Consider Norling Appeal for Variance - Associate Planner Mitchell presented details of the variance appeal to the Planning Commission's denial to construct a deck. The Planning Commission found that the 15' lakeshore variance and 5' south side yard variances were warranted, but denied the 9' south side yard variance on the premise that this action would set a negative precedent when other options were available. Mr. Norling was present to discuss his request. Council concurred that Mr. Norling is simply replacing a deck that had originally been attached to the house and directed to develop a set of findings to substantiate the fact that denial of the request would represent a hardship to Mr. Norling and that granting the variance would not constitute a negative precedent by the City. 9. OTHER BUSINESS (a) Mayor Andren stated that she had requested the Invoices to be Paid item be removed for discussion because the issue on Change Order #1 (which is included in the invoices) had not been resolved at the time of this vote. Councilmember Kedrowski had requested this item be removed for discussion -5- CONSENT: PREPARED BY: SUBJECT: DATE: INTRODUCTION: BACKGROUND: STAFF AGENDA REPORT 4 (C) GINA MITCHEll, ASSOCIATE CITY PLANNER CONSIDER APPROVAL OF FINDINGS OF FACT FOR NORLING VARIANCE APPEAL JULY 5, 1994 The purpose of this item is to consider the findings of fact to approve a variance appeal by David and Elizabeth Norling of 15239 Fairbanks Trail, Prior lake. Mr. Norling applied for a 15' lakeshore variance and a 9' south side yard variance to construct a deck. The Planning Commission on May 19, 1994, approved the 15' lakeshore variance and a 5' south side yard variance. The applicant appealed the Planning Commission's decision to the City Council, requesting that the 9' variance be granted as originally proposed. The City Council granted the 9' south side yard variance on June 20, 1994, subject to preparation of findings of fact for the subject site. The following findings of fact were prepared by staff and reviewed by City Attorney Glenn Kessel, to support granting a 9' south side yard variance for the property located at 15239 Fairbanks Trail, Prior lake: FINDINGS OF FACT: 1. The subject site is located at 15239 Fairbanks Trail and is legally described as lot 4, Maple Park Shore Acres, Scott County, Minnesota. 2. Records on file with the Scott County Recorder's Office do not indicate the specific year in which the cabin was built under the jurisdiction of Eagle Creek Township. 3. The home was built with a 5' setback from the south side property line. The main entrance to the home is via a door located on the south side of the home. A deck was built on the east (Iakeshore) side of the home. A 4 foot section of the deck was constructed on the south side of the home to provide an access to the main entry of the home and also to connect the side entry to the deck. The 4 foot deck section was built with a l' setback from the south side property line. 4. The subject site was annexed to the City of Prior lake in 1973. City Zoning Ordinance 83-6 specifies that a 10' side yard setback is required for structures located within the R-1, Suburban Residential; S-D, Shoreland District Zone. 4629 Dakota St. S.E., Prior Lake, Minnesota 553?.f_-1714 / Ph. Due to the change in site elevation from the front to the rear of the home, the deck is an integral part of the structure required for reasonable access to the home. 6. The main entry of the home is located on the south side of the home, and is accessed by the deck. Relocation of this entry would change the design characteristics of the home and create an undue hardship to the applicant. 7. Section 6.1 (E) of City Zoning Ordinance 83-6 specifies: "normal maintenance of a non-conforming structure is acceptable including non-structural repairs and incidental maintenance." This regulation allows for limited repair of a legal non-conforming use. The applicant's situation is unique in that extensive repair was required for the health and safety of individuals who access the home. The applicants did not discover the deteriorated condition of the deck until shortly after they had purchased the home. The restoration of the entire deck triggered the variance application process. 8. The specific variance requested is a 9' south side yard variance to restore the deck to it's original legal non-conforming setback. The deck on the south side of the home will be restored to the exact dimension of the original structure. The stair case on the east (Iakeshore) side of the deck will be built 5' from the side property line. HARDSHIP STANDARDS: A. Literal enforcement of the Ordinance would result in undue hardship with respect to the property because the structure would require substantial alteration to relocate the main entrance of the home. B. Such unnecessary hardship results because of circumstances unique to the property. The structure was built under the jurisdiction of Eagle Creek Township, with the entrance located on the south side of the home, accessed by a deck located l' from the south property line. C. The hardship is caused by provisions of the Ordinance and is not the result of actions of persons presently having an interest in the property. The hardship is caused by application of Prior Lake Zoning standards which are more restrictive than the setback standards of Eagle Creek Township. D. The variance observes the spirit and intent of this Ordinance, produces substantial justice, and is not contrary to the public interest. The applicant is restoring the deck on the south side of the home to the same dimension as the original deck, approved by Eagle Creek Township. No objections to the proposed 9' south side yard variance were received by the Planning Commission nor City Council. Restoration of the deck is necessary for the health and safety of all individuals who access the home. We are appealing the Planning Co........