AND APPROPRIATING FUNDS THEREFORE.

HISTORY
When the Rainbow Foods site was proposed for'
development in the City of Savage the developer requested
a traffic signal installation at County 42 and Timothy Avenue.
The residential neighborhoods in this area were strongly
opposed to a traffic signal at County 42 and Timothy
because they felt there was already too much traffic using
Timothy Avenue as a cut through and a signal would only
make it worse. Ultimately, the traffic study recommended
that the signal be installed at Rutgers Street and County 42
and not at Timothy. As one part of the process the
neighborhood petitioned the City Council to close Timothy
Avenue off from Commerce. The Council, in Resolution 98-
23 (attached), approved such action concurrent with the
improvement and installation of the traffic signal at Rutgers
Street and County 42.
CURRENT CIRCUMSTANCES
The traffic signal at Rutgers Street and County 42 is
scheduled to be completed by mid-October. The
neighborhood residents are anxious to have Timothy
Avenue closed, but are not agreeable to a temporary closure
such as concrete barriers or other methods. The
neighborhood has proposed a design concept (copy
enclosed) which involves: a) removal of the existing
bituminous street between Commerce Avenue and the first
two driveways south on Timothy Avenue; b) installation of
concrete curb and gutter along Commerce; c) guardrail

along Commerce; d) construction of an approximately two
foot berm; e) drainage provisions from Commerce to
Timothy; and f) 3-4 six foot evergreen trees. The current
residents at 14056 Natalie and 14061 Timothy have
indicated their willingness to maintain that piece of Timothy
Avenue from Natalie to their driveways.
ISSUES
The homeowners at 14040 Commerce Avenue (corner of
County Road 42 and Commerce), Mr. & Mrs. Michael Cox,
are opposed to the closure of Timothy Avenue as they have
expressed they have rights to lake access and by closing
the street their home is devalued. I personally met with
these homeowners on September 15th and discussed this
issue with them. I encouraged them to be present at the
Council meeting. They feel the best solution for them is for
the City to construct a frontage road between Commerce .
Avenue and Rutgers Street and purchase their home. They
are willing sellers.
The removal of only a portion of the street between Natalie
Road and Commerce Avenue is necessitated due to the two
homes that access Timothy Avenue between these two
streets. Leaving a portion of the street in place brings up the
question of maintenance responsibility and liability. While
the current homeowners are willing to take over the
maintenance of the remaining section this could lead to
problems with future owners. It would be staffs
recommendation that the entire segment of Timothy Avenue
right-of-way between Natalie Road and Commerce Avenue
be vacated and a drainage and utility easement be kept.
This will eliminate any possible future confusion as to
ownership of the street.
The residents have requested the installation of guardrail
along the outside curve on Commerce to prevent vehicles
that are travelling too fast from ending up in the yard of
14061 Timothy Avenue. The maintenance staff has
concerns about this installation as they do not currently
maintain guardrail anywhere in the City. It would also be a
problem for clearing snow. The barrier curb that will be
installed should provide some level of protection and the
situation can be monitored in the future to determine if it is

cost effective to install guardrail. Guardrail is therefore not
recommended for installation at this time. .
As was discussed during the discussion of the siting of the
traffic signal, a project to close Timothy Avenue is
unbudgeted. Therefore, the City Council will need to
approve a funding source for this project.
The residents of the area are anxious to get approval on this
design and to have it implemented yet this fall. They are not
agreeable to a temporary closure to be followed next year by
a more permanent closure.
Area residents have been invited to attend the Council
meeting to address these issues should they desire.
CONCLUSION
This project was approved by the City Council in Resolution
98-23. The residents of the area have requested a specific
design be implemented for the closure of Timothy Avenue.
The cost for this design is outlined in the Fiscal Impact
section of this report. The staff recommends approval of the
requested design with the exception of guardrail. The City
Council will need to determine if the requested design is a
cost effective use of funds.

