The selection of the firm is considered a "Professional Service" under the Uniform Municipal Contracting Law, This means that criteria other than, and in addition to cost, may be useA in selecting the desired fi.rm. The Uniform Municipal Contracting Law does not require a ~.F.~., however, staff felt that in the spirit of competition we should solicit proposals from at least three firms. On December 3, 1997 Request for Qualifications were sent to three metro area Park Planning and Design firms. The three firms were Ingraham & Voss, Barton Aschman Associates, and Brauer and Associates, Ltd.. These three firms specialize in Park planning and design. The due date for returning the proposals was January 5, 1998. Only one firm, Brauer and Associates, Ltd., submitted a proposal. At the January 12, 1998 Parks Advisory Committee meeting the 16200-1ilig~~k Ave, S.E., Prior Lake. Minnesota 55372-1714 / Ph. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTLNIW EMPLOYER Committee decided to recommend to the City Council that the City accept the proposal of Brauer and Associates, Ltd. and hire them as the firm to design and develop the Community Park! Athletic Complex and the redevelopment of Lakefront Park in accordance with the Master Plan. DISCUSSION: Brauer and Associates, Ltd. has been involved with the City of Prior Lake and the Parks Advisory Committee since 1995 as a park planning and design firm and have completed the following projects for the City: · Lakefront Park Master Plan · 2010 Parks and Trails Comprehensive Plan · Design of Pond's Park expansion area . Conceptual design of Youth Activity Center · Conceptual design of Deerfield Neighborhood Park . Development of R.F,P.'s and Selection of Playground equipment . Design and bidding of Pond's irrigation system . Conceptual design of new Community Park! Athletic Complex Brauer and Associates, Ltd. has done exceptional work for the City of Prior Lake. They present themselves well to the public, are very creative, produce a quality product in a timely fashion, and are very conscious of budget limitations. Staff and the P.A.c. are very comfortable working with Brauer and Associates, Ltd. and they continue to impress us with their knowledge of Park planning and design work. They also have a good understanding of our community and our future Park and Trail needs. Brauer and Associates, Ltd. has a good reputation in the industry and has done outstanding work in other communities. They bring with them a team of professionals who are well renowned for their accomplishments and abilities. I have included a list of their clients. Brauer and Associates, Ltd. devote 95% of their time to Park planning and design. Though there are many firms which claim they can do Park planning and design work there are few that have as much expertise or devote as much time to this field as Brauer and Associates, Ltd.. AGLKF ARC-DOC Brauer and Associates, Ltd. is very interested in working on these two projects. They did the Lakefront Master Plan and also the conceptual plan for the Community Park/Athletic Complex and would like to see these two projects come to fruition. We modeled our Community Park/Athletic Complex after a park that is being constructed in Inver Grove Heights to conserve costs and because the proposed park layout is consistent with our needs. Brauer is currently working on this project and we feel that with the knowledge they have gained on this project this will benefit us when we undertake this project. ISSUES: We called the other two firms which we had sent the R.F.Q.'s to find out why they hadn't submitted a proposal and also get an idea of the fees they would have charged. We received the following response: INGRAHAM & VOSS, Greg Ingraham . Weare very busy at this time. . We were aware that Brauer had done the Lakefront Master Plan and it is common practice to select the firm that did the Master Plan to carry out the design and construction. . Brauer is an excellent firm. . Our fees for design and engineering are about 7%. . Bloomington just did a $1,150,000 project at Bush Lake and the fee was $110,000 or 10%. . Brauer's proposal of 6.7% is a good deal for Prior Lake. BARTON ASCHMAN ASSOCIATES, Scott Midness . We didn't get selected to do the Lakefront Master Plan and didn't want to do all of the work involved in submitting a proposal if we thought we would come out in second place. . You will be happy with Brauer. They do nice work. . Knowing that Brauer has done a lot of work in Prior Lake it is sometimes professional courtesy not to step on their turf. . I've never seen them come in high (dollar wise) on a project. . I'd like to know how they do it? . Our fees on design, bidding, and construction are usually around 8%. AGLKFARC.DOC FISCAL IMPACT: AL TERNA TIVES: RECOMMENDATION: ACTION REQUIRED: REVIEWED BY: ATTACHMENTS: AGLKFARC.DOC There are sufficient funds included within the referendum budget for professional services for these two projects. When we did our original project estimates we estimated between 8-10% for professional services on these projects The fee which Brauer and Associates would charge is a total of $221,500.00 for the two projects. With a budget total of $3,300,00.00 this would be a fee of 6.7%. Staff has talked to Brauer. concerning the direct project expenses which they mentioned on page 9 of their submittal. This is a typical expense commonly referred to as reimbursable. Staff suggested that this amount be kept to a minimum and Brauer agreed that reimbursables will not exceed $l ,500.00. Attached is a copy of the Request for Qualifications which outlines the work that will be involved with these two projects The alternatives are as follows: l. Accept the recommendation of the Parks Advisory Committee and approve Resolution 98-XX which authorizes the City to enter into a contract with Brauer and Associates, Ltd.. 2. Deny this item for a specific reason. 