~.ssions decision denying us a 9' variance on our south side. The south side of our house was built 5' from the property line and a 4' walkway to our main entrance was attached at that time. Recently, our walkway has corroded beyond repair and within 6 months someone has fallen through. it twice. We have tried to repair it but it keeps falling. It is in need ofreplactment. We feel that since the house was built in 1968 and, therefore, was part of Eagle Creek T ownwp and the side walkway was existing, that we should be able to replace it exactly as it was. There would be I1.0 additions. The neighbors are supportive of this as the walkway would be only 1 1/2 feet from the property line. We would be willing to put a stipulation on the variance to the effect that this walkway would in no way be used for further construction and would stay a walkway only. Please take this into consideration as our houle is built on a hill and this walkway is the ouly cost effective way to enter our house. The applicants desire to build a 4' x 22.5' walkway, a 17.5' x 14' deck, and a future 14' x 14' four season porch addition. The applicants are requesting the Planning Commission to approve the following variances: 1. 9' south side yard variance from the 10' side yard setback requirement 2. 15' lake shore variance from the 75' lakeshore setback requirement PHYSIOGRAPHY: The subject site contains approximately 7,268 sq. feet oflot area. Currently the site is developed with a 22.5' x 22.5' one story home located 5' from the south property line and 74' from the 904. The proposed construction will not interfere with any overstory on the lot. The site has about 27' of relief. There is a 10' difference in elevation from the front of the home to the rear, which has created the opportunity for this home to have a walkout, and the property is partially terraced. This lot has similar topography as others in the area, the majority of which have taken advantage of the ridge that exists in this area by developing homes with walkout basements. The entrance to this home is from the south side. It was accessed by a walkway which ran along the side of the home and connected to a deck. The walkway and deck have deteriorated. The applicant's are proposing to reconstruct a walkway which would run the length of the home and connect to the deck. A stairway would access the southeast corner of the deck and walkway from the rear of the lot. This proposed construction would create aI' setback from the south property line. The applicants' drawings of their proposal are attached. ADJACENT USES: The neighborhood contains a mixture of housing styles and home values. The subdivision of Maple Park Shore Acres was platted in 1922 under Eagle Creek Township. All of the lots within the subdivision are substandard by current Prior Lake zoning regulations. The neighborhood is developed with a mixture of cabins that have been remodeled/upgraded, and new homes with a wide range of architectural styles. PLANNING CONSIDERATIONS: The subject site is a small, substandard lot as are all of the lots in the plat of Maple Park Shore Acres. The neighborhood is unique in that the original 50' wide lots have been developed with sinile family homes. Few lots have been combined to create larger parcels. Much of the construction completed since 1973, (the year Eagle Creek Township was consolidated with Prior Lake), has been granted variances by 4629 Dakota 51. 5.E., Prior Lake, Minnesota 55372-1714 / Ph. The Planning Commission generally approves one, five foot side yard variance for 50' wide, substandard lots in order to allow some degree of design flexibility for the property owner. The applicants' home was built 5' from the side property line, and they are now requesting a l' setback to accommodate the proposed structures. The maximum side yard variance that was approved in the study area was 5.7'. The 9' side yard variance is beyond the established variance patterns that have been approved in this study area. (See Appendix A for specific variances granted within this subdivision). ALTERNATIVES: 1. Approve the variances as requested, or with some modifications as per Planning Commission discussion. 2. Continue or table discussion for specific reasons. 3. Deny the variances finding lack of demonstrated hardship. RECOMMENDATION: The recommendation from staff is Alternative #1. Staff recommends approval of the 15' lakeshore variance as submitted. Staff also recommends that the 9' south side yard variance be denied as submitted. Staff would support a 5' side yard variance which would allow the property owner to build a 13.5' x 14' deck and 14' x 14' four season porch along the same line as the home since this would not further encroach the property owner to the south. However, the proposed walkway with aI' side yard setback is unacceptable. The applicant should explore other options to access his side entrance. Variance Hardship Standards: 1, Literal enforcement of the Ordinance would result in undue hardship with respect to the property. The requested 15' lakeshore variance requested, and the 5' side yard variance that staff recommends would allow the applicant to rebuild the deck without further encroachment on the property to the south. Other similar size lots within the subdivision have been granted similar variances to construct single family homes. The 9' side yard variance which has been requested by the applicants is not consistent with other variances requested and approved within this area. Staff feels that another location could be chosen to access the deck. The purpose of side yard setbacks are to provide for aesthetic and functional purposes related to the sense of space, appropriate areas for utilities, erosion control, and lot drainage. Approval of the variance as requested by the applicant would further encroach the property owner to the south which is not consistent with past applications approved by the Planning Commission for similar developed lots. 2. Such unnecessary hardship results because of circumstances unique to the property. The lot was platted in 1922 under another government jurisdiction. The previous platting standards of Eagle Creek Township are significantly different that current Zoning and Subdivision regulations for the City of Prior Lake. 3. The hardship is caused by provisions of the Ordinance and is not the result of actions of persons presently having an interest in the property. The application of current Prior Lake Zoning standards to this property, platted in 1922, would render the lot unbuildable. The hardship is caused by the application of current Zoning regulations to a substandard lot of record and is not the result of actions of the property owner. 4. The variance observes the spirit and intent of this Ordinance, produces substantial justice and is not contrary to the public interest. The 15' lakeshore and 5' side yard variances observe the spirit and intent of the Zoning Ordinance because these requests are comparable to other variances that have been approved by the City of Prior Lake in this area.
