CONSIDER APPROVAL OF TEMPORARY 3.2
LIQUOR LICENSE FOR CONOCO SOFTBALL TEAM

Conoco softball team is requesting a temporary 3.2 liquor
license in order to sell 3.2 beer at the ASA District IV Men's
C Softball Tournament hosted at The Ponds Park August 15
and 16. The City of Prior Lake Parks and Recreation
Department was awarded the bid to host this district
tournament. Conoco softball team has volunteered to operate
the 3.2 beer concession with the caveat that 50% of the
revenue received will be donated to the Parks and Recreation
Department for the purchase of additional netting and
improvements of Mangan Fields at the Ponds. The Conoco
softball team will be selling beer from a portable dispensing
trailer located by the concession building from 10:00 a.m. to
11:00 p.m. on August 15 and 16,1998.
The Issues
Dram Shop insurance will be carried through the Minnesota
Sports Federation, sponsoring organization of the
tournament. The $25.00 application fee has been requested
to be waived due to the revenue benefit for the City. The
Prior Lake Police Department has found no reason to deny
the application. A park patrol officer will be present for both
of the days of the tournament. The Parks and Recreation
Department's Softball League Director will also be acting as
Tournament Director and will be overseeing the operation of
the beer concession stand. No outside coolers will be
allowed at this tournament to ensure that the 3.2 beer
dispensed from this concession stand will be the only beer
allowed in the park. Attached to this agenda report is a copy
of the Minnesota Sports Federation Dramshop Liquor
Liability Insurance Program Information.

The City Council has the following alternatives:

the temporary 3.2 liquor license for Conoco softball team.
2. Deny the temporary 3.2 liquor license request.
RECOMMENDED
MOTION:
Staff recommends City Council approve the temporary 3.2
liquor license for Conoco softball team for the period of
August 15, 1998 through gust 16, 1998.

DRAMSHOP (LIQUOR LIABILITY) INSURANCE
PROGRAM INFORMATION
Minnesota State law requires the minimum limits of liquor liability insurance be present when a liquor license is in
effect. (statute or 1945. section 34095) In addition to this Minnesota statutory requirement the legal profession
in your community is closely watching potential claims arising out of any automobile accident. personal argument
or assault that might possibly have origil"sted frorn your softball activities. Increasingly, legal counsel tor the
victim(s) is pointing the finger of guilt at the parties responsible for the sale of alcoholic beverages.
Those leagues/tournament directors and cities that have been violating state law and taking a tremendous risk bv
selling beer without the required liquor liability insurance may once again protect themselves against IS potentially
catastrophic lawsuit through the group purchasing power of the Minnesota Sports Federation,
Here are the details of the insurance program:
Cost: ,. $5.00 per $100.00 in gross receipts or a minimum of $125.00 a day for a three day event. (If
event/length of coverage is greater than three days a minimum premium of $625.00 shall be
submitted.) Contingent upon final gross receipts additional premium will either be due or refunded.
(Accounts with II prior history will be espeeted to submit the previous years total premium and it
receipts fall shon the applicable premium amount will be refunded.) All accounts are subject to
outside audit I
2, A $100.00 performance deposit is required per application, Deposit is refunded in hJII upon
submission of required sales receipts/reports.
3. A $50.00 program administration fee is required per application.
4. In order to qualify the license must be held by a single group for the entire season and effective
dates of license must be inclusive of all tournament/league dates.
5. Only tournament weekends/league dates listed on the application form will be covered.

:onditions: 1, Beer drinking trophies may not be offered (we suggest hotdog eating or pop drinking. etc,).
2, Tournaments must be ASA-MSF sanctioned and adhere to established rules and regulations,
3. All umpires and teams must be ASA-MSF members and umpires must be in ASA regulation
uniform and emanate from the local officials' association which works the regular season play.
4. Beverages' must be dispensed by Minnesota Sports Federation members. Members of the
Federation include: players on a member team. team managers of member teams. member
umpires. sanctioned tournament directors. league directors and individual members. (those who
purchase individual memberships at $5.00 each) If the tournament host plans to have an
indjviduat(s) serve beverages who are not MSF members they must purchase individual MSF
memberships at $ 5 .00 each.
To maintain this very reasonable premium it is imperative that all softball and tournament direcrors aSSllre thiH
beverages ~re dispensed in an responsible manner. A flyer which details your responsibilitiE:c will accompany your
certificate of coverage which will be forwarded upon receipt of your application.
