Chairman Arnold passed the gavel to CVlllll.;ssioner Roseth and withdrew from the discussion as he is a
memrer of the Association.
Dave Vrnlove, 15738 Island View Road, Vice President of the Island View 5th Addition Homeowners
Association, stated the memrers of the Association wish to construct a shelter on Outlot A of Island View
5th Addition. They have designed the StruCUlre to allow various types of recreation in the open space and to
allow access to the lakeshore on both sides.
Gina Mitchell, Associate Planner, presented the in[Vlluation as per memo of July 21, 1994. The variances
being requested are: a 45 foot lakeshore variance on the west side and a 33 foot lakeshore variance on the
east side from the 75 foot lakeshore setback requirement When this site was platted in 1987 a conditional
use permit was granted to permit docks and V}JC-U land recreation uses, and a pavilion would be consistent
within the intent of the Conditional Use Permit. The Flood Plain Ordinance does allow construction of
platforms within the flood plain, so the floor of the pavilion can be below 909.3. In the past, the Planning
Cvulll.;ssion has not granted variances over 50%. Staff recoll11U;;uds an alternative plan which would be
consistent with the 50% policy, that being a 32.5 foot and a 25 foot lakeshore setback valiances. If the
required 75 foot lakeshore setbacks are applied, the site would be unbuildable.
Dave Vinlove stated that the Association would not want to cause any problems in changing setbacks or set
a negative precedent and would agree to Staff's alternate plan.
Comments from the Commissioners were; unusual situation, fuUlre expansion plans, parking, electricity,
slope of roof, slab consnuction, and were not in favor of DNR's recollllU::l1dation.

ITEM II . GREG ENGEBOS. VARJANCE
Greg Engebos, 4931 Beach Street, stated that when he was before the Council to appeal his denial of the
three (3) foot north side yard variance, it was noted he needed a lot area variance for 14588 Glendale
Avenue, as the lot is less than 10,000 square feet He is now requesting that variance.
Gina Mitchell, Associate Planner, presented the information as per planning ~c,'pv~l of July 21, 1994. The
Planning Commission acted on a request on June 16, 1994, granting a five (5) foot south side yard variance
and denying a three (3) foot north side yard variance to the site. M1: Engebos appealed the Planning
Commission decision to deny the three (3) foot north side yard variance. The Council did not act on the
appeal because it became evident that a lot area variance was needed. The subject site is 56' wide and 140'
deep containing app~uximately 7,840 square feet of lot area. The required lot size for a substandard
non-wateIfront lot of record in the Shoreland District is 10,000 square feet. The request is for a 2,160
square foot lot area variance for the site to be considered buildable. The site is selVed with utilities and
assessments have been paid on the property. The applicant owns the adjacent lot to the north as well as the
subject site. This lot will be considered buildable provided that the lot area variance is granted and the lot
is owned by a separate individual other than the applicant when the building pc,Hu~t is filed. Hardship is
caused by the the cun-ent Zoning regulations and is not the result of the pru1^'~ Lj owner.
Tom Roszak, 14581 Glendale Avenue, objected to building on a smaller lot and thought the two lots should
be combined.
Horst Graser, Director of Planning, explained the standards of the current regulations. Taxes and sewer and
water assessments have been paid on the subject site. A brief summary on the ordinance standards was
gIven.

INTRODUCTION:
The Planning Department has received a variance application from Kurt Hazekamp of 15654 Fremont
Avenue NW, representing the Island View 5th Addition Home Owners Association. The applicant is
requesting the Planning Commission to approve the following variances for the property located at 15585
Fremont Avenue NW in order to construct a pavilion.
1. 45' lakeshore variance from the 75' lakeshore setback requirement (on the west side).
2. 33' lakeshore variance from the 75' lakeshore setback requirement (on the east side).
PREVIOUS PROPOSALS:
None.
PHYSIOGRAPHY:
The subject site is approximately 80' wide along Fremont Avenue and widens out to 180' along the east
(Crystal Bay) side of the lot. The lot is roughly 220' deep, containing approximately 22,858 square feet
of lot area above the ordinary high water mark of Prior Lake. The site is unique in that the ordinary high
water mark encroaches the site on two sides, necessitating the request for two lakeshore variances. The
45' lakeshore variance is for the east side of the pavilion (Crystal Bay side) and a 33' lakeshore variance
for the west side of the pavilion (channel side).
The site is relatively t1at sloping from Fremont Avenue to Prior Lake. There are several trees located
along the channel which drains Artie Lake. These trees will virtually screen the pavilion from the
existing homes across the channel. It is unlikely that these trees will be impacted by the construction of
the pavilion as proposed.
ADJACENT USES:
The site is located within the single family neighborhood of Island View 5th Addition. This subdivision
was platted in 1987 with the subject site designated as an outlot. This outlot was dedicated to the 21 lots
located within Island View 5th Addition for backlot access. The adjacent lot to the north is developed
with a single family home, meeting all setback requirements of the zoning ordinance. Four lots to the
south of the channel received 20' lakeshore setback variances (see attached map for specific location).
PLANNING CONSIDERATIONS:
If all setbacks are applied to the subject site the lot would be virtually unbuildable since the 75' lake shore
setback requirement must be applied to two sides of the lot. The home owners association has positioned
the pavilion as close to the point as possible to take advantage of the view and the desirability to be close
to the water when recreating. The Planning Commission will need to detennine if the 45' variance on the