3. Table this item for a specific reason. Staff recommends Alternative No. l. The contract will provide that if for any reason the City is unable to acquire a site for the Community Park! Athletic Complex, that this element will be eliminated from the contract to avoid a breach of contract. Motion and second to approve Resolution 98-XX which authorizes the City to enter into a contract with Brauer and Associates, Ltd. to provide land planning, architectural, and engineering services to construct a new Community Park! Athletic complex and redevelop Lakefront Park, according to the aster plan at a fee not to exceed $221,500.0 whic i cludes $1,500.00 for reimbursables. GENERAL GUIDELINES. The City of Prior Lake, Minnesota is seeking a Consultant(s) to aid the City in the recreation planning and design development of two recreational facilities. The Consultant(s) will provide planning, design, specification preparation, bidding and construction observation, and other post-design services for all elements within the parks. It is the intention of the City to select a recreation planning and design firm(s) Consultant(s) based upon the firms' experience, personnel, understanding of recreation planning and design, reputation and client references and response to this Request for Qualifications (RFQ). II. PROJECT DESCRIPTION. A. Lakefront Park. Lakefront Park, a 126 acre park located immediately north of downtown Prior Lake, will combine athletic field development, picnic facilities, playgrounds, amphitheater, paths, roadways and parking lots, irrigation system, beach front improvements, restoration of native vegetation, and construction of related buildings. A master plan for this development was completed in 1996. A copy of the plan graphic for Lakefront Park is attached to this RFQ. B. New Community Park/Athletic Complex, A new community park and athletic complex will be developed on a parcel of land, approximately 80 acres in size. Facilities include baseball, softball and soccer fields, roadways, parking lots, picnic facilities, irrigation system, septic system, well, field lighting and related buildings. A copy of the plan graphic is attached to this RFQ. 'I III. SCOPE OF SERVICES REQUESTED. A. Lakefront Park. 1. Project Focus Meeting a) Determine the extent and accuracy of existing information available about the site. b) Determine the engineering data required and define methods to obtain the needed information. c) Prepare a project design and construction schedule. d) Determine the agency approvals likely to be required for the project and the amount of time each will take to acquire. e) Prepare a project budget and development priority breakdown based upon the Master Plan estimates of construction cost. 2. Preparation of Existing Conditions Base Plan a) Prepare a request for proposal for survey work to supplement existing conditions, and topographic mapping work as required for design and construction control of the improvement project. The survey work will supplement topographic mapping which has already been completed. b) Prepare a request for proposal for pre-construction soil testing deemed prudent for design of the project. c) Prepare a request for proposal for wetland delineation, as required for construction of the project. d) Receive bids for survey work, wetland delineation and soil testing work and make recommendation to the City and award contract for each. e) Prepare a project base map from information supplied by the City and others illustrating existing conditions for use throughout the design process. 3. Preparation of Schematic Design. a) Prepare a layout drawing illustrating modifications to the Master Plan which may be necessary based on existing site conditions and budget. ----- -- , ~ it.. b) Prepare detailed report on environmental conditions and additional existing site condition information gathered during this phase of the design. c) Prepare additional graphics as required which fully illustrate any recommended modifications to the Master Plan. d) Attend review meeting with staff to present any proposed modifications to the Master Plan. e) Revise the Master Plan in accordance to the staff direction. 4. Preparation of Final Documents for Bidding and Construction a) Prepare Design Development Documents which include the preparation of written text, plans and other drawings necessary to describe the design, critical sizes and proportions of elements, materials, colors, textures in sufficient detail for the City to grasp the appearance and function of the site improvements. b) A preliminary engineers estimate of the costs of these improvements shall be prepared from these documents. From this estimate the City shall determine which of the improvements shall be included in the Construction Documents, the final phase of design. 5, Preparation of Construction Documents. a) Construction Documents shall include plans and other drawings as well as, specifications in sufficient detail for the City to pursue competitive bids for the construction of the site improvements. A final engineer's estimate of the work shall be prepared for the City's use in comparing the competitive bids received from contractors. 6. Bidding or Negotiation Process. a) Aid during the bidding or negotiation process shall include answering bidder questions, issuing addenda or other forms of clarification during the bidding process, organizing and attending contractor pre-bid meeting, attending the bid opening and aiding the City in the final selection of a contractor. At the City's discretion, the Consultant shall also be available to attend the City Council meetings where staff seeks authorization to bid and where staff recommends the award of the construction contract. 7. Construction Observation Services. 'I. a) Consultant shall attend weekly site meetings with the contractor and the City to review construction progress. Additional site visits to review contractor progress shall be made as conditions require. These additional site visits shall average one per week throughout the construction period. b) Consultant will provide City and contractor with weekly construction progress reports following each site visit by the Consultant. These reports shall indicate progress made in the construction since the last visit and shall describe verbal directions given by the Consultant, deficiencies in construction, etc. c) Consultant will process contractor payment requests and prepare change orders. d) Consultant will attend substantial completion and final inspections and will develop punch lists as required. e) Consultant will organize and participate in a one-year contractor guarantee inspection and will guarantee a guarantee punch list. A description of firm's past experience in design and construction of recreation projects of similar size, use and complexity to the projects proposed in this request. 