lot area villiance for a non waterfront lot located in the Shoreland Disnict in order to be buildable.
Gina Mitchell, Associate Planner, presented the infOlmatiOl1 as per planning repOlt of September 1, 1994.
111e subject site is approximately 82 feet wide and 120 feet deep, containing 9,722 square feet of lot ill"ea.
111e sub::livision was platted in 1923 in Spring Lake Township and mmexed into the City of Ptior Lake in
I CJ73. In 1 CJ79, the minimum lot m-ea in the R-l district was 10,000 square feet, however, a lot mea vmiance
was not issued to the subject site as it was inadveltently missed by the City at the time of an adrninisn"ative

Blair Tremer-e, Acting Plmming Director, presented the infOlmation as per planning repolt of Septemrer 1,
1994. The request is for a 70 foot nOlth side and a 90 foot SOUtl1 side variance from the 100 foot property
setback r-equirement for accessOlY fmm buildings and a 2,668 square foot m"ea vmiance from the 832 squm-e
foot maximum ar-ea requirement for accessory sn"lrcrm-es within the R -1, Suburban Residential Disnict. 111e
building is an accessOlY to the agricultural use and not to a primmy building and the cOlll1cil is empowel-ed
to allow this. The CUlTent Zoning Standards of the R -1 Suburban Residential Zone al-e not appropriate for
propel1ies not served by mlll1icipal services. The harclship is the result of application of urban development
standards to a propel1y located in tl1e nual m-ea. Staff is not opposed to the grant of minimal setback
vill"iances provided that a condition stating no animals be housed within or about the pole building. It is

INTRODUCTION:
The Planning Depaltment has received a variance application from Summit Construction Inc. of
1609 West County Road 42 #261, Burnsville, Minnesota. The applicant is requesting the
Planning Commission to approve a 278 square foot lot area variance from the 10,000 square foot
minimum lot area requirement for a non water frontage lot located within the Shoreland District
for the site to be considered buildable.
PHYSIOGRAPHY:
The subject site is approximately 82' wide and 120' deep, containing 9,722 square feet of lot
area. The site slopes from the northwest corner of the lot to Green Heights Trail. There are seven
significant Maple trees on the site, three of which will be lost due to construction. Along Green
Heights Trail there are several pine trees which shouldn't be affected by the construction of the
home as proposed.
PLANNING CONSIDERATIONS:
The subject site is located in the First Addition to Lakeside Park. This subdivision was platted in
1923 within Spring Lake Township and annexed into the City of Prior Lake in 1973. In 1979,
the City approved an administrative land division, subdividing Lots 1, 2, and 3, First Addition to
Lakeside Park, into three new tracts (see attached survey - Map #2), When inquiries have been
made on the subject site and the adjacent parcel to the west (Parcel C), staff has advised
developers that they may wish to consider combining the two lots for building purposes. Parcel
C is very low lying and has a very small building envelope. Parcel B, the subject site, and Parcel
C are not under common ownership. They are separate legal parcels, as approved by the City.
According to Finance Director, Ralph Teschner, Parcel C was never assessed because it was
unlikely that the site would be buildable. Should Parcel C ever develop, a connection fee in lieu
of special assessments will be charged (see attached memo). Installation of the water and sewer
stubs for the subject site will be the responsibility of the property owner at the time of building
permi 1.
In 1979, the minimum lot area for a newly created single family lot in the R-1 District was
10,000 square feet, however, a lot area variance was not issued to the subject site. In 1987, the
Shoreland Management Ordinance was adopted, stating that a substandard, non water frontage
"lot of record" is considered buildable, provided that the minimum lot area is equal to or greater

than 10,000 square feet. Since a lot area variance was not issued to the subject site at the time of
subdivision, a building permit cannot be issued until a lot area variance is approved,
Currently existing on the subject site is a driveway off of Park Avenue which provides access to
Parcel A (adjacent parcel to the north, see Map #2). Parcel A also has access to Green Heights
Trail across Parcel C. According to Acting Planning Director, Blair Tremere, the property owner
of Parcel A will need to construct a driveway over his property, or get an easement for continued
access purposes from Parcel C. The owner of the subject site (Parcel B) cannot be required to
provide access for Parcel A.
The 278 square foot minimum lot area variance request is reasonable because the property was
subdivided within the City of Prior Lake, assessments have been paid on the property, and the
subject site is a "Lot of Record" as defined by the Zoning Ordinance and therefore, subject to a
building permit. The Planning Commission has granted multiple lot area variances since the
1987 adoption of the Shoreland Management Ordinance which established the minimum
substandard lot size requirement. Denial of the lot area variance would render the lot
non-buildable which would create an undue hardship with respect to the property.
ALTERNATIVES:
1. Approve the variance as requested.
2. Continue or table the discussion for specific reasons.
3. Deny the variance finding lack of demonstrated hardship.
RECOMMENDATION:
Staff recommends Alternative #1.
Variance Hardship Standards:
1. Literal enforcement of the Ordinance would result in undue hardship with respect
to the property.
The 278 square foot lot area variance is requested to build a home on the property which
was created within the City of Prior Lake and is a "Lot of Record", considered buildable
by the Prior Lake Zoning Code.
2. Such unnecessary hardship results because of circumstances unique to the property.
The hardship is created by the fact that the lot was administratively subdivided within the
City of Prior Lake, without a 278 square foot lot area variance from the 10,000 square
foot lot area requirement for a single family lot in the R-1 District.
3. The hardship is caused by provisions of the Ordinance and is not the result of
actions of persons presently having an interest in the property.
The hardship is caused by the application of current Shoreland Management Ordinance
regulations to a substandard "Lot of Record" and is not the result of the property owner.
4. The variance observes the spirit and intent of this Ordinance, produces substantial
justice and is not contrary to the public interest.
The 278 square foot lot area variance observes the spirit and intent of the Zoning
Ordinance in that this request is comparable to what has been requested and approved for
lots of similar area within the City of Prior Lake. The variance would not be contrary to
the public interest.

Lots 1-3 Lakeside Park 1st Addition were realigned by metes and bounds description in 1979
under the request of the owner J an Ballard. These lots were originally served with water and
sewer utilities in 1972 under Project 72-7 and was assessed 162.81' of frontage and 1.02 acres
for trunk acreage charges.
The balance of these assessments were transferred to Tract B (PIN# 25 097 001 1) on July 30,
1979 at the request of Mrs. Ballard to accommodate her son's application for MHFA financing
which required that no special assessment liens exist on the property. After splitting the
property, the house was sold to her son and the Ballards retained the remaining two parcels.
Mrs. Ballard was informed that the re-division of the property would result in no further
assessments. Mrs. Ballard was also informed that it was highly unlikely that Parcel C (PIN # 25
097 001 2) could be developed without consolidation with Parcel B due to floodplain
restrictions.
On July 29, 1994 Parcels B & C were sold to Integrity Development (Jim Halek) and all
applicable assessment amounts were paid and no special assessment balance remains against the
properties. The tax status of the property is in a current state with no outstanding delinquencies.
