CONSIDER APPROVAL OF A RESOLUTION ORDERING THE PREPARATION
OF A FEASIBILITY REPORT FOR RECONSTRUCTION OF COUNTY ROAD
21 AND THE RECONSTRUCTION OF COUNTY ROAD 121TRUNK HIGHWAY
13 INTERSECTION
Introduction
The purpose of this Agenda item is to initiate the process for local improvements
on County Road 21 and for the CR 12/TH 13 intersection in accordance with
Minnesota Statutes (M.S.), Chapter 429.
Historv
The segment of CR 21 proposed for improvement is located in the southeast
corner of the City of Prior Lake from approximately 1000' west of Franklin Trail to
Adelmann Street. The segment of CR 12 and TH 13 proposed for improvement
is located in the southwest corner of the City of Prior Lake at the intersection of
CR 12 and TH 13.
The City uses the Five Year Capital Improvement Program to plan its
infrastructure improvements and the financing for capital improvements. The
purpose of this Agenda item is to initiate the process for improvements set forth
in the 2007 portion of the 2007-2011 Capital Improvement Program in
accordance with Minnesota Statutes (M.S.), Chapter 429.
This process applies to all projects that will be financed in whole or part through
special assessments or bond proceeds. The first step in the process is for the
Council to order preparation of a Feasibility Report for the improvement projects.
The Feasibility Report will address street reconstruction and improvements for
CR 21 and for the intersection improvements for CR 12/TH 13. The overall cost
and the City's share of the cost will be reviewed and recommendations will be
made to the Council regarding the project.
Current Circumstances
Currently, CR 21 is a 4-lane roadway with an "A" Minor Arterial classification.
The roadway provides a connection point to CR 42 to the north and Interstate
35W to the south.
CR 12 and TH 13 currently intersects at an acute angle. The project would
revise the alignment of CR 12 to provide a 90 degree intersection.
The projects are in the 2007 Capital Improvement Program (C.I.P.). Attached
are pages from the C.I.P. which provides additional information on the Project.

The Feasibility Report will determine if assessments will be feasible and follow
the M.S. Chapter 429 process if necessary.
ISSUES:
The City is required to assess a minimum of 20% of the cost of a public
improvement project completed through the Chapter 429 process and financed
through G.O. bonds. The Feasibility Report will determine the estimated costs of
improvements and methods of financing. The Feasibility Report will also
determine if the assessment will meet the minimum requirement as set forth in
the Chapter 429 process.
The preparation of the Feasibility Report is only the first step in the public
improvement project. Following receipt of the Feasibility Report, the Council will
direct City Staff to abandon or proceed with the Chapter 429 process, dependent
upon whether the requirements for the Chapter 429 are being met. If the
Chapter 429 process is to proceed, the Council can then schedule a Public
Hearing. Following a Public Hearing, the Council may consider authorizing the
preparation of plans and specifications. Once completed, the City Council would
be asked to approve the plans and specifications, authorize advertisement for
bids and then award the contract.
FINANCIAL
IMPACT:
The financial impact of this project will be further analyzed in the Feasibility
Report.
ALTERNATIVES:
The alternatives are as follows:
1. Approve a resolution ordering the preparation of a Feasibility Report for
County Road 21 and CR 12/TH13 intersection.
2. Deny this item for a specific reason and provide Staff with direction.
3. Table this item until some date in the future.
RECOMMENDED Alternative 1, A motion and second to adopt a Resolution ordering the

ORDERING PREPARATION OF FEASIBILITY REPORT FOR THE
COUNTY ROAD 21 AND COUNTY ROAD 121TRUNK HIGHWAY 13
INTERSECTION IMPROVEMENT PROJECTS

WHEREAS, it is proposed to construct improvements for County Road 21 (approximately 1000'
west of Franklin Trail to Adelmann Street) and County Road 12/Trunk Highway 13
intersection (from Spruce Trail to TH 13 on CR 12 and approximately 400' north and
1650' south on TH 13), including the construction of storm sewer, sanitary sewer,
watermain, aggregate base, concrete curb and gutter, bituminous surfacing, street
lights, signals, and appurtenant work; and
WHEREAS, the report will provide information regarding whether the proposed project is necessary, cost-effective, and
feasible.
WHEREAS, Street reconstruction is necessary to provide residents the opportunity of safe travel
while commuting throughout the City.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. that the proposed improvements be referred to the City Engineer for study and that he is instructed
to report to the Council with all convenient speed advising the Council in a preliminary way as to
whether the proposed improvements are necessary, cost-effective and feasible and as to whether
they should best be made as proposed or in connection with other improvements, and the
estimated costs for the improvements as recommended.
