Therefore, due to this hardship, he is requesting that the stipulation on the type of boats to enter and dock in Boudins Manor Bay be changed to include power boats. This year the lCM water in the bay and channel have caused same proolems and pCMer boats help create movement of the water for sailboats to move. In the attached letter Mr. Young is requesting that stipulation number 4 be deleted. Such an action if approved would permit power boats to be moored at the marina which currently has slips for 25 boats. Mr. Young in his letter states that the soft market for sailboats and the low water level have caused a hardship in his effort to market the slips for sailboats only. (612) 447.4230 4629 DAKOTA STREET S.E. P.O. BOX 359 PRIOR LAKE, MINNESOTA 55372 The definition of marina is "A "'........ercial establishment adjacent to a navigable lake prOliding moorings for boats and offering other supplies and services accessory to the principal use". The key word in the definition is "and". It makes it mandatory to have additional services such as gas, bathroans, sales, service, etc. in addition to mooring boats. A marina is a permitted use in the C-l Conservation Zone which is the current zoning of Outlot A. In May of 1985 staff argued that Outlot A due to its low elevation would be costly to develop. However, boat dockage would be an acceptable alternative to a full scale marina. staff believes these factors hold true today. After the Planning Camnission camnitted to the use, the boat mix is really inconsequential. It is only a guess but power boats and sailboats are probably used equally as much. Boudin I s Bay is a snall shallow bay used primarily as access to the main lake. Both power and sail boats use the same channel to the main lake. The Planning Camnission in its decision in 1985 never established criteria or reasons for limiting the use to only sailboats because Mr. Young requested only sailboats. John Packer, President of Prior Lake Yacht Club, feels the facility is needed for tying up boats rather than anchoring them also there is no way to get to the north end of the lake under the bridge. S'mFF ANALYSIS: The applicant is the owner of Qltlot A and has applied to the City of Prior Lake for a permit to erect and subsequently lease 25 boat slips to the general public. Upon review of the application the permit was denied. The reason for denial is the prop:>sal is not consistent with the definition of marina. The definition reads as follows: "A cv......crcial establisl...&e...t adjacent to a navigable lake providing moorings for boats and offering other supplies and services accessory to the principal use". The key word in the definition is .and which requires, in staffs opinion, a full service marina. The property ~~1Smestion is zoned C-l COnservation which permits marinas. It is the only ~l~~ held C-l zone on Prior and Spring Lakes. MY permanent structural use for the site is Wllikely. The site is bisected by a drainage way and with the majority of the property at or below 904 elevation. Access to the site is over lots 1 and 2 of Watersedge 1st Addition. Recently crushed rock was added to the p:irking lot and sailboat display area (north of the survey line in Qltlot A). The applicant currently offices out of Watersedge Office Plaza adjacent to the north. Where accessory marina products and services are sold. the applicant feels that this should qualify him for a full service marina. staff does not agree. The marina use for Qltlot A Imlst be established independent rather than interdc~.dent on shared p:irking or short term lease agreements. It is highly Wllikely that a full service marina could be constructed on this site because of physiographical restrictions and economical restrictions. Lease boat docking is an appropriate use for such a lot of record. There is roore than adequate p:irking on the site. The proposal is divided within four areas. The first section deals with the actual description of the material specified within this proposal. The following sections breakdown the quantity of material into three sections: Tom Fosters, Jerry Young and Leonard. Pole Sections: With any Lake Front or Nautical Theme, Pole Sections blend well into the overall setting. Landscape Junctions Poles Sections are similar to what you would see Ore Docks Constructed out of, or Ship Pilings along Duluth Harbors, in Northern Minnesota. Therefore the application of Pole Sections really compliments both Waters Edge Office Plaza and Main Sail. The material we are suggesting is not only in excellent condition it is also very economical! Pole Sections or "Pile Cut-Offs" are just the material to fit that description. When a railroad decides to renew a Trestle, one of the first items to be replaced is the pressure treated poles. After the old poles are removed a new section is then situated in place to be driven into the ground. After the pole driver has driven the pole into the desired depth, railroad crews then cut off the excess material. (Usually I Western Red Cedar) This is exactly what we specified into our proposal. Brand new poles that are pressure treated to the highest