Prior Lake, MN 55372-1714 PLANNING REPORT AGENDA ITEM: SUBJECT: PREPARED BY: PUBLIC HEARING: CASE FILE #: DATE: 7A AN APPLICATION TO CONSIDER A MINOR AMENDMENT TO A CONDITIONAL USE PERMIT JEFF MATZKE, PLANNER YES X NO-N/A EP06-167 SEPTEMBER 11, 2006 INTRODUCTION: In July of 2005 Eagle Creek Development received approval for a Conditional Use Permit (CUP) to allow two multiple family dwellings on the 4.15 acre property located south of CSAH 21/Cottonwood Lane, east of Fish Point Road, west of Adelmann Street/Revere Way, and north of Deerfield Drive. LCC Services Group is proposing a minor amendment to the approved CUP. The request is specifically related to the exterior materials used for both Buildings A and B. The applicant has provided staff with a narrative detailing the advantages of using vinyl siding as opposed to steel siding. This narrative is included in the staff report along with a color rendering of the proposed buildings. Also included in the report is a signed letter of consent from the property owners agreeing to support the change in the exterior materials from steel siding to vinyl shakes and siding. ANALYSIS: Section 1108.207 of the Zoning Ordinance states that "The Planning Commission may impose reasonable conditions on any Conditional Use Permit and may, at any time, on its own initiative or upon application by the properly owner, modify the conditions of an existing Conditional Use Permit as changing circumstances warrant." CONCLUSION The modification of the exterior materials from steel siding to vinyl siding would provide a more durable, maintenance-free finish to the buildings that will closely match the existing siding of other structures in the area. Unlike the steel siding the vinyl product will not dent or rust and it carries a limited lifetime warranty. The resolution shall be recorded at the Scott County Recorders Office no later than 60 days after the Planning Commission approval. ALTERNATIVES: 1. Approval of the CUP Amendment with conditions as recommended or any other conditions the Planning Commission feels are warranted. 2. Denial of the CUP Amendment. In this case, the Planning Commission should be specific about findings of fact. 3. Continue the request and provide specific direction to the applicant and staff. RECOMMENDATION: Alternative #1. ACTIONS REQUIRED: Motion and second to approve a Conditional Use Permit Amendment to allow for a modification of the exterior materials from steel siding to vinyl siding and shakes for the construction of Building A and B within the Courtwood Village Development. Prior Lake, MN 55372-1714 CONDITIONAL USE PERMIT RESOLUTION 06.15PC RESOLUTION APPROVING A MINOR AMENDMENT TO THE COURTWOOD VILLAGE CONDITIONAL USE PERMIT MOTION BY: SECOND BY: WHEREAS, LCC Services Group has submitted an application for a minor amendment to the approved Conditional Use Permit for the Courtwood Village development to allow a modification to the exterior materials from steel siding to vinyl shakes and siding for Building A and B of the Courtwood Village Development; and WHEREAS, The Prior Lake Planning Commission considered the minor amendment on September 11, 2006; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE: 1. The recitals set forth above are incorporated herein. 2. The Planning Commission hereby approves the amended Conditional Use Permit, subject to the following conditions: a) The resolution shall be recorded at the Scott County Recorders Office no later than 60 days after the Planning Commission approval. CONCLUSION The Planning Commission hereby grants an amended Conditional Use Permit for a multiple family development in the R-4 Zoning District. The contents of Planning Case File # EP06-167 is hereby entered into and made a part of the public record and the record of the decision for this case. The amount of square footage for vinyl siding and shakes would ..I.,......ain the same (See Exhibit B- Architectural Calcs). We believe there would be no negative impact to our surrounding neighbors and in fact with the addition of vinyl shakes the building will have more curb appeal and upscale appearance (See Rendering). We have enclosed the pros of vinyl siding (See Exhibit C) and will provide samples of the proposed products. Our accent line will be a soldier course of brick called St. Thomas queen style with a mix of tan and biege colors. Please keep in mind our residential neighbors all have vinyl siding. However, our proposed siding is thicker, plus we will be using Dutch lap, which has more character and distinction (steel siding only comes in a flat lap style). In addition, we have added vinyl shutters which again gives the building a more residential look and adds curb appeal. Thank you for taking thi.s under consideration.
