Historv On January 21, 1997, voters in the City of Prior Lake approved a $7.8 million Park and Library Bond Referendum. Two of the projects within the referendum were Lakefront Park and development of a Community Park Athletic Complex. The Lakefront Park project included the acquisition of property adjacent to the park presently owned by John and Meda Kop. The Athletic Field Complex project required the acquisition of a 70-100 acre property for development. Current Circumstances Since the referendum, the staffhas contacted the owners of20 candidate properties throughout Prior Lake to acquire for development of the Community Park Athletic Complex. Our efforts to acquire suitable property have been unsuccessful. We have identified a 94+/- acre tract owned by the Menden family which is well suited locationally and geographically to our needs. Despite numerous contacts with the property owners we have been unable to reach an agreement for land acquisition. A considerable amount of discussion has taken place between the Kops, family representatives and the City. The acquisition of this property is a key step in relocating the access to the Lakefront Park road as set forth in the Lakefront Park Master Plan previously adopted by the Council. Issues The staff recognizes that the City Council would prefer to acquire property without resorting to condemnation. The staff believes we have exhausted every other option to acquire these parcels and the only 162(}o.<BaQ1N~'ek<1NRP$ffiC~~'Ocmn372-1714 / Ph. Conclusion The City is obligated by passage of the referendum to complete these voter approved projects. The only way to acquire the properties needed to complete the projects appears to be condemnation. ALTERNATIVES: The Council has the following alternatives: 1. Adopt Resolution 98-XX and Resolution 98-XX authorizing condemnation of the two properties recognizing that the staff will continue to try to negotiate the purchase of each. 2. Defer action on the resolutions. RECOMMENDED MOTION: Alternative 1. Adopt both resolutions. Once the resolutions are adopted and filed, the staffwill request a special meeting with the City Council to further discuss the issues associated with these park project acquisitions. That the City Attorney is authorized to commence eminent domain proceedings pursuant to Minnesota Stature Chapter 117 to acquire the property described on the attached Exhibit "A II , 2. That the Mayor and the City Manager are authorized to execute all documents necessary, in the opinion of the City Attorney, to effect the acquisition of the necessary property interests.
