CONSIDER ADOPTION OF RESOLUTION 98-XX DENYING AN
AMENDMENT TOl.l1E ZONING ORDINANCE RELATING TO
REGULATIONS FOR T.l1E OPERATION OF MOTORIZED
RECREATIONAL VEIDCLES
Historv: On July 6, 1998, the City Council adopted a motion to deny an
amendment to the Zoning Ordinance relating to regulations for the operation
of motorized recreational vehicles. At the same time the Council directed
the staff to prepare a resolution with findings of fact supporting the denial of
this ordinance. At that same meeting, the city Council adopted Ordinance
98-13 extending the moratorium on the use of dirt bikes and motocross bikes
for an additional six months.
Current Circumstances: Resolution 98-XX (see attached) includes a
statement of findings and facts based on the testimony provided at the public
hearing and discussion by the Planning Commission and City Council.
Ordinance 98-13 provides for additional study of this issue, as noted in the
resolution,
The Issues: The only issue in this case is whether the attached resolution
addresses the findings of facts intended by the City Council.
Conclusion: The attached resolution was prepared according to the
directive of the City Council. The staffwill continue to study this issue.
Budf!et Imoact: There is no direct budget impact by this item.
The City Council has two alternatives:
1. Adopt Resolution #98-XX denying the proposed regulations on
recreational vehicles.
2. Defer this item and provide staff with specific direction.
Motion and second as p ofthe consent agenda to adopt Resolution 98-XX.

RESOLUTION DENYING A PROPOSED AMENDMENT TO TUE ZONING
ORDINANCE REGARDINGLtlE USE OF RECREATIONAL VEmCLES

WHEREAS, the City Council of the City of Prior Lake initiated an amendment to the
Zoning Ordinance for the regulation of all recreational vehicles; and
WHEREAS, legal notice of the public hearing was duly published in accordance with
Minnesota Statutes and Prior Lake City Code; and
WHEREAS, the Planning Commission conducted a public hearing on the proposed
ordinance on June 22, 1998, to provide interested persons an opportunity to
express their views; and
WHEREAS, on June 22, 1998, the Planning Commission voted to recommend to the City
Council that they not enact the proposed amendment to the Zoning
Ordinance; and
WHEREAS, on July 6, 1998, the Prior Lake City Council considered the proposed
amendment to the Zoning Ordinance; and
WHEREAS, the City Council received the recommendation of the Planning Commission
to not enact the proposed amendment to the Zoning Ordinance along with
the staff reports and the minutes of the Planning Commission meetings; and
WHEREAS, the City Council has carefully considered the testimony, staff reports and
other pertinent information contained in the record of decision of this case.
NOW T.l1.EREFORE, BE IT RESOLVED BY T.l1E CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that the proposed amendment to the City of Prior Lake Zoning Ordinance is
hereby denied based upon the following fmdings of fact.
FINDINGS OF FACT
1, The recitals set forth above are incorporated herein,
2. Testimony at the public hearing indicated the proposed ordinance placing restrictions on all
types of recreational vehicles is too broad and too restrictive.
3. The proposed ordinance does not adequately address the issue of racing the vehicles or
establishing race tracks.

4. There is a need for additional study of this issue to develop an ordinance which will address
the primary issues involved with the use of these vehicles.