Funding for this project is proposed to be taken from the
unencumbered construction fund balance which is
approximately $202,800 as of September 11, 1998.

A RESOLUTION APPROVING THE TIMOTHY AVENUE CLOSURE DESIGN AND
APPROPRIATING FUNDS THEREFORE.
Motion:

WHEREAS; residents on Timothy Avenue have petitioned the City Council of Prior
Lake to close Timothy Avenue, and
WHEREAS; the City Council of Prior Lake through Resolution 98-XX approved closing
Timothy Avenue concurrent with the improvement and installation of the
traffic signal at Rutgers Street and County Road 42, and
WHEREAS; the traffic signal at Rutgers Street and County Road 42 is expected to be
completed by the middle of October, 1998.
NOW THERFORE BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that
Timothy Avenue between Commerce Avenue and Natalie Road shall be closed by
removal of the street and construction of improvements as detailed in the attached
design, less the requested guardrail.
BE IT FURTHER RESOLVED, that funding for closing Timothy Avenue and the
associated improvements shall be from the unencumbered construction fund balance.

A RESOLUTION CONCURRING WITH SCOTT COUNTY'S REQUEST TO PROVIDE
A FULL ACCESS INTERSECTION AND INSTALLATION OF A TRAFFIC SIGNAL AT
THE INTERSECTION OF CSAH 42 AND RUTGERS STREET; CLOSING TIMOTHY
AVENUE AT COMMERCE AVENUE; RECOMMENDING NO CHANGE TO CSAH 42
AND TIMOTHY AVENUE INTERSECTION; AND DIRECTING STAFF TO INITIATE
STEPS TO ACCOMPLISH LONG TERM IMPROVEMENTS.

WHEREAS, the City of Savage has received a development proposal that requested a.,
traffic signal at the intersection of Timothy Avenue and CSAH 42, and
WHEREAS, the traffic study concluded a traffic signal at the intersection of Timothy
Avenue and CSAH 42 was not feasible considering projected traffic
volumes, and
WHEREAS, the traffic study concluded that the Rutgers Street and CSAH 42
intersection is the appropriate location for a traffic signal, and
WHEREAS, a traffic signal at the Rutgers Street and CSAH 42 intersection is
consistent with Scott County access spacing guidelines and with the
current efforts of the CSAH 42 Corridor Study, and
WHEREAS, the City Council has held a Public Information Meeting to solicit public
input on this issue.
NOW, THEREFORE, BE IT R.ESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, the City of Prior Lake hereby concurs with the installation of a traffic
signal at CSAH 42 and Rutgers Street to provide full access to CSAH 42 from the
residential areas south of CSAH 42 in the City of Prior Lake and to proposed
development north of CSAH 42 in the City of Savage and that the costs of such
improvements be borne by the developer, the City of Savage, and/or Scott County.
BE IT FURTHER RESOLVED, that the City shall. close Timothy Avenue at Commerce
Avenue concurrent with the improvement and installation of signal lights at the
intersection of Rutgers ,and CSAH 42, and

BE IT FURTHER RESOLVED, that improvements to the TH 13, Commerce Avenue
and Boudin Street area to a common signalized full access intersection with the intent
that it be programmed in the Capital Improvement Program for completion as soon as
feasible, and
BE IT FURTHER RESOLVED, that staff is directed to prepare a report for the City
Council to include a frontage road from Commerce Avenue to Rutgers Street in the
Capital Improvement Program and report back to the City Council, and

Harbor to Rutgers and report the findings to the City Council, and
BE IT FURTHER RESOLVED, that the City of Prior Lake desires to leave the existing
Timothy Avenue/Commerce Avenue/CSAH 42 intersection "as is" as of the date of this
resolution subject to continuing discussions with the County, and
BE IT FURTHER RESOLVED, that the Timothy Avenue/CSAH 42 intersection be

renamed Commerce/CSAH 42 upon completion of its separation from Timothy Avenue.
