STATUS OF CATES STREET CHANNEL STABILIZATION
PROJECT 98-11.
DISCUSSION:
HISTORY
This project was tabled at the October 19, 1998 City Council
meeting until further information could be obtained about the
right-of-entry agreements.
CURRENT CIRCUMSTANCES
There are six property owners that will be affected by the
Cates Street channel project. Five of the right-of-entry
agreements have been signed by the property owners. The
sixth property owner, John Messenbrink, refuses to sign the
agreement.
ISSUES
The stabilization project is approximately 800 feet in length,
of which 400 feet is on Messenbrink's property.
CONCLUSION
This project should be delayed until the property owner(s)
agree to sign the right-of-entry agreement, or the property is
developed and an easement is given to the City over the
channel.
ALTERNATIVES:
There are two alternatives for the City Council to consider:
1. Table this item indefinitely.
2. Table this item and provide staff with further direction.
