INTRODUCTION:
The purpose of this Agenda item is to consider approval of
Ordinance 98-XX to amend City Code Section 9-4-15 restricting
lawn and garden sprinkling to even/odd days and imposing a
watering ban. We have had discussions with the Minnesota
Department of Natural Resources (DNR) regarding the water
appropriation permit for proposed Well #6. At this time they are.
not convinced that a new well is required immediately based on
the fact that our peak demand is a function of lawn sprinkling.
The DNR would like us to consider the following items to reduce
peak demand: 1) An odd/even/partial day sprinkling ban; 2) Re-
visit our rate structure to provide that those that use more water
during the sprinkling season pay more; 3) Emphasize public
education; 4) Get a better handle on unaccounted water use, Le.,
meter city water usage, account for hydrant flushing, street
sweeping, irrigation uses, etc. This agenda item is step 1 of this
effort.
BACKGROUND:
The current City Code provides for restricted hours of sprinkling
as follows:
RESTRICTED HOURS FOR SPRINKLING: Whenever the City
Council shall determine that a shortage of water supply
threatens the City, it may, by resolution, limit the times and
hours during which water may be used from the City water
supply system for lawn and garden sprinkling, irrigation, car
washing, air conditioning and other uses specified therein, a
copy of said resolution shall thereupon be mailed or
otherwise delivered to each water customer. Two (2) days
after the mailing or delivery of such resolution, any water
customer or other person who shall cause or permit water to
be used in violation of said resolution shall, in addition to
being subject to prosecution for a misdemeanor, be charged
five dollars ($5.00) for each day of such violation, which
charge shall be added to his next water bill. Continued
violation is hereby prohibited and shall be cause for
discontinuance of water service.

RECOMMENDATION:
On June 16, 1997, the City Council adopted Resolution 97-50
restricting outdoor water uses to an odd/even system. The staff
report and resolution are attached. At that time, staff was directed
to update the ordinance to current city needs.
The dry weather which occurred in June of 1997 produced a high
demand for municipal water. The water tower alarms indicating
low levels of water in the towers, went off June 5th and June 7th.
On Monday, June 9, 1997, the City pumped 3.9 million gallons of
water. This is a City record. All three wells were operating to
meet this demand for water. The maximum amount of water the
wells can produce in ideal conditions is 4.3 million gallons per day.
Odd/even lawn watering ordinances can help reduce peak
demands on a water system, but may also increase water usage
by encouraging customers to water more often than needed.
Watering once or twice per week should be adequate for most
types of soils. In addition, lawn watering before 10:00 a.m. and.
after 6:00 p.m. can improve lawn watering efficiencies by reducing
water lost to evaporation and wind drift. The proposed ordinance
amendment includes both odd-even restrictions and a partial day
ban.
The City is currently in the process of trying to obtain permission
from the Minnesota Department of Natural Resources (DNR) to
drill a new well (Well #6). The DNR has indicated that demand
reduction measures must be implemented (M. S. 103G.291)
before requesting approvals for new wells or increases in water
volumes.
Based on 1997 usage, the City could again approach an
emergency water shortage if the ordinance is not revised to meet
current City needs. DNR approval for Well #6 is also contingent
on demand reduction measures. The advantage of adopting the
ordinance now is: 1) the time it gives the staff to publicize the
new regulations and 2) the ordinance is automatic from year to
year increasing the likelihood of voluntary compliance.
The alternatives are as follows:
1. Approve Ordinance 98-XX.
2. Table this item for a specific reason.
3. Deny Ordinance 98-XX at this time.

ORDINANCE NO. 98-XX
AN ORDINANCE AMENDING SECTION 9-4-15 OF THE PRIOR LAKE CITY
CODE
The City Council of the City of Prior Lake does hereby ordain:
Section 9-4-15 of the Prior Lake City Code is hereby amended to read as follows:
ODD-EVEN SPRINKLING BAN: Lawn or garden sprinkling, irrigation, car washing and
other non-essential outdoor use of the Municipal Water System shall be restricted to an odd/even
system in conjunction with an 11:00 a.m. to 5:00 p.m. ban effective May 1 through September 1.
Residents with an odd house number may water lawns or use an outside hose, when necessary,
before 11 :00 a.m. and after 5:00 p.m. only on odd numbered calendar days. Residents with an
even house number may water lawns or use an outside hose, when necessary, before 11 :00 a.m.
and after 5:00 p.m. only on even numbered calendar days. This applies to all municipal water
users. Exceptions shall be made for landscaping, including newly seeded or sodded lawns,
within the first thirty (30) days of placement. Private wells used for irrigation shall be exempt
from these restrictions. Municipal water customers who have been notified of a violation of
these restrictions, and who violate them a second time, shall be fined $25.00 for each day of
violation. the fine shall be added to the offender's next water bill. A third violation shall be
cause for discontinuance of water service. After payment of all outstanding bills, fines and
connection fee (as stated in city fee schedule), the water service shall be restored.
This ordinance shall become effective from and after its passage and publication.

