After seeing the recvullU:;",.dation flum Staff, he would agree to a 25 foot variance lakeshore instead of 27 feet as originally requested. Deb Garross, Assistant City Planner, presented the information as per planning report of May 19, 1994. The subject site is a substandard lot of record and was subdivided via an administrative land division by the City of Prior Lake in 1985. There is a 60 foot public right-of-way wrere a storm sewer is located northerly of the site. A variance was granted at the time of construction but expired. Staff's recvullu,:uds that a 5 foot north sideyard and a 25 foot lakeshore variance be granted. The variance requested would be consistent with variances granted to the structure on the adjacent parcel and with previous actions of the Planning Cuull..;ssion related to lakeshore setback variances. BONNIE CARLSON, ASSISTANT CITY MANAGER _YES LNO MAY 19, 1994 INTRODUCTION: The attached information is part of an economic development package for development of a second parcel within the Waterlront Passage Business Park. Specifically, the City of Prior Lake owns the subject site and is in the process of negotiating a development proposal for Becker Arena Products. The contractor for the project is Greystone Construction. The request is to consider a 10' east side yard variance from the 20' side yard setback requirement of the 1-1, Business Park zoning district. See attached materials for subject site location and development plan. D.ISClJSSION: See attached memo from Roger Guenette of Advance Resources for Development, Inc. Mr. Guenette is a consultant retained by the City of Prior Lake, to market and assist processing of economic development applications for the Waterlront Passage Business Office Park. ALTERNATIVEs;' 1. Approve the 10' east side yard variance as requested. 2. Table or continue the item for specific purposes. 3. Deny the application finding no demonstrated hardship. ,RECOMMENDATION: Alternative #1. Variance Hardship Standards: 1. Literal enforcement of the Ordinance would result in undue hardship with respect to the property. In this case, literal enforcement of the Ordinance would result in the probable loss of a second tenant within the Business Office Park. The City and developer have spent considerable time and effort in an attempt to accomplish the objective of the Business Park, to develop at least one property per year. It is in the City's best interest to facilitate this project. The development could not occur on the original site intended due to wet conditions within the plat. The original subject site was to be within Block 2. However, due to wet conditions, an alternate site within Block I was found in order to facilitate the development. There are more stringent setback requirements within Block 1, therefore the contemplated site plan requires a variance. 3. The hardship is caused by provisions of the Ordinance and is not the result of actions of persons presently having an interest in the property. The City of Prior Lake is the developer of the Business Office Park. The plat of Waterfront Passage Addition was approved with the understanding that the City would attempt to facilitate development proposals that are consistent with the objectives of the Business Park and Economic Development incentives. The Becker Ice Arena project is consistent with the Business Park objectives, however, the alternate site contains more restrictive setbacks than the original site contemplated for the development. 4. The variance observes the spirit and intent of this Ordinance, produces substantial justice and is not contrary to the public interest. The variance observes the spirit and intent of the Ordinance and Business Park District. The grant of one, 10' east side yard variance would not be contrary to the public interest. 'or Oeve'OPIMItt-:i: DATE: May 13. 1994 TO: Prior Lake City Council FROM: Roger Guenette Request for Variance and Increase of Tax Increment Budget fer Becker Arena Project RE: Over the past month the City staff has been working with Becker Arena Products, Inc. and Greystone Construction, the project contractor, to finalize site plans and prepare tinal budgets, AS you may recall the project v.a:> initially to occur within Block 2 of the Business Park, but was then shifted to a lot within Block 1 due to .....et conditions on the original site. An issue has arisen due to the setback requirements of lots within Slock 1. Due to more stringent setbacks. the proposed site plan cannot be accommodated unless a sideyard setback variance is granted. To enable the site plan to be implemented and maximize development density it is necessary to allow a 10 foot sideyard building setback rather than the 20 foot sideyard building setback stipulated in the Business Park design standards. The company is concerned about management of the project budget b&C3use they are proposing to upgrade the facility from a metal to a concrete structure and increase the initial scope of development frcm 8.000 to 7.000 SF. They still intend to construct an additional 6,000.1.000 SF within the next 2.3 years. To p~cmote the propO$ed upg:'ade of building materials and expand the size of the facility, the company has requested approval of a variance for sideyard setback and $9,300 in additional funding to be repaid to the city through tax increments. Approximately $10,000 in additional tax increment ..vould be generated as a result ofthe increas@d project size. The company has been experiencing very significant groMh and is seeking to begin the project immediately. They have indicated that Shakopee has proposed they develop on a , acre lot which has no soil correction issues. lesser setback stipulations and less stringent covenants pertaining to landscaping, curbs and gutter. Specifically, the City of Prior Lake owns the subject site and is in the process of negotiating a development proposal for Becker Arena Products, The contractor for the project is Greystone Construction. The request is to consider a 10' east side yard variance from the 20' side yard setback requirement of the I-I, Business Park zoning district. Mr. Guenette is a consultant retained by the City of Prior Lake, to market and assist processing of economic development applications for the Waterfront Passage Business Office Park. ALTERNATIVE&. 1. Approve the 10' east side yard variance as requested. 2. Table or continue the item for specific purposes. 3. Deny the application finding no demonstrated hardship. RECOMMENDATION: Alternative #1. Variance Hardship Standards: 1. Literal enforcement of the Ordinance would result in undue hardship with respect to the property. In this case, literal enforcement of the Ordinance would result in the probable loss of a second tenant within the Business Office Park. The City and developer have spent considerable time and effort in an attempt to accomplish the objective of the Business Park, to develop at least one property per year. It is in the City"s best interest to facilitate this project. The development could not occur on the original site intended due to wet conditions within the plat. The original subject site was to be within Block 2. However, due to wet conditions, an alternate site within Block I was found in order to facilitate the development. There are more stringent setback requirements within Block 1, therefore the contemplated site plan requires a variance. 3. The hardship is caused by provisions of the Ordinance and is not the result of actions of persons presently having an interest in the property. The City of Prior Lake is the developer of the Business Office Park. The plat of Waterfront Passage Addition was apJ:'J.Vved with the understanding that the City would attempt to facilitate development proposals that are consistent with the objectives of the Business Park and Economic Development incentives. The Becker Ice Arena project is consistent with the Business Park objectives, however, the alternate site contains more restrictive setbacks than the original site contemplated for the development. 4. The variance observes the spirit and intent of this Ordinance, produces substantial justice and is not contrary to the public interest. An issue has arisen due to the setback requirements of lots within Slock 1. Due to more stringent setbacks. the proposed site plan cannot be accommodated unless a sideyard setback var.ance is granted. To enable the site plan to be implemented and maximiz:a development density it is necessary to allow a 10 foot sideyard building setback rather than the 20 100t sideyard building setback stipulated in the Business Park design standards. The company is concerned about management of the project budget b&C3use they are proposing to upgrade the facility from a metal to a concrete structure and increase the initial scope of development from 8.000 to 7,000 SF. They still intend to construct an additional 6.000.1.000 SF within the next 2.3 years. To promote the propc~ed upg:'ade of building materials and expand the size of the facility. the company has requested approval of a variance for sideyard setback and $9.300 in additional funding to b~ repaid to the city through tax increments. Approximately $10.000 in additional tax. increment would be generated as a result of the increased project siZe. The company has been experiencing very significant gro\vth and is seeking to begin the project immediately. They have indicated that Shakopee has prop~sed they del/Glop on a 1 acre lot which has no soil correction issues. lesser setbacl< stipulatiol1s and less stringent covenants pertaining to landscaping, curbs and gutter.
