Planning Commission to approve the following variances in order to construct a porch addition over an

Associate Planner Gina Mitchell presented the Staff report dated October 27, 1994. Staff feels the
variances requested are reasonable and support the aWlVval of the variances.
Comments from Commissioners included: ice build-up creating a safety hazard; slope of roof installation of
gutters; rationale for STH. 13 setback requirement; right-of-way width; and future plans for S.TH. 13
improvements and possible impacts to a future homeowner if variance is granted and ST.H. 13 is widened.

INTRODUCTION:
The Planning Department has received a variance application from Arnold Erp. The applicant is
requesting the Planning Commission to approve the following variances in order to construct a porch
addition over an existing cement patio.
1. 5' south front yard variance from the 25' front yard setback requirement.
2. 30' south front yard variance from the 50' State Highway 13 right-of-way setback requirement.
PREVIOUS PROPOSALS:
On October 1, 1987, the Planning Commission granted a 25' front yard variance from the 50' State
Highway 13 right-of-way setback requirement in order that a single family home could be built on the
site. Please see attached minutes for further reference.
PHYSIOGRAPHY :
The subject site contains approximately 27,000 square feet of lot area and has a frontage of 223' on State
Trunk Highway 13 (S.T.H.). The western half of the property is heavily wooded with the slope going
from south to north, exhibiting about 20' of relief (see attached topography map). The driveway access is
off of Green Oaks Trail, however the front of the home and the entrance face S.T.H. 13.
ADJACENT USES:
This single family neighborhood is part of Green Oaks Addition which was platted in 1969, within the
City of Savage. This area was annexed into the community in 1974.
PLANNING CONSIDERATIONS:
In 1987 the Planning Commission granted a 25' variance from S.T.H. 13 right-of-way. The applicant's
home was designed with a cement patio. The applicant proposes to enclose this patio with a porch which
would square off the building (the proposed porch would not extend beyond the existing home). The
Minnesota Department of Transportation did not provide comment to the City prior to this report being
written, however, they generally are only concerned with proposals that are in the right-of-way.
Several variances have been granted from S.T.H. 13 since 1984, when its setback was increased to 50'.
Staffs research found a variances approved ranging from 4' - 39'. The applicant's proposal seems
reasonable, however, the Planning Commission will need to decide whether the lack of a porch on the site
constitutes a hardship for granting the variances.

ALTERNATIVES:
1 . Approve the variances as requested, or with some modifications as per Planning Commission
discussion.
2. Continue or table discussion for specific reasons.
3. Deny the variances finding lack of demonstrated hardship.
RECOMMENDATION:
Staff feels that the variances requested are reasonable, and could support the approval of the variances as
requested. In the event that the Planning Commission decides to grant the variances, the following
rationale could be given to justify the four hardship standards.
Variance Hardship Standards:
1. Literal enforcement of the Ordinance would result in undue hardship with respect to the
property.
The proposed porch has been positioned in the only logical location for a porch. Locating the
porch in any other area on the site would require a redesign of the home.
2. Such unnecessary hardship results because of circumstances unique to the property.
The subject site is unique in that the lot is quite large, however, due to the topography of the site
the home had to be positioned close to the right-of-way causing a hardship for a future porch
addition. This property is also unique in that the lot has frontage on S.T.H. 13 and access off of
Green Oaks Trail. The proposed porch addition faces S.T.H. 13, and will not visually appear to
further encroach upon this roadway due to the location of the existing cement patio.
3. The hardship is caused by provisions of the Ordinance and is not the result of actions of
persons presently having an interest in the property.
The application of current Prior Lake Zoning standards to this property render the logical location
for a porch addition impossible without a variance. Several variances from S.T.H. 13 have been
granted that are more excessive than what the applicant is requesting.
4. The variance observes the spirit and intent of this Ordinance, produces substantial justice
and is not contrary to the public interest.
The proposed variances are reasonable under the circumstances. These variances observe the
character of the area and are not detrimental to the general health, safety, and welfare of the
community.

To consider a 25 foot front yard variance for 15230 Creen Oaks Trail to
construct a new hane.
Staff Analysis:
The subject site is an approximate 27,000 square foot single family residential
lot that has a frontage of 223 feet on S.T.H. 13. Together with S.T.H. l3's
negative influence, the lot is unusually shaped aoo has 20 feet of relief. To
minimize the effect of Highway 13 and construction costs, it will require a
sensitive approach to developnent.
In 1979 where this lot was created, the highway setback was 25 feet fran the
right-of-way line. In 1984, it was changed to 50 feet after recognizing the
conflict relationship between residential construction and arterials.
A third factor influencing the location of the hane is the grade separation
between the subject site and property to the north. This lot is deve1vt'CJ with
a single family hane with a setback of about 10 feet fran their c...,..,...... property
line. On the property line is a three foot retaining wall pres\Jl\ably built to
separate grades in order that a drainage swale may be constructed around the
hane.

The location of the proposed hane would jeopardize the retaining wall and
drainage pattern. Furthermore, little effort was taken in placing the hane on
the lot to minimize external negative influence.
Perhaps, the most dangerous situation is the proximity of. the retaining wall
(tie wall) to the driveway. The construction of the wall is poor and will
surely collapse under the additional pressure stemning fran the use of the
driveway. The driveway an:Jle at the garage could result in a precarious
position for anyone forgetting to turn when backing out of the garage.
Approximately the western half of the subject lot is heavily wooded with the
slope going fran south to north (see attached topo map). The slope and
Ol1erstory could be used as a positive element in design for this lot. 'Itte
awlicant will also find that it will prd:>ab1y reduce the variance.
