INTRODUCTION:
The Planning Department has received an application from James Halek to consider side yard,
lakeshore, lot area and impervious surface variances for the property located at 4253 Grainwood
Circle, legally described as Lot 10, Grainwood Park. The applicant proposes to construct a new
single family home on the vacant lot as per attached survey. The specific variances requested are
as follows:
1. .1' south side yard variance (for the garage), from the 10' side yard setback requirement.
2. 2' south side yard variance (for the house), from the 10' side yard setback requirement.
3. 42' lakeshore variance from the 75' lakeshore setback requirement.
4. 1,138 square foot minimum lot area variance from the 7,500 square foot lot area
requirement.
5. 3.8% impervious surface variance from the maximum 30% impervious surface
requirement.

DISCUSSION ~
Lot 10, Grainwood Park is a substandard Lot of Record, platted in 1944 under the governing
jurisdiction of Eagle Creek Township. The plat was brought into the City of Prior Lake in 1973
via the consolidation of Eagle Creek Township. The neighborhood is nearly fully developed
with a variety of housing types ranging from old cabins to new, single family homes. The lot
consists of 6,362 square feet of area and is approximately 50' x 125' feet. Application of current
setback and lot area requirements would result in a 30' x 25' building envelope which is virtually
unbuildable.
Staff reviewed all lake shore lots within the subdivision of Grainwood Park and found that
numerous lots have been granted multiple variances for new construction or additions. The
variances ranged from 2' to 5' side yard variances, (in three cases, two side yard variances were
granted in excess of 5'); 9' to 50' lakeshore variances; 2' to 10' front yard variances, and up to
17% lot coverage variances. The adjacent home to the north, (Lot 11, Grainwood Park), was
granted the following variances in 1989: 3' north, 5' south side yard, 50' lakeshore and 17%
coverage ratio variances to construct the home as indicated on the survey.

1. Approve the variances as requested.
2. Continue or table action for specific information or research as directed by the Planning
Commission.
3. Deny the variances finding no hardship, as defined by the Zoning Ordinance.
RECOMMENDATION:
Alternative #1, subject to discussion of the Planning Commission.
* The Planning Commission may want to encourage the applicant to take advantage of
Zoning Ordinance Section 4.1F which states: "Where structures on adjacent lots or parcels
have front yard setbacks different from those required, the minimum front yard setback
shall be the average of the existing structures."
The applicant would have to revise the survey to indicate the location of the garages on
Lots 9 and 11 and the distance to Grainwood Trail. It appears that the home on the subject
site could be located approximately 20-21' from the front property line by utilizing the
setback average clause of 4.1F. Utilizing the average setback would result in the same size
home, and increase the lakeshore setback to 37-38'.
Variance Hardship Standards:
1. Literal enforcement of the Ordinance would result in undue hardship with respect
to the property.
If current setback and lot size standards are applied to the subject site, it would be
rendered unbuildable. Other similar size lots are developed and/or have been granted
similar variances by the City of Prior Lake to build. Literal enforcement of the Ordinance
would result in undue hardship to the property.
2. Such unnecessary hardship results because of circumstances unique to the property.
The hardship is related to the fact that the lot was platted under the former government
jurisdiction of Eagle Creek Township, which allowed subdivision with standards that are
inconsistent with current Prior Lake codes and ordinances.
3. The hardship is caused by provisions of the Ordinance and is not the result of
actions of persons presently having an interest in the property.
The Prior Lake Zoning Ordinance provisions which apply to the subject site were
adopted approximately 30 years following the platting of the property. The hardship is
caused by the application of current zoning regulations to a substandard, Lot of Record.
4. The variance observes the spirit and intent of this Ordinance, produces substantial
justice and is not contrary to the public interest.
The variances requested are consistent with previous actions of the Planning Commission
for lakeshore lots within the subdivision of Grainwood Park. The applicant has tried to
minimize variances and has proposed a plan that requires minimal side yard setback
variances, (for the garage and a cantilever only). The proposed lakeshore setback is 33'
versus the 25' lakeshore setback of the adjacent home located on Lot 11. The proposal
requests minimal variances, considering the history of the subdivision and therefore
observes the spirit and intent of the Ordinance and would not be contrary to the public
interest.
