Christensen of 3270 154th Street N.W. The applicant proposes to construct a new single family home. The previous home was built in 1880 according to the Office of the Scott County Assessor, and destroyed by fIre within the past year. The applicant proposes to construct the new home on the previously occupied building pad. In order to construct the home in the location }lluJJOsed the applicant requests the following variances from the Zoning Ordinance 330' farm building separation requirement from new construction homes: 1. 200' north setback variance to the existing bam to the north of the proposed building site. 2. 105' east side setback variance to the existing pole bam to the east of the proposed building site. Mr. Christensen explained the fIre that destroyed his home and stated that he would like to rebuild on the existing home site. The applicant is requesting the Planning Commission to approve the following variances for the property located at 15371 Breezy Point Road SE in order to replace an existing cabin with a new single family home. I. 4,35' north side yard variance from the 10' side yard setback requirement. 2. 44' lakeshore variance from the 75' lakeshore setback requirement. 3. 5' front yard variance from the 25' front yard setback requirement. 4. 39'0 impervious surface variance from the 30% impervious surface maximum. 5. A 2,706 square foot lot area variance from the 7,500 minimum lot area requirement. PREVIOUS PROPOSALS: None. PHYSIOGRAPHY: The subject site is approximately 50' wide by 95' deep and, it contains 4,794 square feet oflot area above the ordinary high water mark of Prior Lake. The site slopes from the front of the lot to the lake. The lowest Boor elevation of the home and the fill surrounding the structure must be at an elevation of 909.3. The Flood Plain Ordinance is enforced at the time of building pem1it to insure that the structure and adjacent fill complies with the regulations. The applicant has requested a north side yard variance to avoid the destruction of several large pine trees. There are no other significant trees on the lot which will be impacted by the development as proposed. ADJACENT USES: This single family neighborhood is part of Breezy Point subdivision which was platted in 1923 within Eagle Creek Township. This area was annexed into the community in 1973. The lots in this subclivision are subst,mdard by current Zoning regulations. Any new construction or additions to existing structures have required extensive setback and coverage variances. Staff researched this area and found that lakeshore variances have been granted to allow structures within 9' - 50' of the ordinary high water mark. There is no building envelope on the site that meets the required setbacks. The 44' lakeshore variance request is consistent with what has been approved within the study area. PLANNING CONSIDERATIONS: The existing cabin on the site is located 11.5' from the front property line. The applicant proposes to be 20' from the front property line. This variance has also been requested to reduce the amount of variance necessary from the lake. The Planning Commission has generally granted one, 5' side yard setback variance for substandard lots of record to allow for design flexibility for narrow lots. The applicant has chosen to seek a side yard variance on the north side of the property because the home to the north is located 14.6' from the common property line. This will allow for 20.36' between structures. The Planning Commission should be aware that granting a 5' north side yard variance to the subject site would not encumber the property owner to the north for future development. In addition, the applicant would like to preserve the large pine trees on the site. A 2,706 square foot lot area variance is necessary in order for this lot to be considered buildable. The 30% impervious surface variance coverage for a standard lot equates to 4,000 square feet. The applicant's development proposes to cover 1,604 square feet of impervious surface coverage, which is well within the coverage established by the Zoning Ordinance. However, due to the substandard area of the lot (4,794 sq. ft.), the applicant requires a 3% impervious surface variance. ALTERNATIVES: 1. Approve the variances as requested, or with some modifications as per Planning Commission discussion. 2. Continue or table discussion for specific reasons. 3. Deny the variances finding lack of demonstrated hardship. RECOMMENDATION: The recommendation from staff is Alternative #1. Staff recommends approval of the variances as requested, rationale being that the four variance hardship standards have been met. Variance Hardship Standards: 1. Literal enforcement of the Ordinance would result in undue hardship with respect to the property. If current setback and lot size standards are applied to the subject site, it would be rendered unbuildable. Other similar size lots are developed and/or have been granted similar variances by the City of Prior Lake to build. Literal enforcement of the Ordinance would result in undue hardship with respect to the property. 2. Such unnecessary hardship results because of circumstances unique to the property. The subject site was platted in 1923, under another government jurisdiction. The previous platting standards of Eagle Creek Township are significantly different that current Zoning and Subdivision regulations for the City of Prior Lake. 3. The hardship is caused by provisions of the Ordinance and is not the result of actions of persons presently having an interest in the property. The application of current Prior Lake Zoning standards to this property, platted in 1923, would render the lot unbuildable. The hardship is caused by the application of current Zoning regulations to a substandard lot of record and is not the result of actions of the property owner. 4. The variance observes the spirit and intent of this Ordinance, produces substantial justice and is not contrary to the public interest. The proposed variances are reasonable under the circumstances. These variances observe the character of the area and are not detrimental to the general health, safety, and welfare of the community.
