTY USE CHANGE AND AUTHORIZING THE DISPOSAL OF TAX-FORFEITED LAND VOTE Briggs Braid Churchill Lake Hellier Aye ☒ ☒ ☒ ☒ ☒ Nay ☐ ☐ ☐ ☐ ☐ Abstain ☐ ☐ ☐ ☐ ☐ Absent ☐ ☐ ☐ ☐ ☐ The motion carried.
