PERTAINING TO THE ACQillSITION OF TAX FORFEITED
LANDS
Historv: Periodically, the Scott County Auditor submits a list of
properties in the County which will be on the next tax forfeiture sale.
The City has the opportunity to request a specified use deed from the
State for any of these parcels. A specified use is defined as any public
use. The City may also purchase fee title to the property at market
value ifit desires. If the City takes neither action, the property is sold
at auction.
Current Circumstances:.. Several parcels ofland in the City of Prior
Lake are currently in tax forfeiture (as shown on attached Exhibits A-
G). Most of the parcels are small strips ofland or remnant pieces. The
larger parcels are generally wetlands or drainage areas.
The Issues: If the City acquires property through a specified use deed,
the property may only be used for the specified use. These uses
include parks, drainage, roads, or other public uses. There is no cost
involved in acquiring these parcels through this process; however, the
City should not acquire any parcels without a current or future public
purpose. The properties in question have been forfeited to the State of
Minnesota for the non-payment of property taxes.
Conclusion: The Development Review Committee has reviewed
these parcels on the basis of whether there is a public need to acquire
the land. Below is a list of these parcels and the staff recommendation
on the acquisition of each parcel.
. 25-162-002-0 and 25-162-006-0 These parcels, shown on Exhibit
B, are located on the south side of Cates Street, west of Albany
Avenue and east of CJ Circle. There is a wetland and a creek on
these parcels, and they are unbuildable. The parcels should be
acquired for drainage purposes.

· 25-244-006-0 This parcel, shown on Exhibit C, is a strip ofland
located on the south side of 150th Street, just west ofFish Point
Road, and north ofFish Point Park. This parcel was dedicated in
Nystrom 1 st Addition, and was intended as a walkway to the park
although it was never deeded to the City. There is a strip of
parkland adjoining this parcel on the east side. The City currently
maintains this parcel, and should designate it for parkland.
· 25-902-098-0 This parcel, shown on Exhibit D, is located at the
southeast quadrant ofthe intersection ofTH 13 and CR 23. The
property will be used for a stormwater detention pond. The Prior
Lake/Spring Lake Watershed District intends to acquire this
property for that purpose. There is no need for this property for the
future extension ofCR 23.
· 25-930-117-0 This parcel, shown on Exhibit E, is a 30' wide strip
ofland located on the north side ofTH 13,just southwest of
Glascow Trail. This property is used as a private driveway. There
is no public purpose for this property.
· 25-933-007-0 This property, shown on Exhibit F, is a remnant
parcel located on the south side of CSAH 82, and west of CSAH
81. The parcel was probably created when the County Road was
extended. The City has no public purpose for this parcel.
· 25-155-028-1 This parcel, shown on Exhibit G, is a 4' wide strip
of land located on the north side of Condons Street. There is no
public purpose for this parcel.

The staff recommends parcels 25-162-002-0, 25-162-006-0 and 25-
244-006-0 be acquired through the specified use deed.
Budpet ImDact: There is no cost in acquiring these parcels. There
may be some future costs involved in maintaining the wetland area.
The City Council has three alternatives:
1. Adopt Resolution 98-XX approving the acquisition of the tax'
forfeiture parcels.
2. Deny Resolution 98-XX.
3. Deferthis item and provide staffwith specific direction.
A motion and second to adopt Resolution #98-XX authorizing the

RESOLUTION PERTAINING TO THE CITY ACQUISITION OF TAX FORFEITED
PARCELS
MOTION BY: SECONDED BY:
WHEREAS, the Scott County Auditor has submitted a list of properties, shown on Exhibits A,
B and C, that will be on the next tax forfeiture sale; and
WHEREAS, Minnesota Statutes allow the City to request a specified use deed from the State
for a property on the tax forfeiture list; and
WHEREAS, the City Council has reviewed this list and determined there is a specified need
for three of the these parcels (shown on Exhibit B and C); and
WHEREAS, the City Council has determined the City acquisition of these parcels IS
consistent with the goals and the policies of the 2010 Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council that a specified use
deed for each ofthe following parcels should be acquired:
. 25-162-002-0 and 25-162-006-0 These parcels, shown on Exhibit B, are located on the south
side of Cates Street, west of Albany Avenue and east of CJ Circle. There is a wetland and a

angles to the Southeasterly line of said Outlots
D and E) of Outlots, D and E, Mitchell Pond,
according to the plat thereof on file and of
record in the Office of the Register of Deeds,
Scott County, Minnesota.
Lot 1 Block 2, Holly Court, according to the
plat thereof on file and of record in the Office
of the County Recorder, Scott County, Minnesota.
Lot 5 Block 2, Holly Court, according to the
plat thereof on file and of record in the Office
of the County Recorder, Scott County, Minnesota.
Outlot A, Nystrom 1st Addn according to the
plat thereof on file and of record in the Office
of the County Recorder, Scott County, Minnesota.
That part of the Southeast 1/4 of the Southwest 1/4
of Section 2, Township 114, Range 22, Scott County,
Minnesota, described as follows: Commencing at the
Southeast corner of Lot 6, Jo-Anna Stepka's 4th
Addn, according to the recorded plat thereof;
thence West along the South line of said Lot 6 a
distance of 140.0 feet; to the Southwest corner of