3. Resumes for the professional and technical personnel to be assigned to these projects. Indicate the person who would manage the project and the percentage of the manager's time that will be devoted to the project. 4. A statement of your firm's understanding of issues and opportunities unique to the design and implementation of park and recreation projects. 5. A list of past clients and the names and phone numbers of client contact persons. 6. GENERAL GUIDELINES. The City of Prior Lake, Minnesota is seeking a Consultant(s) to aid the City in the recreation planning and design development of two recreational facilities. The Consultant(s) will provide planning, design, specification preparation, bidding and construction observation, and other post-design services for all elements within the parks. It is the intention of the City to select a recreation planning and design firm(s) Consultant(s) based upon the firms' experience, personnel, understanding of recreation planning and design, reputation and client references and response to this Request for Qualifications (RFQ). II. PROJECT DESCRIPTION. A. Lakefront Park. Lakefront Park, a 126 acre park located immediately north of downtown Prior Lake, will combine athletic field development, picnic facilities, playgrounds, amphitheater, paths, roadways and parking lots, irrigation system, beach front improvements, restoration of native vegetation, and construction of related buildings. A master plan for this development was completed in 1996. A copy of the plan graphic for Lakefront Park is attached to this RFQ. B. New Community Park/Athletic Comulex A new community park and athletic complex will be developed on a parcel of land, approximately 80 acres in size. Facilities include baseball, softball and soccer fields, roadways, parking lots, picnic facilities, irrigation system, septic system, well, field lighting and related buildings. Project Focus Meeting a) Determine the extent and accuracy of existing information available about the site. b) Determine the engineering data required and define methods to obtain the needed information. c) Prepare a project design and construction schedule. d) Determine the agency approvals likely to be required for the project and the amount of time each will take to acquire. e) Prepare a project budget and development priority breakdown based upon the Master Plan estimates of construction cost. 2. Preparation of Existing Conditions Base Plan a) Prepare a request for proposal for survey work to supplement existing conditions, and topographic mapping work as required for design and construction control of the improvement project. The survey work will supplement topographic mapping which has already been completed. b) Prepare a request for proposal for pre-construction soil testing deemed prudent for design of the project. c) Prepare a request for proposal for wetland delineation, as required for construction of the project. d) Receive bids for survey work, wetland delineation and soil testing work and make recommendation to the City and award contract for each. e) Prepare a project base map from information supplied by the City and others illustrating existing conditions for use throughout the design process. 3. Preparation of Schematic Design. a) Prepare a layout drawing illustrating modifications to the Master Plan which may be necessary based on existing site conditions and budget. b) Prepare detailed report on environmental conditions and additional existing site condition information gathered during this phase of the design. c) Prepare additional graphics as required which fully illustrate any recommended modifications to the Master Plan. d) Attend review meeting with staff to present any proposed modifications to the Master Plan. e) Revise the Master Plan in accordance to the staff direction. 4. Preparation of Final Documents for Bidding and Construction a) Prepare Design Development Documents which include the preparation of written text, plans and other drawings necessary to describe the design, critical sizes and proportions of elements, materials, colors, textures in sufficient detail for the City to grasp the appearance and function of the site improvements. b) A preliminary engineers estimate of the costs of these improvements shall be prepared from these documents. From this estimate the City shall determine which of the improvements shall be included in the Construction Documents, the final phase of design. 5. Preparation of Construction Documents. a) Construction Documents shall include plans and other drawings as well as, specifications in sufficient detail for the City to pursue competitive bids for the construction of the site improvements. A final engineer's estimate of the work shall be prepared for the City's use in comparing the competitive bids received from contractors. 6. Bidding or Negotiation Process. a) Aid during the bidding or negOtlatIOn process shall include answering bidder questions, issuing addenda or other forms of clarification during the bidding process, organizing and attending contractor pre-bid meeting, attending the bid opening and aiding the City in the final selection of a contractor. At the City's discretion, the Consultant shall also be available to attend the City Council meetings where staff seeks authorization to bid and where staff recommends the award of the construction contract. 7. Construction Observation Services. 'I a) Consultant shall attend weekly site meetings with the contractor and the City to review construction progress. Additional site visits to review contractor progress shall be made as conditions require. These additional site visits shall average one per week throughout the construction period. b) Consultant will provide City and contractor with weekly construction progress reports following each site visit by the Consultant. These reports shall indicate progress made in the construction since the last visit and shall describe verbal directions given by the Consultant, deficiencies in construction, etc. c) Consultant will process contractor payment requests and prepare change orders. d) Consultant will attend substantial completion and final inspections and will develop punch lists as required. e) Consultant will organize and participate in a one-year contractor guarantee inspection and will guarantee a guarantee punch list. B. SO-Acre Community ParkJ Athletic Complex, 1. A statement of your firm's understanding of issues and opportunities unique to the design and implementation of park and recreation projects. 5.
