INTRODUCTION:
The purpose of this agenda report is to receive City Council
approval through resolution to apply for a Department of
Natural Resources Natural and Scenic Area Grant. The
resolution is one of the requirements of the grant application.
BACKGROUND:
The Natural and Scenic Area Grant which the City would be
applying for is an effort to seek financial assistance to
acquire and preserve the 15.75 acres of land which is
currently owned by John and Meda Kop. (The grant
application criteria require that this project be identified).
At the City Council worksession which was held on January
12th staff informed the Council of their intentions to apply
for grant assistance and the Council reacted favorably. At
this same worksession the City Council advised staff, that if
we cannot come to a mutual agreement for the purchase of
this property that we should back out of the deal and
condemn the portion of the property that is needed for the
roadway. If this is the case we would then retract our grant
application and ask that the D.N.R. assist us with the
acquisition of property which would be needed for a
roadway.
As part of the grant application it is necessary to conduct a
public hearing. The public hearing was conducted by the
Parks Advisory Committee at 6:30 p.m. on March 9, 1998 at
the Maintenance Center. One resident attended the public
hearing and supported the idea of the city acquiring the farm
property. The resident also stated that he was in favor of the

the Maintenance Center. One resident attended the public
hearing and supported the idea of the city acquiring the farm
property. The resident also stated that he was in favor of the
proposed park access road and the idea of the city preserving
and maintaining the farm property.
If this grant is approved the D.N.R. would provide the City
with funds to help purchase the Kop Farm.

RESOLUTION AUTHORIZING THE CITY OF PRIOR LAKE TO APPLY FOR
A DEPARTMENT NATURAL RESOURCES NATURAL AND SCENIC AREA
GRANT

WHEREAS, The City of Prior Lake will act as the legal sponsor for the project
contained in the Natural and Scenic Area Grant Program Application to
be submitted on March 31, 1998 and that the City Manager is hereby
authorized to apply to the Department of Natural Resources for funding
of this project on behalf of the City of Prior Lake, and,
WHEREAS, The City of Prior Lake has the legal authority to apply for financial
assistance, and the institutional, managerial, and financial capability to
ensure adequate construction, operation, maintenance and replacement
of the proposed project for its design life, and,
WHEREAS, The City of Prior Lake has not incurred any costs, has not entered into
any written agreements to develop the property, and,
WHEREAS, The City of Prior Lake has not violated any Federal, State, or Local
laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of
interest or other unlawful or corrupt practice, and,
WHEREAS, Upon approval of its application by the state, the City of Prior Lake
may enter into an agreement with the State of Minnesota for the above
referenced project, and that the City of Prior Lake certifies that it will
comply with all applicable laws and regulations as stated in the contract
agreement and described in the Compliance's section of the Natural and
Scenic Area Grant Program Application.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR
LAKE, MINNESOTA, that the City Manager is hereby authorized to execute such
agreements as are necessary to implement the project on behalf of the applicant.
