CONSIDER APPROVAL OF A REPORT DIRECTING STAFF TO NEGOTIATE
EASEMENTS FOR THE CR 21 TRAIL AND 150TH STREET LIFT STATION
Introduction
The purpose of this agenda item is for the City Council to authorize staff to
negotiate easements on the City's behalf for the CR 21 Trail and 150th Street Lift
Station.
History
CR 21 Trail
The City Council has previously approved the preparation of the feasibility study.
For the CR 21 project between Franklin Trail and Adelmann Street. This project
is scheduled for 2007 pending City Council approvals of the feasibility study,
cooperative agreement and construction plans.
150th Street Lift Station
The City owns and operates the 150th Street lift station. This lift station serves
approximately eight homes. The City is currently engaged in litigation to remove
impediments from the existing City easement needed to service this lift station.
Current Circumstances
CR 21 Trail
As part of the CR 21 project the City's existing trail west of the Fire Station needs
to be moved and reconstructed. This work requires an easement from the
existing property owner.
150th Street Lift Station
Currently the City does not have access to a portion of the maintenance
easement. For this reason staff recommends obtaining an easement from the
Dennehy Property to ensure permanent access to the lift station.
CR 21 Trail
If the City does not acquire the required easement reconstruction of the existing
trail will be expensive and may not be feasible. Additionally the delay in
acquiring an easement could result in delays to the overall project.
150th Street Lift Station
Failure to acquire this easement could impact the City's ongoing litigation related
to this lift station and limit access for maintenance.

FINANCIAL
IMPACT:
The total financial impact is expected to be less than $5,000 for both easements.
The easement costs of the CR 21 trail will be part of the project costs. The costs
associated with the 150th Street Lift Station will be funded by the Utility Fund.
ALTERNATIVES: The alternatives are as follows:
1. Direct staff to negotiate the CR 21 Trail and 150th Street Lift Station
easements for City Council approval.
2. Deny this item for a specific reason and provide Staff with direction.
3. Table this item until some date in the future.
