HomeMy WebLinkAbout8B - Waterfrom Passage Addition MEETING DATE: AGENDA #: PREPARED BY: REVIEWED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT OCTOBER 19, 1998 8B d( JENNI TOVAR, PLANNER-.J)c DON RYE, PLANNING DIRECTOR PUBLIC HEARING TO CONSIDER APPROVAL OF RESOLUTION 98-XX APPROVING THE VACATION OF A DRAINAGE AND UTILITY EASEMENT LOCATED IN LOTS 1 AND 2, BLOCK 1, WATERFRONT PASSAGE ADDITION Historv: This petition is part of a land transaction between the EDA and Gary Horkey, d.b.a Keyland Homes. Mr. Horkey is in the process of purchasing an additional half acre of land from the city to be' combined with his existing parcel, thereby creating a 2.14 acre parcel. The administrative subdivision was approved in August. This vacation will remove an existing utility and drainage easement located between the existing lot and the lot to be combined. The combined lot with the vacation will accommodate a future addition to the Keyland Homes building. Drainage and utility easements will be granted on the newly created lot lines as part ofthe land transaction. The Planning Commission reviewed this vacation request on September 28, 1998. The Planning Commission adopted Resolution 98-028PC recommending approval of the proposed vacation. The granting of the additional easements, on the property being purchased, was a condition of the administrative subdivision. Current Circumstances: There are no utilities located in the easement to be vacated. Since additional easements will be granted, which will encompass the entire parcel after the land transaction is completed, there is no need for the City to have a claim to this easement. The vacation of the easement will make the proposed future addition to Keyland Homes' property easier to accomplish when the time comes. The Issues: State Statute 412.851 allows the Council to vacate easements or right-of-way by resolution. The statute states that "no such vacation shall be made unless it appears to be in the public interest to do so". The existing drainage and utility easement is used for primarily for drainage. Conclusion: The proposed vacation is consistent with the Comprehensive Plan and is in the public interest. On this basis, the staff recommends approval of the vacation ofthe drainage and utility easement. Bud~et ImDact: There is no budget impact with the approval of this request. Vacating the easement will facilitate the construction of an addition to the existing building which will add to the City's tax base. The City Council has three alternatives: 1. Adopt Resolution 98-XX approving the vacation as requested. 2. Deny Resolution 98-XX. 3. Defer this item and provide staffwith specific direction. Conduct the public hearing. If no new information is offered, make a motion and second to approve Resolution 98-XX approving the vacation of a portion ofthe drainage and utility easement located in Lots 1 and 2, Block 2, Waterfront Passage Addition. Frank Boy anager Page 2 RESOLUTION 98-XX RESOLUTION PROVIDING FOR T.I::1E V ACA TION OF A PORTION OF DRAINAGE AND UTILITY EASEMENTS LOCATED ON LOTS 1 AND 2, BLOCK 2, WATERFRONT PASSAGE ADDITION BY: SECOND BY: WHEREAS, a petition for the vacation of drainage and utility easements has been duly presented to the City of Prior Lake, signed by the owners of the property abutting the following described easement situated in the City of Prior Lake, Scott County, Minnesota to wit: LEGAL DESCRIPTION: A 40.00 foot easement for drainage and utility purposes lying over, under and across part of Lots I and 2, Block 2, as delineated and dedicated on Waterfront Passage Addition, according to the recorded plat thereof, Scott County, Minnesota. The center line of said easement is described as follows: Commencing at the Southeast comer of said Lot 2; thence on an assumed bearing of North 00 degrees 10 minutes 44 seconds East, along the East line of said Lot 2, a distance of 20.00 feet to the point of beginning of said center line; thence continuing North 00 degrees 10 minutes 44 seconds East, along said East line, a distance of 188.00 feet and there terminating; and WHEREAS, notice of the hearing on said petition has been duly published and posted in accordance with the applicable Minnesota Statutes, and WHEREAS, a Public Hearing was held on said petition on Monday, October 19, 1998, at 7:30 p.m. in the Council Chambers at the Prior Lake Fire Station #1; and WHEREAS, the City Council then proceeded to hear all persons interested in said petition and persons interested afforded the opportunity to present their views and objections to the granting of said petition; and WHEREAS, the City Council of Prior Lake has determined that the vacation of said drainage and utility easement would be in the public interest. NOW THEREFORE, BE IT RESOLVED BY T.I::1E CITY COUNCIL OF PRIOR LAKE, that pursuant to Minnesota Statues 412.851, the above described drainage and utility easement situated in the City of Prior Lake, Scott County, Minnesota is hereby vacated. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PRIOR LAKE, recommends to the City Council that the previously dedicated drainage and utility easements legally described and shown on attached Exhibit A, be vacated.
