ITEM n . PUBLIC HEARING. AMENDMENT TO THE COMPREHENSIVE PLAN LAND USE MAP ANDCrrY ZONING ORDINANCE. 'The Public Hearing was called to order at 9:20 P.M. The public was in attendance and a sign-up sheet was circulated Chairman Arnold noted the infonnation on the amendment to the City Zoning Ordinance was published in an adequate amOtlllt of time. However, the infonnation regarding the Comprehensive Plan Land Use Map Arrendment was published. later. The presentation and discussion will take place at this time, and a special meeting has been called for April 12, 1994, at 6:00 P.M., at which time the entire amendment will be voted o~ . Horst Graser presented the infonnation as per planning report of April 7, 1994. The applicant is New Cennny Construction and the application would be to convert the subject building from a bowling alley to a kindergarten school The purpose of the public hearing is to consider an amendment to the Prior Lake Comprehensive Plan and Zoning Code for 2.6 acres of COI1'lIrefCial designated land irrunrliately southwest of the intersection of Tower and Toronto Streets. 'The requested action is to change the land use designation in the Comprehensive Plan from cOlTlIIUCial to high density residential and to amend the Zoning Ordinance from B-3 to R - 3 for the same parcel. The building on the site is 22,000 square feet and the use is a bowling alley, lounge, and sports bar. There have been several owners through the years but no one seems to flourish at this business site. Perhaps this example of a failed business is an indication that the COI1'lIrefCial districts need to be mOOified to residential south of Tower Street A redesignation to high density for the subject site would be more respectable and conducive to the adjacent single family homes. The land use designation can be justified and is not considered spot zoning. Regardless of the zoning, the utilities and roads are sufficient to accoITlI'l'Xrlate the uses of either district Jim Erickson, 4544 Pond view, stated he is in agreement with the change. Les Sonnebend, Superintendent of Prior Lake School District 719, corrnrented that the school district is in real need of space and is considering this a long-term presence. If it is not needed for kindergarten it will be used for Community Education, Special Education, Early Children, etc. There is room for buses on-site, playground will be expanded, and the fencing upgraded. Bill Schmokel, School Board Memrer, reiterated that this will be a long-term commitment on the part of the school and when the remooeling is complete it will look very moch like a school and not a bowling alley. Corrnrents from the Commissioners were on; change in zoning change property taxes, question on rezoning when schools are allowed in B-3, transitional buffering, design bus loading site for safety, trend is to keep cornrrr:rci.al intact but this is an exception to the rule, traffic increase, no negative fmancial impact on the City, and all were in agreement with the petition. The subject site is a substandard lot of record and was platted under Eagle Creek Township. Precedent has been set in the neighborhood by similar variances granted in order to construct single family homes. It is possible that two trees may be lost during the construction. PLANNING REPORT AGENDA ITEM: SUBJECT: 3 CONSIDER VARIANCE APPLICATION FOR JOHN AND DOROTHY STARIHA DEB GARROSS, ASSISTANT CITY PLANNER _YES LNO APRIL 7, 1994 PRESENTER: PUBLIC HEARING DATE: INTRODUCTION: The purpose of this item is to consider a variance application for John and Dorothy Stariha for the property located at 15538 Red Oaks Road, legally described as Lot 9, Red Oaks. The specific variances requested are listed as follows: REQUESTED VARIANCES: 1. 5' North side yard variance. 2. 25' Lakeshore variance. 3. .45' South side yard variance. 4. 1 % Lot coverage variance. 5. 1 % Impervious surface coverage variance. 6. .26' Lot width variance. The proposal is to remove an existing seasonal cabin and replace it with a new single family home. See attached survey for details related to the proposed development plan. DISCUSSION: The subject site is a substandard lot of record that contains appr0ximately two trees which are anticipated to be lost or relocated due to the proposed construction. The adjacent neighborhood is fully developed with a variety of cabins, additions and new single family homes. Because the site is part of a subdivision platted in 1933, the majority of lots are substandard by current Zoning Standards. Staff reviewed records on file for the subdivision of Red Oaks and found that many properties have received variances in order to remodel or construct new dwellings within the plat. There were eight properties in the vicinity of the subject site granted variances ranging from 12' to 40' lakeshore; l' to 10' front yard; 2.5 to 5' side yard and an 8% lot coverage variance. Please note that the majority of construction has occurred within the plat prior to 1987 when the 30% impervious surface provision went into effect. The subject site was platted in 1930, presumably for development by seasonal cabins and later, and annexed to the City of Prior Lake in 1973 as part of the consolidation of Eagle Creek Township. The required lot size for a substandard lot is 7,500 square feet with 50' of lot width. The subject site contains approximately 7,847 square feet but according to the surveyor's 4629 Dakota 51. 5.E., Prior Lake, Minnesota 55372-1714 / Ph. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER measurements is shy of the 50' lot width requirement by .26'. The width of the lot according to the plat is 50' however, that is because the front property line is not perpendicular to the side property lines. Therefore, the lot width is actually .26' less than the required 50' lot width req~irement of the Zoning Ordinance. Therefore, the applicant has requested a .26' lot width varIance. ALTERNATIVES: 1. Approve the variances as requested or with some modification as per Planning Commission discussion. 2. Continue or table discussion for specific reasons. 3. Deny the variances finding lack of demonstrated hardship. RECOMMENDATION: Alternative #1 subject to the conditions that: 1) The shed in the front yard and south side yard, adjacent to the existing cabin be removed. 2) The roof line be designed in a manner so as not to allow water to drain to the side yards and/or gutters be installed to control drainage along the side yards. Variance Hardship Standards: 1. Literal enforcement of the Ordinance would result in undue hardship with respect to the property. The site is a substandard lot of record that is considered buildable according to the Zoning Ordinance, yet application of current Zoning Standards severely restrict the building envelope. The resulting building envelope, including garage is approximately 1,653 square feet. 2. Such unnecessary hardship results because of circumstances unique to the property. The property was platted under a former government jurisdiction that could not foresee the market demands for lakeshore property in the 1990's. Lots of similar size, shape and area, within this subdivision have been granted similar variances in order to construct single family homes. 3. The hardship is caused by provisions of the Ordinance and is not the result of actions of persons presently having an interest in the property. The Zoning Ordinance contemplates a maximum 22% lot coverage requirement for 10,000 square foot, standard lots which equates to 2,200 square feet. The applicant proposes approximately 1,814 square feet of coverage which equates to a 23% lot coverage for a 7,847 square foot lot but which is well within the objective of the Zoning Ordinance. Likewise, the Zoning Ordinance contemplates a maximum 30% impervious surface coverage requirement for 10,000 square foot, standard lots which equates to 3,000 square feet. The applicant proposes 2,474 square feet of impervious surface which equates to a 31 % impervious surface coverage for the 7,847 square foot lot but which is well within the objective of the Zoning Ordinance. 4. The variance observes the spirit and intent of this Ordinance, produces substantial justice and is not contrary to the public interest. The applicant proposes to remove a non-conforming cabin located approximately 37' from the 904 and construct a new dwelling 50' from the 904 which is consistent with the setback of the adjacent structure to the north. The proposed construction will maintain the same north side yard setback as the existing cabin. The proposed .45' south side yard variance is requested due to the irregular lot width which occurred because the front (east) property line is not perpendicular to the side property lines. The variances requested are within what has been granted previously to similar size lots within the neighborhood.
