Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT MEETING DATE: AGENDA #: PREPARED BY: OCTOBER 16, 2006 SH ROSS BINTNER, WATER RESOURCES ENGINEER CONSIDER APPROVAL OF A RESOLUTION AWARDING THE CITY'S STANDARDIZED PROFESSIONAL SERVICES CONTRACT FOR PREPARATION OF THE NON DEGRADATION REPORT. AGENDA ITEM: DISCUSSION: Introduction The purpose of this agenda item is for the City Council to approve a resolution authorizing the Mayor and City Manager to execute the City's standard agreement for professional services with WSB & Associates, Inc. Historv On March 3, 3006 the Minnesota Pollution Control Agency issued a revised Municipal Separate Storm Sewer System (MS4) permit that requires permit holders like the City of Prior Lake to complete analysis and planning to comply with State and Federal Clean Water Laws. Current Circumstances In the effort to stay in compliance with the revised MS4 permit, the City sent out a request for proposals for professional service to three consulting engineering firms with experience with water resources in the City of Prior Lake. Bonestroo Rosene Anderlik and Associates, Inc, Wenck Associates, Inc, and WSBand Associates, Inc each submitted proposals to assist the City in meeting the requirements of the MS4 permit. Each proposal described a different method of modeling pollution citywide. Because each proposal was so different, staff took the time to question each consultant about the specifics of their proposed method to determine which was most sound and the best fit for the City. The proposal from WSB, is recommended for the following reasons. The modeling and analysis proposed by WSB will build off the current city Geographical Information System (GIS). Through building off an existing system the City benefits by using existing information as a basis for constructing a comprehensive model. This process limits the amount of new information that must be compiled and insures that newly compiled information is in a usable form in the future. Also, due to uncertainty in the direction of nondegradation planning an easily understandable and reusable model is preferred over a more complex one. The proposal by WSB was in staffs opinion the simplest to understand and useful in the future. Secondary benefits of the proposed model also factored in the decision to recommend WSB. A separate part of the MS4 permit requires the City of model its stormwater system. The nondegradation model will include modeling of portions of the City's stormwater system, closing the gap in the goal of having the entire city stormwater system modeled. In concert with the effort to meet the Nondegradation portion of the MS4 permit, Staff asked WSB to submit an additional scope of services for providing a uniform map of the City stormwater system to build off the effort that will be needed for the Nondegradation Analysis. This additional scope of services is meant to meet the permit provisions of the MS4 that require the City to map and monitor its stormwater system. A partial map will be complete as part of the nondegradation analysis, this additional item is used to expand on the mapping already required to make a useable and uniform system map citywide. ISSUES: Although this is a mandated study, it is the hope of staff that both the analysis itself and the mapping required as part of the study will provide efficient solutions to improve water quality in the City of Prior Lake. FINANCIAL IMPACT: The City budgeted $70,000 for the years 2006 and 2007 for completion of this study. Costs for the proposals were competitive; Bonestroo's proposal was the most expensive at $67,900 while WSB and Wenck came in well below budget grouped together at $35,694 and $32,360 respectively. In choosing the second lowest bid, the staff recognizes that the method used by WSB will provide additional benefits and will be the easiest to reuse in the future. Although hard to quantify, these added benefits will easily make up the $3,300 difference in cost in staffs opinion. By choosing a method that staff will be able to use in the future, the City saves consulting fees each time the water quality model needs to be utilized. In the same way, by choosing a method that is reusable in the future the City pays less for potential future mandates. Since this purchase is considered a professional service under the Uniform Municipal Contracting Law the City may consider other factors in addition to price. The proposed scope of additional services is $9,800 for the mapping and monitoring system. Combined with the cost of the analysis these two items bring the total cost to the City to $45,494, well under the budgeted amount of $70,000. ALTERNATIVES: 1. Approve a resolution authorizing the Mayor and City Manager to execute the City's standard agreement for professional services. 2. Deny this item for a specific reason and provide staff with direction. 3. Table this item until some date in the future. RECOMMENDED MOTION: Alternative #1. Motion By: Second By: WHEREAS, The City of Prior lake is required to comply with its Municipal Separate Storm Sewer Systems (MS4) Permit; and, WHEREAS, The 2006-2011 MS4 Permit requires the City to complete an analysis of its water quality and plan for the nondegradation of resources; and, WHEREAS, The City requested proposals from three consulting engineering firms with experience in the City and water resources; and, WHEREAS, WSB and Associates, Inc was determined by City Staff to have the most competitive proposal in terms maximizing benefit and minimizing cost to the City; and, WHEREAS, This purchase is considered a professional service under Uniform Municipal Contracting law. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The Mayor and City Manager are herby authorized to execute the City's standard contract with WSB and Associates, Inc. for professional services for an amount not to exceed $45,494.00.
