CONSIDER APPROVAL OF RESOLUTION 98-XX DENYING
THE FINAL PUD PLAN AND FINAL PLAT FOR CREEKSIDE
ESTATES, ALSO KNOWN AS THE EAGLE CREEK
ASSISTED LIVING FACILITY (Case File #98-088)
Historv: On September 2, 1997, the Council approved Resolution 97-
78, approving the Preliminary PUD plan and the preliminary plat for'
the Eagle Creek Villas Assisted Living Facility in the Priorview PUD
with several conditions. Section 5-5-12 (D,7) of the City Code
requires an application for a Final PUD plan to be filed within 120
days of approval of the Preliminary PUD, or by January 2, 1998. The
City Council extended this deadline to May 31, 1998, and the
developer submitted an application for a Final PUD Plan and Final
Plat on that date. These applications were complete; however, several
changes are required.
On October 5, 1998, the City Council denied the developer's request
for a further extension of the deadline. Following that denial, the staff
notified the developer that revised plans must be submitted. The
developer also had the option of formally withdrawing these
applications. To date, the staff has not received revised plans, or a
letter withdrawing the application.
Current Circumstances: The plans submitted by the developer are not
consistent with the conditions of approval of the preliminary PUD
Plan. In addition, the plans submitted for the final plat are not
consistent with the conditions of approval of the preliminary plat, or
the requirements for a final plat.
The Issues: State Statute requires that a City take action on a
development application within 60 days of receipt of a complete
application. The City also has the option of extending the deadline for
an additional 60 days. In this case, the deadline for City action is
November 27, 1998. Since the developer has not formally withdrawn

these applications, the City Council must take some action Failure to
act on this application means the plans will be automatically approved.
Conclusion: The plans submitted do not meet the requirements for a
Final PUD Plan and a Final Plat. The staff therefore recommends
these applications be denied.
Budf!et ImDact: There is no budget impact involved in this request.
The City Council has one alternative:
1. Adopt Resolution 98-XX as part of the Consent Agenda denying
the Final PUD Plan and Final Plat for Creekside Estates.
The staff recommends Alternative #1.
A motion and second approving Resolution 98-XX as part ofthe

RESOLUTION OF TtlE PRIOR LAKE CITY COUNCIL TO DENY THE FINAL PUD
PLAN AND FINAL PLAT OF "CREEKSIDE ESTATES"
MOTION BY: SECOND BY:
WHEREAS: the City Council held a hearing on and approved the preliminary PUD Plan to be
known as Creekside Estates, subject to conditions identified by Resolution 97-78, on
September 2, 1997; and
WHEREAS: the City Council held a hearing on and approved the preliminary plat to be known as
Creekside Estates, subject to conditions identified by Resolution 97-79, on
September 2, 1997; and
WHEREAS: the City Council has found that the developer has failed to submit plans for the Final
PUD and the final plat of "Creekside Estates" which are in compliance with the
approved preliminary PUD and preliminary plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF TtlE
CITY OF PRIOR LAKE, MINNESOTA, that it hereby denies the final PUD Plans and final
plat of "Creekside Estates" since the developer has failed to submit plans for the Final PUD and
the final plat which are in compliance with the approved preliminary PUD and preliminary plat.
Passed and adopted this 16th day of November, 1998.