INTRODUCTION:
The purpose of this Agenda item is to consider adoption of
Resolution 97 -XX authorizing the City Council to restrict lawn and
garden sprinkling to even/odd days. As a separate matter, the
Council should discuss changes which might be desirable to the
existing City code.
BACKGROUND:
The following is the Section of the current City Code that
discusses restricted hours for sprinkling:

ISSUES:
I. TYPE OF WATER RESTRICTIONS
The purpose of water restrictions is to "restructure" water
usage to reduce the peak daily usage. One option is odd/even
restriction which is the most common tool used. This method is
used by numerous communities in the metropolitan area and
has been proven effective in communities such as Eagan in
reducing peak water use. The resolution includes an exception
for new sod and landscaping installed within sixty days prior to
the resolution or any sod laid thereafter and authorizes the City
Manager to initiate additional restrictions if necessary.
The implementation of the sprinkling restrictions would limit
residents with odd numbered house numbers to watering and
use of an outside hose only on odd numbered calendar days.
Residents with even numbered addresses could water lawns or
use an outside hose only on even numbered calendar days.
The sprinkling restrictions would apply only to usage drawn.
from the Municipal Water Supply system. The sprinkling
restrictions would apply to lawn and garden irrigation, car
washing and other non-essential outdoor water usage.
For the above reasons, the staff recommends odd/even
restrictions. A survey is attached which shows the practices
other cities have adopted.
II. ORDINANCE REVISIONS
The City is currently in the process of obtaining permission
from the Minnesota Department of Natural Resources (DNR) to
drill a new well (Well #6). The DNR has indicated that demand
reduction measures must be implemented (M.S. 103G.291)
before requesting approvals for new wells or increases in water
volumes. The City's Water Emergency and Conservation Plan
must be approved and action taken on implementation before
work on Well #6 can begin. Part of the implementation plan
includes evaluating water conservation ordinances such as
odd/even sprinkling bans, partial sprinkling bans and limited
sprinkling hours.
The current ordinance revisions date back to when the City had
significantly fewer water customers. A number of ordinance
revisions may be in order:
1. Annual Resolution - Because of the unpredictability of
weather, the problem can be over before the resolution is
adopted. We nearly had that problem this year. The
ordinance could be written to keep restrictions in effect
year round. A second option is to authorize the City

Manager to enact sprinkling restrictions without further
Council action. A third option is to write the ordinance so
the restrictions are automatically invoked every year. The
bottom line is that the effectiveness of the restrictions
depend upon voluntary compliance. Whatever regulations
are adopted must be easy for the public to understand and
remember.
2. publication - In an effort to notify the water users the city
must mail the Council approved resolution to each of our
4,500 users. Keeping the restriction in effect year round
would allow us to remind the public on a year around
rather than one time basis, which is likely to be more
effective.
3. Penaltv - The penalty should be revised to a misdemeanor
consistent '-"lith other aspects of the code \^Jith the
requirement that each day is a new violation.
The alternatives are as follows:
1. Approve the Resolution 97 -XX and provide direction on
future ordinance revisions.
2. Table this item for a specific reason.
3. Deny Resolution 97 -XX at this time.
Alternative NO.1. Resolution 97 -XX will impose water restrictions
in accordance with present ordinance requirements effective
Saturday, June 21st at the latest following publicity in the form of:
Post cards to all water users, cable television and Prior Lake
American. Enforcement will rely primarily upon reminders,
warnings and penalties as a last resort. The staff then needs
direction regarding what changes, if any, should be made to
update the ordinance to current city needs.

WHEREAS,
the City Council has determined that a shortage of water supply is threatening
the City's water supply system due to the high demand of water used for
sprinkling lawns and gardens and other outdoor uses as a result of weather
conditions; and
WHEREAS,
Prior Lake City Code title 9, Chapter 4, Section 15 provides a means by
which water usage regulations may be implemented.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, '.
MNNESOT A, that:
1. Lawn or garden sprinkling and other non-essential outdoor use of the
Municipal Water System shall be restricted to an odd/even system.
Residents with an odd house number may water lawns or use an
outside hose, when necessary, only on odd numbered calendar days.
Residents with an even house number may water lawns or use an
outside hose, when necessary, only on even numbered calendar days.
2. Such restrictions shall take effect immediately upon notification
pursuant to Prior Lake City Code.
3. The City Manager is hereby authorized to Impose additional
restrictions, if necessary.
4. Any new sod and landscaping installed within the past 60 days and any
laid in the future from the date of this Resolution shall not be affected
by this ban.
5. The staff is directed to prepare a flyer for delivery to all water users
through the postal service and other means as appropriate advising
them of this Resolution and where a copy can be secured, the specific
restrictions, the effective date, and the penalties for noncompliance.
