HomeMy WebLinkAbout10C - Hilsbury Townhomes PP CITY COUNCIL AGENDA REPORT MEETING DATE: AGENDA #: PREPARED BY: REVIEWED BY: AGENDA ITEM: DISCUSSION: OCTOBER 5, 1998 10C JANE KANSIER, PLANNING COORDINATOR DON RYE, PLANNING DIRECTOR CONSIDER APPROVAL OF RESOLUTION 98-XX APPROVING THE PRELIMINARY PLAT FOR "HILLSBURY TOWNHOMES" Historv: Eagle Creek Villas, LLC, has applied for approval of a Preliminary Plat to be known as Hillsbury Townhomes. The property is located on the east side of Franklin Trail (CR 39) and in the south side of 1 60th Street (CSAH 44). The property is the former site of the . Apple Valley Ready Mix plant. A 4-unit townhouse is presently under construction on this site. The site was graded in May, 1998, under an approved building permit when the existing buildings were demolished and construction of the new buildings began. The City Code allows one new building on an unplatted parcel. In order to obtain a building permit for an additional building, the developer must plat the property. On September 14, 1998, the Planning Commission considered this preliminary plat application. The Planning Commission recommended approval of the preliminary plat subject to the condition that, prior to final plat approval, the developer must submit a landscaping plan as required by Section 6-7-1 ofthe Subdivision Ordinance. A draft copy of the Planning Commission meeting minutes is attached to this report for your information. Current Circumstances: The preliminary plat consists of 0.76 acres to be subdivided into 1 lot for townhouse development. The proposed lot meets the minimum lot area and frontage requirements for the R-3 district. The total density ofthis site is presently 5.2 units per acre. The developer is proposing to build an additional 4-unit building which will bring the total density to 10.5 units per acre. The R-3 district permits a density of 14 units per acre. Access to this lot is from Franklin Trail. There is no public right-of- way or parkland dedicated in this plat. These services are located in the road right- . of-way. The developer has already extended service lines to serve the new units. Since no utility improvements are required, no fees will be collected. However, a park land dedication fee and a collector street fee will be collected for the final plat. The Issues: The only outstanding issue in this preliminary plat is the landscaping plan. The developer has submitted a landscaping plan which meets the provisions ofthe Subdivision Ordinance. Conclusion: The Planning Commission concluded the preliminary plat is consistent with the Subdivision and Zoning Ordinance requirements. The Planning Commission recommended approval of the preliminary plat, subject to the following condition: 1. Prior to final plat approval, the developer must submit a landscaping plan as required by Section 6-7-1 of the Subdivision Ordinance. This condition has been satisfied by the developer. Bud!!et ImDact: Approval ofthe preliminary plat will allow the developer to proceed to the final plat, which will in turn allow the construction of at least three new townhouse units. The new units will contribute to the City's tax base. The City Council has three alternatives: 1. Adopt Resolution #98- XX, approving the preliminary plat of Hillsbury Townhomes with the finding that the preliminary plat is consistent with the intent and purpose of the Comprehensive Plan and the Zoning and Subdivision Ordinances. 2. Deny the preliminary plat on the basis it is inconsistent with the purpose and intent ofthe Zoning and Subdivision Ordinances and/or the Comprehensive Plan. In this case, the Council should direct the staff to prepare a resolution with findings of fact for the denial of these requests. 3. Defer consideration of this item for specific reasons. (' 1 -1-- r---- Frank Boy ty l1anager I I: \9 8files\9 8subdi v\prep lat\hills bur\hillscc.doc Page 2 ....,..-......- &~ ~N~~ RESOLUTION 98-XX RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE PRELIMINARY PLAT OF "IDLLSBURY TOWNHOMES" MOTION BY: SECOND BY: WHEREAS: the Prior Lake Planning Commission conducted a public hearing on September 14, 1998, to consider an application from Eagle Creek Villas, LLC, for the preliminary plat of Hillsbury Townhomes; and WHEREAS: notice of the public hearing on said preliminary plat has been duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and WHEREAS: all persons interested in this issue were afforded the opportunity to present their views and objections related to the preliminary plat of Hillsbury Townhomes for the record at the Planning Commission hearing; and WHEREAS: the Planning Commission and City Council have reviewed the preliminary plat according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said preliminary plat to be consistent with the provisions of said ordinances; and WHEREAS the Prior Lake City Council considered an application for preliminary plat approval of Hillsbury Townhomes on October 5, 1998; and WHEREAS: the City Council finds the preliminary plat of Hillsbury Townhomes to be consistent with the 2010 Comprehensive Plan. NOW, THEREFORE, BE IT HEREBY RESOLVED BY 1.l1.E CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, that it hereby approves the preliminary plat of Hillsbury Townhomes.
