CONSIDER APPROVAL OF A RESOLUTION RECONVEYING FORFEITED
LANDS TO THE STATE OF MINNESOTA
Introduction
This agenda report asks the City Council to adopt a resolution approving the
reconveyance of tax forfeited land back to the State of Minnesota. The
property in question is located on the west side of Northwood Road and a
block north of CSAH 12, and is described as Lots 10, 11 and 12, Block 20, and
Lots 8 and 9, Block 21, Spring Lake Townsite.

The City originally acquired the subject parcels by specified use deed in
August, 1997. The City specified the use of these parcels as stormwater
management ponds. The parcels consist entirely of wetlands.
Current Circumstances
The City and County are working to resolve some encroachment issues by
private property owners on Spring Lake Regional Park. As part of this
process, the City and the County are proposing to add these wetland parcels
to Spring Lake Regional Park. There is also dedicated right-of-way adjacent to
these parcels that could be vacated and attached to the park. Because the
City title to the property is in a specified use deed, the City cannot convey the
parcels directly to the County. The City can convey the parcels back to the
State; the County will then have the opportunity to obtain the parcels through
the same specified use deed process.
Conveying these parcels back to the State will help to resolve the existing
encroachments. There is no tax value to the property since it consists entirely
of wetlands.
There is no financial impact as a result of this action.
1. Adopt a resolution approving the reconveyance of forfeited land to the
State of Minnesota.
2. Deny this Resolution.
3. Defer this item and provide staff with specific direction.

WHEREAS, In August, 1997, the City of Prior Lake acquired the following described tax forfeited
parcels:
Lots 10, 11 and 12, Block 20, and Lots 8 and 9, Block 21, according to the plat thereof
on file and of record in the Office of the Registrar of Deeds, Scott County, Minnesota.
and
WHEREAS, The City specified the use of these parcels for stormwater ponding; and
WHEREAS, The City of Prior Lake would like to convey these properties to Scott County for
inclusion in Spring Lake Regional Park.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. Pursuant to Minnesota Statues 282.01, Subdivisions 1 a to 1 c, the City of Prior Lake reconveys the
following described property to the State of Minnesota:
Lots 10, 11 and 12, Block 20, and Lots 8 and 9, Block 21, according to the plat thereof on file and of
record in the Office of the Registrar of Deeds, Scott County, Minnesota.
PASSED AND ADOPTED THIS 21sT DAY OF AUGUST, 2006.
