Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT January 2, 2007 xJ 5B .~ Frank Boyles, City Manager CONSIDER APPROVAL OF AN AMENDMENT TO PRIOR LAKE CITY CODE SECTION 802 RELATING TO DOGS AND CATS Introduction The purpose of this agenda item is to receive Council approval of an amendment to the dangerous dog ordinance requiring a $300,000 surety bond or insurance policy rather than $50,000 as provided in section 802 of the City Code. Historv The City Council received a report from Police Chief Bill O'Rourke regarding the City's dangerous dog ordinance. While reviewing the ordinance, the Council directed that the surety bond and insurance policy requirements be modified from $50,000 to $300,000. Current Circumstances The proposed ordinance amendment (attached) will accomplish the Council's direction. The Council desires that there be greater financial protection in the event a person is injured by a dangerous dog. This amendment will accomplish that direction. 1. Adopt the ordinance amendment as proposed as part of the consent agenda. 2. Remove the item from the consent agenda for discussion or amendment. Prior Lake, MN 55372-1714 CITY OF PRIOR LAKE ORDINANCE NO. 107-xx AN ORDINANCE AMENDING SECTION 802 RELATING TO DOGS AND CATS The City Council of the City of Prior Lake does hereby ordain that: Section 1: Subsection 802.1705 is amended as follows: 802.1705 Suretv Bond. A surety bond issued by a surety company authorized to conduct business in this state in a form acceptable to the animal control authority in the sum of at least $50,000 $300.000 payable to any person injured by the dangerous dog or a policy of liability insurance issued by an insurance company authorized to conduct business in this state in the amount of at least $50,000 $300.000 insuring the owner for any personal injuries inflicted by the dangerous dog. Section 2: This ordinance shall be come effective upon passage and publication in the City's official newspaper. Passed by the City Council of the City of Prior Lake this 2nd day of January, 2007.
