Driveway
RE:
The homeowner at 16176 Evanston Avenue made an inquiry as to the pavement of the
existing gravel driveway. A variance was granted in 1994 regarding the setback of the
garage from HWY 13. The site plans indicate a driveway that is setback 2 feet from the
property line to the south. Considering that the current ordinance requires driveways to
be setback 5' from the property line, the following determinations have been made. The
property owner can pave the gravel driveway as shown on the site plan in Variance
94-37 based on the following rationale:
. Gravel driveway exists, the property owner could have paved it years ago without
incident.
. The city requires and encourages all driveways to be paved for erosion and run-off
control.
. The property owner is not encroaching the setback any further than already exists.

INTRODUCTION:
The Planning Department received a variance application from Judson Brown of 16176 Evanston
Avenue. The subject site is legally described as Lot 1 and the North palt of Lot 2, Block 11, Plior
Lake Original Townsite. The applicant proposes to construct a detached garage on the west, rear
yard portion of the lot as proposed on the attached drawings. The specific valiance requested is:
1. An 11' west rear yard variance from the 50 foot, State Truck Highway 13 right of way
setback requirement.
BACKGROUND:
The plat of the Original Townsite of Prior Lake dates back to the 1890's. Information from the
Scott County Assessor's Office indicates that the existing house was built in 1900. S.T.H. 13 was
re-routed from Main Avenue to its CUlTent location in the late 1950' - early 1960's. Prior Lake
records indicate that a permit for a porch addition was granted in 1990 and re-roofing pelmit
granted in 1993. There is no gal'age located on the property. The proposal is to locate the
garage as indicated on the attached drawings. The garage will be setback 29' from the rear yard
property line and 39' from the S.T.H. 13 R-O- W line. The applicant requests the Planning
Commission to grant an 11' variance from the 50' setback requirement from the R-O~W line.
DISCUSSION:
The home was built in the center of the lot so that development options for a garage al'e limited
on site. The applicant proposes to construct a minimum size, double car, detached garage. The
rear Yal'd setback for the R-2 zone is 25' however, the Zoning Ordinance permits detached
structures to be located as close as 10' to the rear yard property line. Approximately 60 yeal's
after the construction of the home on the subject site, S.T.H. 13 was re-routed to its CUlTent
location. The 50' setback requirement was not adopted until 1983, when the CUlTent Zoning
Ordinance was adopted. The hal'dship in this case is not caused by the applicant but is the result
of MNDOT re-alignment of S.T.H. 13 and subsequent establishment of the 50' R-O-W setback
by the City of Prior Lake in 1983.
ALTERNATIVES:
1. Approve the 11' R -0- W variance as requested.
2. Table or Continue discussion of the item for specific purposes.
3. Deny the application citing lack of demonstrated hardship.

RECOMMENDATION:
Alternative #1.
Variance Hardship Standards:
1. Literal enforcement of the Ordinance would result in undue hardship with respect
to the property.
Application of the 50' setback standard in this case would result in a situation whereby
no garage could be built on site. The Planning Commission has considered lack of a
garage as a hardship in other variance applications.
2. Such unnecessary hardship results because of circumstances unique to the property.
S.TH. 13 was constructed over Blocks within Prior Lake Original Townsite that were
subdivided for single family purposes. There are several structures in the Downtown area
that are located at variance with the required R-O-W setback requirement. One home,
located within the same Block, is located on the R-O-W line. The garage will not appear
to the public as encroaching toward the highway due to the fact that the grade of the lot is
much lower than the road elevation of the highway and the location of existing structures
which are situated closer to the R-O-W than the proposed garage. In fact, the garage will
provide additional buffer between the noise, traffic and litter associated with the highway,
and the existing single family home.
3. The hardship is caused by provisions of the Ordinance and is not the result of
actions of persons presently having an interest in the property.
The property was subdivided and developed within the Corporate limits of Prior Lake.
Government actions related to the re-routing of S.TH. 13 from Main Avenue to the
current location and subsequent adoption of a R-O-W setback standard, created the
hardship. If it were not for the re-routing of S.TH. 13 and resulting setback requirement
established in 1983, the applicant would be able to build the garage without variance.
4. The variance observes the spirit and intent of this Ordinance, produces substantial
justice and is not contrary to the public interest.
Staff has consulted with the City Engineer related to future improvements anticipated for
S.TH. 13 in the vicinity of the subject site. Currently, MNDOT does not plan to upgrade
the road from a two lane facility. The City and County will approach MNDOT in the
near future to suggest that they plan for a four lane facility. The City Engineer reviewed
this site and determined that in the event that an additional lane is constructed on the
south side of S.TH. 13, there is currently sufficient R-O-W to accommodate such an
improvement. At a maximum, one could contemplate the addition of one lane and a trail
or bike path which could be built within 50 of the current paved section. The R-O- W
width from the paved street to the edge of R-O-W is 103'(+-) which is adequate to
accommodate a future roadway expansion. The City Engineer has no objection to the
granting of the 11' R -0- W variance.

