Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT FEBRUARY 5, 2006 10A STEVE ALBRECHT, DIRECTOR OF PUBLIC WORKS CONSIDER APPROVAL OF A RESOLUTION ORDERING THE PREPARATION OF A FEASIBILITY REPORT FOR THE INDUSTRIAL PARK UTILITY AND STREET IMPROVEMENT PROJECT AND AUTHORIZING STAFF TO SOLICIT PROPOSALS FOR ENGINEERING SERVICES Introduction The purpose of this Agenda item is to initiate the process for local improvements of the Industrial Park in accordance with Minnesota Statutes (M.S.), Chapter 429 Special Assessments. The first step in the process is to authorize a feasibility study and direct staff to obtain proposals to accomplish such work. History On September 18, 2006 the City Council placed the Welcome Avenue Industrial Park Utility Extension Project in the 2007 Capital Improvement Program (CIP). This project covers Industrial Circle, Credit River Road and Welcome Avenue. The existing Industrial Park is not served by City utilities. Currently properties are served by individual wells, septic systems and sewage holding tanks. The Council noted the Industrial Park's location in the Wellhead Protection Area and potential for redevelopment as reasons for inclusion. The Industrial Park is located within the City's High Vulnerability Zone of the Wellhead Protection Area. This area is highly vulnerable to potential groundwater contamination. The existing septic systems and wells are considered potential contamination sources for the groundwater. Current Circumstances On January 16, 2006 the City received a petition from 39% of the property frontage on Credit River Road and Welcome Avenue within the Industrial Park area for preparation of a feasibility study. A minimum of 35% of the properties must sign a petition for 429 improvements to proceed based on a petition. The petition also included signatures from Industrial Circle. Including Industrial Circle the petition included 35% of the property frontage in the Industrial Park. Based on the proximity of City utilities, Scott County which is responsible for the permitting and monitoring of onsite sewage treatment systems in the City has indicated that no additional septic systems will be allowed if a utility extension is not planned. Without the extension of sewer to the Industrial Park no additional development or redevelopment can be permitted. The 429 Improvement Process applies to all projects that will be financed in whole or part through special assessments or bond proceeds. The first step in the process is for the Council to order preparation of a Feasibility Report for the improvement projects. The City is required to assess a minimum of 20% of the cost of a public improvement project completed through the Chapter 429 process and financed through G.O. bonds. The Feasibility Report will determine the estimated costs of improvements and methods of financing. The Feasibility Report will also determine if the assessment will meet the minimum requirement as set forth in the Chapter 429 process. The preparation of the Feasibility Report is only the first step in the public improvement project. Due to the Engineering Department's current workload which includes feasibility studies for the CR 21 and CR 12/TH 13 Projects along with working on utility plan design for the CR 21 project a consultant will be needed to assist with this project. Following receipt of the Feasibility Report, the Council will direct City Staff to abandon or proceed with the Chapter 429 process, dependent upon whether the requirements for the Chapter 429 are being met. If the Chapter 429 process is to proceed, the Council can then schedule a Public Hearing. Following a Public Hearing, the Council may consider authorizing the preparation of plans and specifications. Once completed, the City Council would be asked to approve the plans and specifications, authorize advertisement for bids, conduct the special assessment hearing and then award the contract. ISSUES: There are several reasons which support the completion of this project. 1) The existing septic systems and wells pose an on-going threat to the City's water supply due to their location within the High Vulnerability Zone of the Wellhead Protection Area. 2) The property in this area is ideal for industrial development considering its adjacency to County Road 21. But no additional development or redevelopment can occur without utility extension to the Industrial Park. 3) The City has limited commercial and industrial property available for immediate development once Deerfield Industrial Park is completed. FINANCIAL IMPACT: The financial impact of this project will be further analyzed in the Feasibility Report. ALTERNATIVES: The alternatives are as follows: 1. Approve a resolution ordering the preparation of a Feasibility Report for the Industrial Park Utility and Street Improvements and directing staff to solicit proposals for completion of such work. 2. Prior Lake, MN 55372-1714 RESOLUTION 07 -xx Motion By: Second By: WHEREAS, it is proposed to construct improvements for Industrial Circle, Credit River Road and Welcome Avenue including the construction of storm sewer, sanitary sewer, watermain, aggregate base, concrete curb and gutter, bituminous surfacing, and appurtenant work; and WHEREAS, a petition of greater than thirty-five (35%) of the affected property owners has been received by the City for preparation of a feasibility study; and WHEREAS, the report will provide information regarding whether the proposed project is necessary, cost-effective, and feasible; and WHEREAS, The extension of utilities is necessary to protect the City's Wellhead Protection Area and to permit development in the Industrial Park. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. That the proposed improvements be referred to the City Engineer for study and that he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvements are necessary, cost-effective and feasible and as to whether they should best be made as proposed or in connection with other improvements, and the estimated costs for the improvements as recommended. 3.
