CONSIDER APPROVAL OF REQUEST TO EXTEND THE
DEADLINE FOR SUBMITTAL OF A FINAL PUD PLAN FOR
THE EAGLE CREEK VILLAS ASSISTED LIVING FACILITY
PROJECT IN THE PRIORVIEW PUD
Historv: On September 2, 1997, the Council approved Resolution 97-
78, approving the Preliminary PUD plan for the Eagle Creek Villas '
Assisted Living Facility in the Priorview PUD with several conditions.
Section 5-5-12 (D,7) of the City Code requires an application for a
Final PUD plan to be filed within 120 days of approval of the
Preliminary PUD, or by January 2, 1998.
On October 10, 1997, the Planning staff received a letter from the
developers requesting an extension of this deadline to April or May of
1998. The developers indicated that it would take longer to obtain
their financing for this project and they would prefer not to start
construction in the winter months. The Council considered this
request on November 3, 1997, and ultimately adopted Resolution 97-
98, extending the deadline to May 31, 1998.
On May 31, 1998, the developer submitted an application for Final
PUD Plan approval. The application was complete; however, several
changes are required. The staff has continued to work with the
developer to submit the necessary plans, but have not received the
revised plans at this time.
On September 22, 1998, the developer submitted another request for
an extension of the deadline. They have requested an additional 120
days to submit the final PUD plans, or until April 5, 1999. They are
submitting this request rather than submitting revised plans for review
by the Council at this time. The developers hope to have a buyer for
the project prior to the expiration ofthe extended deadline.
Current Circumstances: The developers have done some grading and
site preparation for this project, and have installed storm sewer and a

The staff recommends Alternative #1.
A motion and second denying Resolution 98-XX, and directing staff to
prepare a resolution denying this request for consideration on the next
Consent Agenda.

Dear Jane,
We are requesting a 120 day extension on the p, U. D. for the Assisted Living Facility due to the
fact that our original buyer has backed out of the project. We are currently in negotiations with
two new buyers and would ask for this extension while we continue to work out the terms of a
deal with one of the potential buyers. A significant amount of time and money has been put
towards this P.U.D. from both ends, and we feel it would be in the best interest of all parties
involved to grant this extension.
