HomeMy WebLinkAbout5E - Northwood Oaks Estates CITY COUNCIL AGENDA REPORT MEETING DATE: AGENDA #: PREPARED BY: REVIEWED BY: AGENDA ITEM: DISCUSSION: AUGUST 3, 1998 5E JANE KANSIER, PLANNING COORDINATOR DON RYE, PLANNING DIRECTOR CONSIDER APPROVAL OF RESOLUTION 98-XX EXTENDING THE DEADLINE FOR SUBl\nTTAL OF A FINAL PLAT FOR NORTHWOOD OAKS ESTATES Historv: On August 18, 1997, the City Council adopted Resolution 97-66 approving the preliminary plat to be known as Northwood Oaks Estates. This preliminary plat consists of 34.15 acres to be subdivided into 46 lots for single family dwellings. The property is located on the west side of North wood Road, south of Arctic Lake and east of Spring Lake Regional Park. On July 17, 1998, the Planning staff received the attached letter from Kurt Larson, developer of this project, requesting a six month extension for the approval of this final plat. Mr. Larson notes the additional time is required in order to purchase the property and submit the necessary documents for final plat approval. Current Circumstances: Section 6-3-4 (A) of the Subdivision Ordinance states that a final plat must be submitted within 12 months of the preliminary plat approval by the City. This section also states "the Council may extend this period for good cause for up to but not exceeding twelve (12) months, upon written application by the developer". In this case, the preliminary plat expires on August 18, 1998. The developer has requested this deadline be extended until February 18, 1999. Without the extension, the preliminary plat becomes null and void. Any development must begin at the preliminary plat stage. Issues: The purpose of the deadline for submittal of a final plat is to ensure that ordinances and conditions are relatively similar to those in place at the time of preliminary plat approval. In this case, the City is in the process of reviewing a new zoning ordinance. While this extension may extend beyond the effective date of a new ordinance, the ordinance in its current form would not have any effect on the lot size or configuration of this site. Finally, the physical conditions of this site have not changed since preliminary plat approval. Conclusion: Extension of the approval of the preliminary plat will not adversely affect the platting process. Bud!!et ImDact: There is no budget impact as a result of this action. Any development of this site will generate development fees and taxes. The City Council has three alternatives: 1. Adopt Resolution 98-XX approving the extension as requested. 2. Deny Resolution 98-XX. 3. Defer this item and provide staffwith specific direction. ';;:; L~, 1:\97files\97 subdiv\preplat\northoak\extend.doc Page 2 RESOLUTION 98-XX RESOLUTION APPROVING T.I:lli EXTENSION OF THE APPLICATION DEADLINE FOR SUBMITTAL OF FINAL PLAT FOR THE PRELIMINARY PLAT TO BE KNOWN AS NORltl WOOD OAKS ESTATES MOTION BY: SECOND BY: WHEREAS: the Prior Lake City Council adopted Resolution #97-66 on August 18, 1997, approving the preliminary plat for N orthwood Oaks Estates; and WHEREAS: Section 6-3-4 (A) of the City Code requires an application for a Final Plat shall be filed within twelve months of Preliminary Plat approval, in this case by August 18, 1998; and WHEREAS: the Developer has submitted a request to extend the application deadline to February 18, 1999; and WHEREAS: the City Council finds the extension of this deadline is not inconsistent with the intent of the provisions of Section 6-3-4 (A). NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that it hereby approves the extension of the application deadline for a Final Plat for the preliminary plat to be known as Northwood Oaks Estates until February 18, 1999. The preliminary plat was approved August 18, 1997. Since that time the property has gone through a foreclosure process and updating and clearing of the title. This halted any effort to be able to finalize the plat and ownership issues for this parcel. ) I have recently contracted with the current fee owners, Richfield Bank and Trust, to acquire the property. The plat expires August 18, 1998. With the amount of processing and logistics that are required for acquisition and for the City of Prior Lake, there is not enough time to complete and get approval of the final plat. I am therefore requesting a six month extension to the approval of the preliminary plat for Northwood Oaks Estates. I appreciate the consideration for this request and would be available for any questions or additional information that may be needed.
