and discussed what he believed to be a discrepancy in the distance of the }'NpOSed deck addition to the

Associate City Planner, Gina Mitchell, presented the infvuuation as per planning report dated June 2, 1994.
The request is for a 40.5' County Road 12 setback variance llU~ll the 85' County Road setback requirement
The subject site is a substandard lot and was platted under the jurisdiction of Spring Lake Township. The
majority of the construction that has occwred in this area was done before the 85' county road setback
requirement was inCOIpu1cW:.d into the Zoning Oldinance in 1989, resulting in many strucmres encroaching

INTRODUCTION:
The Planning Department has received a variance application from Marty Hanson of 3068 170th Street
SW. The applicant is requesting the Planning Commission to approve a 40.5' front yard variance from the
85' County Road 12 setback requirement to construct a 14' x 24' deck as indicated on the attached
survey.
PHYSIOGRAPHY:
The subject site contains approximately 8.850 square feet of lot area. The site is relatively nat, and
developed with a single family home and garage that was built in 1978. The site has several trees located
on it which should not be affected by the construction of the deck as proposed.
ADJACENT USES:
This single family neighborhood is part of the original Spring Lake Town Site which was platted in 1857
within Spring Lake Township. The City of Prior Lake annexed this area into the community in 1975.
This area is almost completely developed with single family homes and many cabins which have been
upgraded/remodeled. Specifically. the lot to the west is vacant, and at some time in the future may be
developed with a single family home. Several of the properties to the east were built before the 85'
County Road setback requirement was established, and they comply.
PLANNING CONSIDERATIONS:
The attached Map #2 is the 1976 reconstruction project plans. It shows the homes/cabins that existed in
the area at that time, and the setbacks from the centerline of County Road 12 are indicated. There are
several homes in this area that do not meet the 85' County Road Setback requirement. What the applicant
is proposing is not consistent with the development pattern on the north side of the County Road 12.
In 1990, the property located at 3019 Spring Lake Road (across the street) received a 36' variance from
the 85' County Road setback requirement. Brad Larson with the Scott County Highway Department
responded to the request stating that it is consistent with other buildings on County Road 12. He also
stated that the applicant should be aware that any future upgrading of the road may impact the area
between the existing roadway and the home that was being proposed (see attached letter).
In response to this variance request, Jack Witt, also with the Scott County Highway Department, called
and stated that this request is reasonable since there are several other properties in this area that are closer
to the centerline than what the applicant is proposing.
ALTERNATIVES:
1. Approve the variances as requested. or with some modifications as per Planning Commission
discussion.
2. Continue or table discussion for specific reasons.

3. Deny the variances fmding lack of demonstrated hardship.
RECOMMENDATION:
The recommendation from staff is Alternative # 1. Staff recommends that the size of the deck be reduced
to 10' x 24'. This would require a 36.5' setback variance. This deck would maintain a 25' setback to the
front property line, which is consistent with the R-1 zone. The variance that was granted in 1990 for the
property across the street also observes that setback. In addition, should County Road 12 ever be
improved the deck addition should not impede the acquisition of additional right-of-way.
Variance Hardship Standards:
1. Literal enforcement of the Ordinance would result in undue hardship with respect to the
property.
The applicant should be able to use his property in a similar way as others who own single family
lots. A 36.5' County Road setback would maintain a 25' front yard setback, and will allow the
applicant a reasonable use of his property.
2. Such unnecessary hardship results because of circumstances unique to the property.
The hardship is created by the fact that the lot was platted under the jurisdiction of Spring Lake
Township. The standards of Spring Lake Township are significantly different than current
Zoning and Subdivision regulations for the City of Prior Lake.
3. The hardship is caused by provisions of the Ordinance and is not the result of actions of
persons presently having an interest in the property.
The home and garage were built in 1978. In 1989, the 85' County Road setback was adopted,
making the site legally non-conforming. The hardship is not the result of the property owner.
4. The variance observes the spirit and intent of this Ordinance, produces substantial justice
and is not contrary to the public interest.
The variance requested is consistent with the development pattern in the area and is reasonable
under the circumstances. It observes the spirit and intent of the Ordinance and would not be
detrimental to the general health, safety, and welfare of the community.

We have reviewed the proposed variance request from the required 85 foot County
Road setback to 44.5 feet and note the following:
. Other buildings along this segment of CSAH 12 are as close as or closer than the
proposed variance request.
. Future upgrading of CSAH 12 should be not affected by this proposal. However,
applicant should be aware of and accept the fact that future upgrading of CSAH
12 will affect the property within the setback area.
Based on the above, the Scott County Highway Department does not object to this
variance request.

referenced request. However, for the record, the following
comments are listed:

highway right-of-way, it is in line with other

Permit is required prior to construction of driveway.
Existing driveways will be required to be removed.
