Prior Lake, Minnesota 55372 CITY COUNCIL AGENDA REPORT DECEMBER 4, 2006 9C JANE KANSIER, PLANNING DIRECTOR AL FRIEDGES, PARKS SUPERVISOR CONSIDER APPROVAL OF: (1) A RESOLUTION APPROVING AN AGREEMENT FOR THE REMOVAL AND RELOCATION OF A BARN; AND (2) A RESOLUTION AUTHORIZING STAFF TO SOLICIT QUOTES FOR THE CREATION OF A RUIN AND THE REMOVAL AND RELOCATION OF A BARN TO HERITAGE FARM Introduction The purpose of this agenda report is to authorize staff to take the first steps toward the development of the Heritage Farmstead. These include: 1. Approval of an agreement with Jeffery and Alissa Schneider for the removal and relocation of the existing barn on their property to Heritage Farmstead Park; 2. Authorization for staff to solicit quotes for this work, and for the work needed to create the "ruin" from the existing farmhouse, and to construct a foundation and walls for the barn. Historv On September 5.2006, the City Council adopted Resolution 06-166 approving the Master Plan for Heritage Farmstead. Elements of this plan include the preservation of a ruin of the existing farm house, placement and restoration of a barn on the site for community events, historic farm equipment, an orchard and community gardens, a skating rink and warming house, and a series of paths. Current Circumstances 1. Barn Aareement. To facilitate the Master Plan, the staff has located a barn for the site. The barn is located on the Jeffery and Alissa Schneider property at 16381 Marschall Road, and is in the City of Prior Lake. This barn is a 1940's era barn in good condition, measuring over 2,500 square feet in area. There is a loft in the barn which will be ideal for displaying some of the vintage farm equipment. The Schneider's are excited about locating their barn on the Heritage Farmstead site. They have asked for some considerations, as outlined in the attached agreement. These include: . Removal of the barn no later than December 31, 2007. . Restoration of the barn site, including removal of the block foundation, addition of black dirt and grass seed. . A $12,000 credit towards any parkland dedication required as part of the www.cityofpriorlake.com Phone 952.440.9675 / Fax 952.440.9678 ISSUES: mes\OCi future development of this parcel. This credit is applicable as long as an application for a final plat is submitted within 8 years of the date of the agreement. While we obviously would have preferred an outright donation, the staff feels this arrangement is beneficial to both the Schneiders and the City. Restoration of the barn site would have been done for any party. The cash credit may impact the capital park fund in the future. However, staff believes this impact will be very small. The Schneider property can only accommodate 6-7 lots, and at the current rate of parkland dedication rate of $3,750 per unit, the City will still collect $10,000 to $14,000 in parkland dedication. That per unit amount will probably increase over the next years, so the longer it takes for this site to develop, the less the impact to the park fund. There is already a neighborhood park in that area (Stemmer Ridge), so there is no need for a land dedication. At the very least, staff believes this is a "break even" deal. 2. Quote Solicitation. The first phase of this project, as contemplated in the 2007 Capital Improvement Program (CIP), includes moving the barn, constructing a foundation and walls for the barn, reproofing the barn, and selective deconstruction of the house to create a ruin. The staff estimates the cost of each of these elements as follows: Relocate barn Structural Engineering and soil borings Construct foundation and walls New barn roof Deconstruction of house (by staff) Debris disposal, etc. Brick stabilization Miscellaneous equipment rental $40,000 $10,000 $40,000 $5,500 $0 $5,000 $3,000 $1.500 TOTAL ~19_~..P00 Each element of the project will be let separately, and we expect each element to be less than $50,000. For this reason, it is possible to obtain quotes rather than bids. The staff expects to receive at least 3 competitive quotes for the foundation and wall work and 2 competitive quotes for moving the barn. If the quotes exceed the estimates, the staff will look for other options in completing this work. The Heritage Farmstead Master Plan, prepared by HKGI, anticipated completion of the project in three phases. Due to funding constraints, staff recommends the project be completed in six phases. Only Phase 1 is included in the 2007 CIP. Phases 2 through 6 would need to be incorporated into future capital improvement programs or budgets. Phase 1: Move the barn to the Heritage Farmstead site, set it on the proposed foundation and walls, and reroof the barn. This will preserve the barn and ready it for future use. Phase 2: Complete the remaining amenities to the house (arbor structure, accent lighting, and other enhancements). Phase 3: Complete prairie and wetland restoration, trails and boardwalks, entry improvements and the warming house. Grants from the Minnesota Department of Natural Resources may be available for the restoration work. Phase 4: Construct main parking lot (9 stalls) and the orchard parking lot (58 stalls). Phase 5: Complete the event lawn area and landscaping, install lighting and park furniture, the windmill, signage, fencing and security systems. Phase 6: Complete the interior of the barn for event use, including exterior restoration, extension of utilities, mechanical systems, bathrooms, and kitchen facilities. Phasing the project as suggested will allow more of the construction project to be completed by staff, rather than an outside contractor. This timing also allows the City to solicit private donations and to research other funding options. The $12,000 credit towards parkland dedication may impact the capital parks fund in the future. However, this is not a specific outlay, but rather a reduction in the amount of cash collected as part of the development. The staff has also received tentative commitments of $80,000 to $100,000 from private sources. Prior to requesting City Council authorization for this work, the staff will have finalized the amount of the private donations. The City Council has the following alternatives: 1. Adopt a resolution approving the agreement for removal of the barn, and adopt a resolution authorizing the staff to solicit quotes for the work. 2. Deny the resolutions. 