to construct a deck on his lakefront cabin at 16244 Lakeside Avenue. A letter from his adjacent neighbor on
Lot 25, Michael and Karen LOl1nser, was read into the record supporting the variance request
Gina Mitchell, Associate Planner presented the infOlmation as per planning repOlt of July 7, 1994. The
request is for a 13 foot lakeshore Vallance from the 75 foot lakeshme setback requirement and a 2 foot east
sideyard Vallance from the 10 foot sideYalu setback requirement The subject site is a small substandaI'd
Lot of Record and was platted under a previous governing body. The applicant will consttuct the deck to
save the trees on the lot The proposed i.Luplvvements observe the spirit and intent of the Zoning Ordinance
and substantial justice would be realized by allowing the owner of the Propc..lLj to use and develop in a

INTRODUCTION:
The Planning Department has received a variance application from Michael Fischbach of 84 West Duck
Pond Drive, West St. Paul. The applicant is requesting the Planning Commission to approve a 13'
lakeshore variance from the 75' lake shore setback requirement and a 2' east side yard variance from the
10' side yard setback requirement to construct a deck at the property located at 16244 Lakeside Avenue,
as indicated on the attached survey.
PHYSIOGRAPHY:
The subject site is 50' wide and approximately 175' deep, containing approximately 8,750 square feet of.
lot area. The site slopes from the front of the lot to the rear. There are several significant trees on the site
which will not be impacted by the proposed deck. There is one large oak tree located in the northwest
corner of the deck which the applicant is proposing to save by designing the deck in manner which will
avoid this tree.
ADJACENT USES:
The subject site is located in the single family, lakeshore neighborhood of Lakeside Park. This
subdivision was platted in 1921 within Spring Lake Township, and annexed into the City of Prior Lake in
1973. The majority of the lots in this area have been built with cabins, many of which have been
remodeled or upgraded to single family homes.
There have been very few variance requests in this area. It appears that several homes do not meet the
required 10' side yard and 75' lakeshore setback requirements. This is likely due to the fact that these
properties were built under the jurisdiction of Spring Lake Township. The property to the west was built
in 1957,6' from the east property line. In 1985, this property received a 7' west side yard variance for a
deck.
PLANNING CONSIDERATIONS:
The subject site is a small, substandard lot of record. The home was built in 1920, 4.68' from the east
property line. The northern most part of the house was built 8' from the east property line. The applicant
is proposing to build a deck off the north side (lakeside) of the home. Stairs will access the northeast
corner of the deck with a landing area proposed to be located 8' from the east property line.
The subject site is located on a slight point, with the ordinary high water mark of Prior Lake encroaching
further south on the applicant's property than it does on the two adjacent properties. The applicant is
proposing to be 62' from the 904. Visually, the applicant's deck will appear to be at a setback consistent
with the adjacent properties. The Planning Commission will need to determine if the proposed deck
setback meets the variance hardship criteria of the Zoning Ordinance.

AN EQUAL OPPORTUNITY EMPLOYER
ALTERNATIVES:
1. Approve the variances as requested, or with some modifications as per Planning Commission
discussion.
2. Continue or table discussion for specific reasons.
3. Deny the variances finding lack of demonstrated hardship.
RECOMMENDATION:
The recommendation from staff is Alternative #1. Staff recommends that the Planning Commission grant
the 2' east side yard variance and the 13' lakeshore variance. A deck 14' deep is a reasonable in this
situation because the applicant is trying to reduce the length of the deck to avoid destroying the large oak
tree located in the northwest corner of the deck. The deck will be located closer to the 904 than the decks
on adjacent properties due to the fact that the applicant's lot is located on a point. In all likelihood, this
encroachment on the 904 will not be noticeable by neighborhood residents or by persons using the lake.
Variance Hardship Standards:
1. Literal enforcement of the Ordinance would result in undue hardship with respect to the
property.
The applicant should be able to use his property in a similar manner as others who own single
family lake shore lots. The proposed deck will be in harmony with the character of the
neighborhood and will provide an opportunity conducive to lakeshore living.
2. Such unnecessary hardship results because of circumstances unique to the property.
The hardship is created by the fact that the lot was platted and developed under the jurisdiction of
the Spring Lake Township and Scott County. The standards of Spring Lake Township and the
County at the time of subdivision were apparently less restrictive than current Zoning and
Subdivision regulations for the City of Prior Lake.
3. The hardship is caused by provisions of the Ordinance and is not the result of actions of
persons presently having an interest in the property.
The hardship is caused by the application of current Zoning regulations to a substandard lot of
record and is not the result of the property owner.
4. The variance observes the spirit and intent of this Ordinance, produces substantial justice
and is not contrary to the public interest.
The proposed improvements observe the spirit and intent of the Zoning Ordinance by allowing
the applicant to improve a lakeshore property with a deck attached to the home. Substantial
justice would be realized by allowing the owner of the property to use and develop it in a manner
consistent with the character of the neighborhood and special needs of lakeshore living on a lot
that is substandard in width and lakeshore setbacks, due to the previous platting and zoning
requirements of Spring Lake Township, to improve his property.

I. A 13' lakeshore variance from the 75' lakeshore setback
requirement.
2. A 2' east side yard variance from the 10' side yard setback
requirement.
