The Ju1y 7, 1994, Planning Commission Meeting was called to order by Chainnan Amold at 7:00 P.M.
Those present were Cvullll~ssioners Roseth, Amold, Loftus, Vonhof, Assistant City Planner Deb GalTOSS,
Associate Planner Gina Mitchell, and Secretary Rita Schewe.

A recess was called at 7 :05 P.M. to await the anival of City Manager Frank Boyles. The meeting was
reconvened at 7 :30 PM. As the City Manager Boyles was not present:. Item I was placed at the end of the
agenda At this time Item II was brought before the O.JuIl1..:ssioners.
ITEMJI - CHRIS ANDF.HSON - VARIANCE
Ouis Anderson, 16020 Eagle Oeek Avenue, stated he is requesting a variance in order to add a dining
room addition to his residence. The home is very small and the family is growing, so therefore more room
is needed. Mr Anderson said at the same time he will be raising the house and putting in a full basement
which will bling the sttucture into compliance with the Flocxi Plain Ordinance.
Gina Mitchell, Associate Planner, presented the infonnation as per planning repOlt of July 7, 1994. The
variance requested is a 6 foot east front yard Valiance from the 25 foot front yard setback requirement The
subject site is a small, substandard lot of record that has no legal building envelope if all the setbacks were
applied. The hal'clship was created by the platting process of a previous governing bcxiy.
Comments from the Commissioners were in SUPPOlt of the Valiance.

INTRODUCTION:
The Planning Department has received a variance application from Chris Anderson of 16020 Eagle Creek
Avenue. The applicant is requesting the Planning Commission to approve a 6' east front yard variance
from the 25' front yard setback requirement to construct a 12' x 12' dining room addition as indicated on
the attached survey,
PHYSIOGRAPHY:
The subject site is 53' wide and 70' deep, containing approximately 5,183 square feet oflot area. The site
slopes from the front of the lot to the lake with about 20' of relief, The majority of the vegetation near the
front of the property consists of volunteer growth, There are no significant trees that will be effected by
the proposed addition,
ADJACENT USES:
The subject site is located in the single family, lake shore neighborhood of Lakeside Park. This
subdivision was platted in 1921 within Spring Lake Township, and annexed into the City of Prior Lake in
1973, The majority of the lots in this area have been developed with cabins, many of which have been
remodeled or upgraded to year round single family homes,
There are several properties in this area which do not meet the required setbacks according to City Zoning
Ordinance 83-6, The adjacent property to the south has a garage that was built 22.5' over the front
property line, While conducting a site inspection, it appeared that other properties to the south of the
applicant's may also be encroaching the 25' front yard setback requirement. There are no front yard
variances that have been granted in this area, which may be due to the fact that these structures (homes,
garages) were built within Spring Lake Township,
PLANNING CONSIDERATIONS:
The subject site is a small. substandard lot of record that has no legal building envelope, The existing
home was built in 1940, encroaching on the rear and south side yard setbacks, The applicant is proposing
to build a dining room addition off the east side (front) of the home, The only reasonable expansion area
for this home is toward the street which has an extraordinary large boulevard of 40', In part due to the
topography and lot sizes, other homes in this neighborhood have developed close to the front property
line. The proposal will not pose any problems to the area development nor be detrimental to the property
values,
ALTERNATIVES:
) , Approve the variances as requested, or with some modifications as per Planning Commission
discussion,
2, Continue or table discussion for specific reasons.
3, Deny the variances finding lack of demonstrated hardship,

RECOMMENDATION:
The recommendation from staff is Alternative #1, Staff recommends that the Planning Commission grant
the 6' front yard variance.
Variance Hardship Standards:
1. Literal enforcement of the Ordinance would result in undue hardship with respect to the
property.
The applicant should be able to use his property in a similar manner as others who own single
family lots, The applicant has a small substandard lot, which if all setbacks were applied would
render this lot unbuildable,
2. Such unnecessary hardship results because of circumstances unique to the property.
The hardship is created by the fact that the lot was platted under the jurisdiction of the Spring
Lake Township, The standards of Spring Lake Township at the time of subdivision are
significantly different than current Zoning and Subdivision regulations for the City of Prior Lake.
The unique features of the lot indicate a an expansion of the home into the front yard as the
reasonable alternative.
3. The hardship is caused by provisions of the Ordinance and is not the result of actions of
persons presently having an interest in the property.
The hardship is caused by the application of current Zoning regulations to a substandard lot of
record and is not the result of the property owner.
4, The variance observes the spirit and intent of this Ordinance, produces substantial justice
and is not contrary to the public interest.
The variance requested is consistent with the development pattern in the area, and is reasonable
under the circumstances, It observes the spirit and intent of the ordinance and would not be
detrimental to the health, safety, and welfare of the community.