specifications. Thus you are not only assured of a long lasting mat~rial, in addition to a aesthetically pleasing appearance. If you compare poles to more conventional materials, ie: Railroad Ties, Landscape Timbers, etc. you will find from a purely economical stand point poles are far more "Cost Effective" than other types of materials: The reason for the "Cost Efficiency" are for one, based on labor savings. If you compare one Pole Section verses 3 or 4 Page 2 Railroad Ties placed vertically with rope tied around them (This would be approximately the same size) it is by far faster to install one pole, than 3 to 4 Railroad Ties. I~ addition to faster installation time, poles have more flexibility in their placement. As in your application where the poles will gradually follow the bay, This can easily be accomplished. Finally even though the poles are "New" it is still could be considered used from the Railroad. Since our Company specializes in Railroad Salvage, we deal with aIlS major Railroads in the State of Minnesota. Therefor we have an ample supply of quality materials, at a very reasonable price. The actual size of the poles will be approximately 7' Long. Diameter will fluctuate between 9" to 16". As per Tom Fosters drawing the approximate overall length of the entire bay area to be outlined with poles is 472-475' feet. When the poles are placed at 15' intervals this calculated out to be approximately 32-35 7' poles. How this is divided up between the three property areas is as follows: Waters Edge Office Plaza: 90 Feet Divided by (Tom Foster) 15', Placement intervals = 6 Poles Main Sail Incorporated: (Jerry Young) 320 Feet Divided by 15', Placement intervals = 22 Poles (Does Not include any gate system or Entra'nce Area.) Waters Edge Town Homes: (Leonard) 62 Feet Divided by 15', Placement Intervals = 5 Poles Total: 7' Poles = 33 Poles Total Footage Covered: 472 Feet The cost per pole is $ 14.00 or $ 2.00 per foot. Dock Configuration: The dock will extend straight west into the bay (Outlot C) approximately 150'. It is designed for 25 slips. The construction will be such that they will be floating sections attached to a four foot main section also floating. Number of slips: There will be dockage for 25 boats. An area on the west end will be set aside for transient usage and one slip will be set aside for the sheriff should the county wish to use it. Use of the slips will be restricted to sailboats except to the extent the sheriff needs to use one of the slips. Young Dock permit application for Watersedge Marina Dear Mr. Graser: Jerry Young has come to us about his plan to establish a marina on Outlot A, Watersedge 1st Addition, which is zoned C-1. Although his primary interest is in sailboats, he originally submitted a dock permit application for a mix of approximately half powerboats and half sailboats, thinking that there might not be enough sailboat business to keep the dock occupied. We understand that you suggested he apply for a variance since, though marinas are permitted uses in C-1, it was your opinion his proposal did not provide accessory supplies and services sufficient to fit the definition of a marina in the zoning ordinance, nor could the property accommodate those services. Since the time the application was filed, enough sailboat owners have shown interest in sailboat mooring so that Mr. Young feels he can devote the entire dock area to sailboats, and has revised his dock permit application to reflect this change in the principal use. We believe this fits the proposed marina within the zoning ordinance because the accessory services for a powerboat marina would not be needed, and this should avoid the necessity for a variance. Mr. Young points out that sailboat marinas at White Bear Lake, for example, provide no services other than docking, and that his own marina would provide parking, trash disposal, and launching assistance. Additionally he can provide storage through a contract with the Scott County Fairgrounds. Restrooms are available during business hours in the Watersedge office building he leases on Lot 2, Waters edge 1st Addition, for his retail operation, but neither this nor the retail sales are essential accessories to a sailboat marina, in our opinion. Mr. Young presently has the benefit of an existing access easement across the East 25 feet of Lot 3, Block 1, Watersedge 1st Addition (see attached Common Driveway Easement Declaration) and he is in Mr. Horst Graser, City Planner Page 2 May 29, 1985 the process of acquiring and recording an additional 25 foot wide access easement along the Easterly line of Lot 2, Block 1, Watersedge 1st Addition, to provide more direct access for the marina customers. It is also worth noting that he owns Outlot C, Boudin's Manor 5th Addition, the plat for which was approved in 1977 when the lake level was nearly 900. He is also asking the county's permission to place 15 buoys on the lake within the boundary lines of that lot, as he has for the last several years. Please review the revised application and exhibits and call us or Mr. Young if further information or documents are needed.