3. Defer this item and provide staff with specific direction. Staff recommends Alternative #1. The following motions are required: 1. A motion and second to adopt a resolution approving Agreement for Removal of Sarn on Property Located at 16381 Marschall Road and authorizing the Mayor and City Manager to sign the agreement. 2. Schneider, husband and wife ("Owners"). (1) WHEREAS, the City 2030 Vision and Strategic Plan provides that the City encourage appreciation of our community's history and small town values; and (2) WHEREAS, the City has purchased a I5-acre parcel next to Lakefront Park which has been a historic farmstead within the City; and (3) WHEREAS, in an effort to preserve the farm house building, the City Council previously authorized the preservation of a ruin of the structure for public use; and (4) WHEREAS, a master plan for the 15-acre parcel has been prepared which proposes additional improvements to the property, including the placement and restoration of a bam on the site to be used for community events (hereinafter referred to as "Heritage Farm park"); and 1:\06 files\06 subject\schneider bam\barn agreement.doc 1027/06 Page 1 (5) WHEREAS, on September 5,2006, the City Council adopted Resolution 06-166 app~oving .the master plan for Heritage Farmstead. (6) WHEREAS, the Owners desire to donate a bam currently located on their property at 16381 Marshall Road, Shakopee, Minnesota, 55379 ("Owner's Property"). (7) WHEREAS, the City Council adopted Resolution #06-_ on December 4,2006, accepting the donation of the bam. Based on the mutual promises and covenants set forth herein, the sufficiency of which is not disputed, the City and the Owners (collectively "Parties") agree as follows: 1. RECITALS. The recitals set forth above are incorporated as if fully set forth herein. 2. DONATION OF BARN. The Owners have agreed to donate to the City a bam located on their property at 16381 Marschall Road, Shakopee, Minnesota, 55379, and legally described as follows: The North 365.80 feet of the South 831.24 feet of the West 1190.81 feet of the South half of the Northeast Quarter (S 'li ofNE~) of Section 5, Township 114, Range 22, Scott County Minnesota. The bam will be relocated from the Owner's Property to the Heritage Farmstead Park. 3. lUGHT OF ENTRY. The Owners hereby grant the City and its agents a right of entry onto Owner's Property for the purposes of removing the bam and any residual work required as part of this removal. This right of entry shall be effective until December 4, 2007. 4. CITY OBLIGATIONS. The City has the following obligations: A. The City shall restore the area where the bam currently sits, and any area disturbed by the removal of the bam. This work includes removal of the block foundation and concrete floor, the addition of black dirt to fill in the area where the block foundation and concrete law were removed, and the placement of grass seed in the area the bam was removed from. B. The City agrees to provide a credit of $12,000.00 towards any parkland dedication required as part of the future development of the Owners Property. The credit shall remain effective only if a final plat for the Owners Property is submitted within eight (8) years of the date of this Agreement. After eight (8) years, the credit is not applicable. s. MISCELLANEOUS.. A. Severability. If any portion, section, subsection, sentence, clause, paragraph, or phrase of this Agreement is for any reason held invalid, such decision shall not affect the validity of the remaining portion of this Agreement. B. Amendments. There shall be no amendments to this Agreement unless in writing, signed by the parties and approved by resolution of the City Council. C. Interpretation. This Agreement shall be interpreted in accordance with and governed by the laws of the State of Minnesota. The words herein and hereof and words of similar import, without reference to any particular section or subdivision, refer to this Agreement as a whole rather than to any particular section or subdivision hereof. Titles in this Agreement are inserted for convenience of reference only and shall be disregarded in constructing or ink'.p.eting any of its provisions. D. Jurisdicition. The credit is a fixed amount and shall remain effective for a period of eight (8) year. The credit will expire if a final plat application for this property is not submitted within that time frame. Please review this agreement and let me know if you have any questions. Hopefully, this agreement will be satisfactory and ready to sign. The City Council will consider this agreement at their meeting on December 4, 2006. At that same meeting, we will be asking the Council to authorize the staff to seek bids for the relocation of the barn and construction of footings on the Heritage Farm site.