You are hereby notified that the Prior Lake Planning Commission will hold a hearing in the City
Council Chambers located at City Hall, 4629 Dakota Street S.E. on: Thursday, November 3,
1994 at 7:00 p.m.

REQUEST:
The applicant proposes to construct a detached garage as proposed
on the attached drawings. The garage is proposed to be set back
29' from the north rear yard prope11y line and 39' from the right of
way line of State Trunk Highway 13. The Plior Lake Zoning
Ordinance requires structures to be set back 50' or more from the
State Trunk Highway 13 right of way. Mr. Brown is therefore
requesting the Planning Commission to grant an 11' variance in
order to construct the garage as proposed.
If you are interested in this issue, you should attend the hearing. The Planning Commission will
accept oral and/or written comments. Questions related to this hearing should be directed to the

p.m. Those present were Commissioners Roseth, Arnold, Loftus, Kuykendall and Vonhof, Assistant City
Planner Deb Garross and Secretary Connie Carlson.

The Planning Department received a variance application from Judson Brown of 16176 Evanston Avenue.
The subject site is legally described as Lot 1 and the North part of Lot 2, Block 11, Prior Lake Original
Townsite. The applicant proposes to COnstlUct a detached garage on the west, rear yard portion of the lot.
The specific variance requested is an 11' west rear yard variance from the 50 foot, S.T.H. 13 right-of-way
setback requirement.
Assistant Planner Deb Garross presented Staff report dated November 3, 1994. The home was built in the
center of the lot so that develupwent options for a garage are limited on site. The applicant proposes to
construct a minimum size, double car, detached garage. The rear yard setback for the R-2 zone is 25'
however, the Zoning Ordinance permits detached structures to be located as close as 10" to the rear yard
property line. The hardship in this case is not caused by the applicant but is the result of Minnesota
Department of Transportation re-aligning S.T.H. 13 and subsequently the establishment of the 50'
right-of-way setback by the City of Prior Lake in 1983. Recornrrendation by Staff is to applVve the
variance request as the applicant has met all hardship criteria of the zoning ordinance.
Cornrrents by Commissioners included: concern about encroachment toward S.T.H. 13 right-of-way; the
safety of walkway slab off house with ice and water buildup; possibility of an attached garage; aesthetics;
location of garage to north; and support of variance request.
Lori Brown of 16176 Evanston Avenue, stated there was a retaining wall next to their plVpC.lj and
practically and aesthetically a detached garage at the location p.vpvsed was the best alternative they could
fmd.

Commissioner Vonhof asked if one of the Commissioners would be willing to participate in the interview to
select the new Planning Director on Tuesday, November 15. The Commissioners will check their schedules
and get back to Commissioner Vonhof. Also, the Commissioners suggested a mock interviewlpresentation
in front of the Planning Commissioners at an evening meeting, possibly November 17; a video tape be
made of the candidates for Commissioner's review; and submit five interview questions ilulll the
Commissioners to Administration. The Commissioners would like to meet with the new Planning Director
and discuss the concerns of the Board.
There was a brief discussion on a preliminary wOIkshop for the Business Park Develupment on Mooday,
Novernrer 7,5:30 to 7:00. Notices will be sent out to all Commissioners.
