David Norling. 15239 Fairbanks Trail. stated they are requesting a variance to rebuild a deck that is
deteriorating to the point of being unsafe as pan of the deck has fallen off. Mr. Norling would like to build
a 4' x 22.5' walkway. a 17.5' x 14' deck. and a fuwre l4'x 14' four season porch addition. After having a
sUIVey done it was found the stairs had encroached on the adjoining lot
Gina Mitchell, Associate Planner presented the infonnarion as per planning repon of May 19. 1994. The
request is for a 9 foot south siaeyard variance and a 15 foot lakeshore variance. The subject site is a 50'
substandard lot and was platted under the jurisdiction of a previous governing body. The proposed
construction would not encroach onto the adjacent property as is now the case. COlIllll.,lIts from D NR were

Gina Mitchell, Associate Planner, presented the infOlmation as planning repotl of May 19, 1994. The
variance requested is a 6 foot nOlth front yard variance from the 25 foot front ywu setback requirement.
The requested variance would allow the proposed home to be set back along a similw' visual line as the
homes on the adjacent properties. Due to the City's street construction project the applicant has a larger
boulevard than most of the homes and the variance would not be noticeable. The proposal is reasonable
under the circumstances, it observes the character of the area and would not be deoimental to the health and
welfare of the commlmity.

Deb Garross, Assistant City Planner, presented the information as per planning repon of May 19, 1994.
The subject site is a substandard lot of record and was subdivided via an administrative land division by the
City of Prior Lake in 1985. There is a 60 foot public right-of-way where a storm sewer is located nonherly
of the site. A variance was granted at the time of construction but expired. Staff recol11Irel1d~ that a 5 foot
north sideyard and a 25 foot Iakeshore variance be granted. The Valiance requested would be consistent
with variances granted to the structure on the adjacent parcel and with previous actions of the Planning

INTRODUCTION:
The Planning Department has received a variance application from Lawrence Hartmann of 3582
Basswood Circle SW, for the property located at 3576 Basswood Circle SW. The applicant is requesting
the Planning Commission to approve a 6' north front yard variance from the 25' front yard setback
requirement to construct a rambler style single family home.
PHYSIOGRAPHY:
The vacant subject site contains approximately 21,429 square feet of lot area. The site slopes from the
north property line (along Basswood Circle) to the south property line. There are 12 coniferous trees on
the lot, 5 to 7 of which are located within or near the building pad of the home, and may be lost due to
construction. There is also one Cottonwood tree which will be lost since it is located in the building pad
area. There are a line of bushes (possibly lilac) which extends across Mr. Hartmann's present home (the
property to the east) and this vacant lot, some of which may also be lost.
ADJACENT USES:
This single family neighborhood is part of the Willows 3rd Addition which was platted in 1972 within
Spring Lake Township. The plat is nearly completely developed, and the majority of the homes in this
addition were built in the 1970's. All of the lots within this subdivision appear to meet the R-l,
Suburban Residential, single family regulations of the Prior Lake Zoning Ordinance. There have been no
variances requested or granted in the area which was studied (see attached Map #1 for study area and
years built).
This lot is located on a platted eyebrow cul-de-sac. The City's road reconstruction plans in 1985
eliminated the improvement in the cul-de-sac. What has resulted is an improved street that turns at an
approximate 90 degree angle, and a considerably larger boulevard for the properties platted on the
cul-de-sac. The setback from the curb to the proposed home is 60' (see attached Map #2 for reference).
PLANNING CONSIDERATIONS:
The applicant is requesting a 6' front yard setback variance from the 25' setback requirement to construct
a single family home. This home is proposed to be one story walkout to accommodate the handicapped
condition of the applicant's wife. The requested variance would allow this proposed home to be setback
along a similar visual line as the homes located on the properties to either side. The home to the east is
also owned by the applicant. Due to the reconstruction project the applicant has a substantially larger
boulevard than most of the homes in this subdivision, and thus the front yard variance will not be
noticeable. The setback from the proposed home to the curb is 60'. which meets the intent of the front
yard setback requirement of the Zoning Ordinance.

ALTERNATIVES:
1. Approve the variances as requested, or with some modifications as per Planning Commission
discussion.
2. Continue or table discussion for specific reasons.
3. Deny the variances fmding lack of demonstrated hardship.
RECOMMENDATION:
The recommendation from staff is Alternative #1.
If it is the intent of the Planning Commission to approve the requested variance you may consider
requiring that the coniferous trees that would be lost due to construction be relocated or replaced.
Variance Hardship Standards:
1. Literal enforcement of the Ordinance would result in undue hardship with respect to the
property.
The required setback appears unnecessary in this case since the street reconstruction project has
created a very large boulevard. The applicant is requesting the 6' front yard variance to build a
walkout style of home which would accommodate the needs of his family. If the home met the
required setback, some filling would need to take place, and the adjacent homes would not be
setback along the same visual line as the applicant's proposed home.
2. Such unnecessary hardship results because of circumstances unique to the property.
The City's reconstruction plans 85-11 eliminated the improvements in the eyebrow cul-de-sac
which has created a larger boulevard, and greater front yard appearance (60' from the back of the
curb to the applicant's proposed home), so the 6' variance will not be noticeable. The larger
boulevard is a unique feature associated with this lot. Topography of the site is such that the
proposed walkout rambler fits well into the hillside as currently placed.
3. The hardship is caused by provisions of the Ordinance and is not the result of actions of
persons presently having an interest in the property.
The City has reconstruct the street not based on the cul-de-sac which created the unusual
condition. The owner had no interest in this decision.
4. The variance observes the spirit and intent of this Ordinance, produces substantial justice
and is not contrary to the public interest.
The proposal is reasonable under the circumstances. It observes the character of the area and is
not detrimental to the general health, safety, and welfare of the community.

REQUEST:
The applicant proposes to construct a new single family home as
per attached sUlVey reduction. In order to construct the home as
proposed, the applicant requests the Prior Lake Planning
Commission to grant the following variance from Zoning
Ordinance 83-6:
1. 6' north front yard variance from the 25' front yard setback
