HomeMy WebLinkAbout10A - Spring Lake Township Sewer & Water AGENDA #; PREPARED BY: SUBJECT: ItJA CITY ATTORNEY MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE METROPOLITAN COUNCIL REGARDING THE CITY PROVIDING SEWER AND WATER SERVICE TO CERTAIN AREAS OF SPRING LAKE TOWNSHIP DATE: JULY 29, 1998 INTRODUCTION: The City of Prior Lake and Spring Lake Township hav~ entered into an agreemenl peftaining to the City extending sewer and. water to certain areas abutting Spring Lake. The Metropolitan Council regulatt:s the availability of sewer and water connections within the City. In order to pre.serve the future availability of sewer and water connections within the City, the Chy entered into discussions with the Metropolitan Council. The City and Metropo1iLan Council have reached a tentalive agreement set forth in a Memorandum of Understanding which is before the City Council [or its approval. BACKGROUND: On May 18th, 1998 the City Council authorized execution of an agreemenl between the City and Spring Lake Township pertaining to the City extending sewer and water to certain areas abutting Spring Lake. The agreement was conditioned in part upon the following factors involving the Metropolitan Council and the City: 1. The extension of sewer and water will not have the effect of' removing any land area from, or modifying the location of any land area within the current MUSA boundaries within Prior Lake. 3. The Metropolitan Council will hill tile Township directly for all SAC eharges. 4. The provision. of sewer service to the South Sore Drive Area will not have any effect 011 the capacity to provide wastewaLer treatment service to the MUSA within Prior Lake. DISCUSSION: In the absence of an agreement to the contrary, the Spring Lake Township sewer and water extension could reduce or offset lhe MUSA area designated for the City of Prior Lake. Additionally, the. City could be initially responsible for all SAC charges. ISSUES: The Council should authorize the Mayor and City Manager to sign the Memorandum of Understanding to preserve the sewer and wastewater MUSA availability within the City, and to insure that the Township pays fOT all SAC charges direcLly. ALTERNATIVES: The COLlIlCil hAS the following options: 1. Aurhorize the Mayor and City Manager to sign the memorandum of Understanding with the Metropolitan Council. RECOMMENDATION: Alternative:l . BACKGROUND 1. The City of Prior Lake ("Prior Lake") and Spring Lake Township ("Spring Lake") are located adjacent to each other in Scott County. Prior Lake owns and operates a local trunk sewer system which receives metropolitan sewer service from the Metropolitan Council (the "Council") . 2. An area of Spring Lake referred to in this document as the South Shore Drive Area has a number of failing residential septic systems in residences adjacent to Spring Lake. These systems are contributing to environmental degradation of Spring Lake and upper and lower Prior Lake. For the purposes of this Memorandum of Understanding the "South Shore Drive Area" is that area shown on Exhibit A attached hereto and made <4>art hereof. .- 3. The South Shore Drive Area is currently not located within the Metropolitan Urban Service Area ("MUSA") and is, therefore, not currently eligible for metropolitan sewer service from the Council. However, the Council's Water Resources Management Plan provides for extension of metropolitan sewer service to the rural areas in certain exceptional cases where four criteria are met and when approved by the Council through amendment of the comprehensive sewer plan of the local governmental unit in which the problem exists. 4. In order to alleviate the environmental problems in the South Shore Drive Area, Spring Lake is desirous of obtaining metropolitan sewer service in that area from the Council by way of a connection into the Prior Lake local trunk sewer system. 5. In order to alleviate the environmental problems in the South Shore Drive Area, Prior Lake is willing to enter into an agreement with Spring Lake to provide metropolitan sewer service by way of a connection through its local trunk sewer system under certain terms and conditions in such an agreement and upon certain other understandings. Based on the above background, the following are the understanding of the Council and Prior Lake regarding this matter: 1. In accordance with current law and Council policies and procedures, metropolitan sewer service will not be provided to the South Shore Drive Area unless and until a comprehensive sewer plan amendment which meets the requirements of Paragraph 2 below of this Memorandum of Understanding is submitted to, and approved by the Council. 2. The Council understands that the agreement between Prior Lake and Spring Lake for metropolita."1 ::;e',T/er ser..ice fo: t.~e Sc~t.~ Sho:-e D:-ive Area by a cor.:lect:.on into the Prior Lake local trunk sewer system is for the sole purpose of alleviating the environmental problems referred to in Background, Paragraph 2 of this Memorandum of Understanding and will limit such service to an area outlined and shown on the attached map as the South Shore Drive Area and the remainder of Granger's Crest and to residences located within that area as outlined and shown on the attached map. The agreement will also provide that the residential connections into the metropolitan sewer system through the Prior Lake local trunk sewer system will be limited to a maximum of 80 connections within the area outlined and. shown on the attached map as the South Shore Drive Area and the remainder of Granger's Crest. 3. Under current Council policy and procedures, the provision of metropolitan sewer service to the South Shore Drive Area as an exception for environmental reasons does not result in an extension of the MUSA boundary into Spring Lake and such action will not be considered to place such land within the MUSA. 4. The provision of metropolitan sewer service to the South Shore Drive Area is an exception for environmental reasons and will not have the effect of removing any land area from, or modifying the location of any land area within, the current MUSA boundaries within Prior Lake. 5. The provision of metropolitan sewer service to the South Shore Drive Area through the Prior Lake local trunk sewer system and at the capacity described above is expected to have no effect on the capacity to provide wastewater treatment service to the MUSA within Prior Lake. 6. The Council will bill Spring.Lake directly for SAC charges rather-than having such billing be done through Prior Lake. 7. Nothing in this document is intended to modify or limit the exercise of, any statutory authority or obligations of the Councilor Prior Lake.
