HomeMy WebLinkAbout8B - Liquor License / Captain Jack's AGENDA ITEM: DISCUSSION: ALTERNATIVES: RECOMMENDED MOTION: Reviewed by: Frank Boyles, SEPTEMBER 18, 2006 8B JANET RINGBERG, LICENSE CLERK PUBLIC HEARING TO CONSIDER APPROVAL OF THE ISSUANCE OF AN ON SALE INTOXICATING AND SUNDAY LIQUOR LICENSE FOR JKL CAPTAIN JACK'S LLC DBA CAPTAIN JACK'S Current Circumstances Richard and Karen Sweet have applied for an on-sale intoxicating liquor license and a Sunday liquor license in order to sell intoxicating liquor at Captain Jack's, 3950 Green Heights Trail SW. Mr. and Mrs. Sweet have purchased Captain Jack's from the current owners. They plan to keep the same business name under their ownership. Prior Lake City Code Section 301.503 provides that with respect to a liquor license request, the City Council"... shall hear testimony from any person who requests to be heard for or against the granting of the license. After the investigation and hearing the Council shall, in its discretion, grant or deny the issuance of the license," The purpose of tonight's public hearing is to consider the issuance of an on-sale intoxicating liquor license and a Sunday liquor license for JLK Captain Jack's LLC dba Captain Jack's. The Council should hear the staff report, open the public hearing to receive testimony, close the public hearing and then take action on this request. The Sweets have paid the prorated fee of $3,975.03 for the period of October 1,2006 to June 30, 2007, for the on-sale intoxicating license and $200.00 for the Sunday liquor license. Any new license issued and renewed on July 1, 2007, will require payment of the full year on-sale intoxicating license fee of $5,300.00 and $200.00 for the Sunday liquor license. The Sweets have provided the City with all required documents and have provided proof of liquor liability insurance. All county taxes are current for 3950 Green Heights Trail. The Prior Lake Police Department has completed its investigation and has found no reason to deny this license request. The City Council has the following alternatives: 1. Adopt a motion approving the on-sale intoxicating and Sunday liquor licenses. 2. Deny the liquor license requests.