channel side and 33' on the Crystal Bay side are reasonable requests under the circumstances.
The Planning Commission has tried to eliminate granting variances which exceed 50% of the required
setback unless absolutely necessary. If this policy were applied to this situation, the Planning
Commission would not grant a lakeshore variance over 37.5' unless there were some unique
circumstances which would warrant a greater variance. Staff has reviewed the proposal and positioned
the pavilion in an area that would reduce the requested variances from 45' to 37.5' along the channel, and
along Crystal Bay from 33' to 25'. Staff is of the opinion that this location will provide the users of the
pavilion the same opportunities for using the lake shore as in the requested location while still maintaining
the 50% objective has established.
ALTERNATIVES:
1. Approve the variances as requested, or with some modifications as per Planning Commission
discussion.
2. Continue or table discussion for specific reasons.
3. Deny the variances finding lack of demonstrated hardship.
RECOMMENDATION:
The recommendation from staff is Alternative #1. Staff recommends denying the variances as requested,
but would support granting a 37.5' lakeshore variances along the channel side and a 25' lakeshore
variance along the Crystal Bay side from the 75' lakeshore setback requirement.
Variance Hardship Standards:
1. Literal enforcement of the Ordinance would result in undue hardship with respect to the
property.
If current setback standards are applied to the subject site, it would be rendered unbuildable.
Literal enforcement of the Ordinance would result in undue hardship with respect to the property.
2. Such unnecessary hardship results because of circumstances unique to the property.
The subject site is unique in that the lakeshore of Prior Lake encroaches this property on two
sides, creating a unique circumstance with respect to the site.
3. The hardship is caused by provisions of the Ordinance and is not the result of actions of
persons presently having an interest in the property.
Due to the fact that the lake shore surrounds the property on two sides, increased setbacks are
required for the site that are not required for other lakeshore lots which typically have only one
lakeshore setback applied. The hardship is caused by the application of a 75' setback requirement
on the channel and Crystal Bay sides of the property.
4. The variance observes the spirit and intent of this Ordinance, produces substantial justice
and is not contrary to the public interest.
The proposed lakeshore variances are reasonable under the circumstances and would not be
contrary to the public interest.

Dear Ms. Mitchell:
I have reviewed the materials submitted relative to the setback
variance requested by the Island View 5th Addition Homeowners
Association and offer the following recommendations for
consideration at the July 21, 1994 Planning commission meeting.
The extension of Prior Lake into the southwest portion of the
property results in some unique circumstances that render necessary
the application for variance regardless of where the proposed
pavilion might be located on the lot. However, I do not believe
that the proposed location fully minimizes the variance needed.
By simply moving the pavilion north and east of the proposed
location, the required 75' setback from the east side (Crystal Bay
side) can be met, and the variance from the west side (channel
side) can be reduced. Unless there are other factors which would
preclude the relocation of the structure, the DNR encourages the
City to require the applicant to pursue a design and location which
requires a maximum of only one setback variance.
Enclosed is a sketch of my proposed recommended location.

The applicant proposes to construct a pavilion as indicated on the
attached survey. In order to construct the pavilion as proposed, the
applicant requests that the Planning Commission grant the following
variances from the requirements of Prior Lake Zoning Ordinance 83-6:
1. A 45' lakeshore variance from the 75' lakeshore setback
requirement (on the west side).
2. A 33' lakeshore variance from the 75' lakeshore setback
